REGULAR M371ETING - FEBRUARY 9, 1970
A regular meeting of the Commissioners' Court of Brazos County,
Texas, was held in the Commissioners' Courtroom in the Courthouse
in Bryan, Texas, beginning at 10:00 A. M. on Monday, February 9,
1970, with the following present:
William R. Vance, County Judge, presiding;
Raymond A. Nolan, Commissioner of Precinct 1;
George Dunn, Commissioner of Precinct 2;
Clyde J. Porterfield, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The minutes of the regular meeting held January 12th and
the special meeting held February 2, 1970 were read and approved
without change.
The Court received, approved and ordered filed as submitted
the following reports for January:

The Court received, considered and approved the following

Co-:.missioner iorterfield moved that the plat be approvod with the
understanding that the County would be under no obligation to build,
co:,struct, or maintain any of the streets or roads in said Subdivision.
Co:.missioner Nolan seconded the motion which unanimously carried with
the understanding that the approval would be with the receipt of a
letter from the City of College Station that the property is not in-
cluded in their extra-territorial 3ursidietion.
The Court next heard from Joe Novosad, Justice of the Peace of
Precinct 8 who stated that his Court had been an active Court in spite

Co-rumissiover Stasny stated that the County would not accept the main-
tenance on a permanent basis since the road is a private road, but
a;-reed to consider accepting the right of way.
':ext presented for consideration was the final approval of a
contract with the Texas Department of Public Welfare concerning the
establishment of a Food Stamp Program for Brazos County. Commissioner
Stasny moved that the contract be executed, seconded by Commissioner

Dunn motion unanimously carried. A copy of such contract is attached
to these minutes.
The County Judge next presented a request from the Texas Agri-
culture Extension Service that office space be furnished in the
present office of the County Agent for an additional employee to work
with an Expanded Nutritional Program (Youth) in conncetion with the
Food Stamp Program. Commissioner Stasny moved that such office space
be provided. Motion seconded by Commissioner Dunn the motion un-
animously carried.
The County Judge next presented a proposal by the Texas Department
Of Public Welfare for the establishment of a Child Welfare Program
for Brazos County, Texas. After a discussion the Court agreed that
further information was necessary prior to a determination of the
matter.
On motion duly made, seconded and unanimously passed, the Court
voted to approve all reports and pay all bills which have been properly
filed and approved.
There being no further business, the meeting adjourned.
SPECIAL.MEETING - MARCH 2, 1970
The Commissioners Court of Brazos County, Texas convened in
Special Session at a Special term of said court, on the 2nd day of
March, 1970 in the county courthouse in Bryan, Texas,i and the roll was
called of the duly constituted officers and members of said-court, to wit:
William R. Vance, County Judge, presiding;
Raymond Nolan, Commissioner, Precinct #1;
George Dunn, Commissioner, Precinct #2;
Clyde J. Porterfield, Commissioner Precinct #3;

and all of said persons were present, except the following absentees:
Clyde J. Porterfield, thus constituting a quorum. Whereupon, among other,
business the following was transacted at said meeting; a written
ORDER CALLING ELECTION was duly introduced for the consideration of
said court and read in full., It was then duly moved and seconded that
said order be adopted; and,iafter due discussion, said motion,
' carrying with it the adoption of said order, prevailed and carred by the
following vote:

WHEREAS, on February 9, 1970, a petition was presented
to the Conumissioners Court requesting the holding of an
election to determine whether the voters of BRAZOS COUNTY favor
the creation of an airport authority to consist of the area

WHEREAS, it is hereby officially found and determined
;,nat said petition was signed by more than five percent of
the qualified taxpaying voters of BRAZOS COUNTY; that said
petition was signed by more than five percent of the qualified
resident electors of BRAZOS COUNTY; and that said petition is
Cuily auequate in ali respects; and
WHEREAS, it is hereby officially found and specified
that a tax not to exceed twenty (20) cents on the $100
assessed valuation is the amount of the annual tax to be

now authorized and required to call and hold, in accordance
~iLn the Constitution and laws of the State of Texas, particu-
larly Section 12 of Article IX of the Constitution of Texas-

Section 1. An election shall be held in BRAZOS COUNTY
on the
21st day of March, 1970; the polls shall be open for
voting
from 8 a.m. to 7 p.m. at the following polling
places
in each of the following precincts heretofore estab-
lished
and described byenatural or artificial boundaries or
survey

Each presiding judge shall appoint not less than two
or more than the maximum number of election clerks specified
above to serve at the polling place under his ,jurisdiction.
Frank Boriskie is hereby appointed as the clerk for
absentee voting; and the:

Bryan, Texas 77801
is designated as the place for absentee voting for said elec-
tion. During the lawful absentee-voting period, said clerks
shall keep said place for absentee voting open for absentee
voting from 6 a.m. to 15, P.M. on each day except
Saturdays, Sundays, and official state holidays.
Section 2. At said election the following PROPOSITION
shall be submitted in accordance with law:
PROPOSITION
SHALL THE BRAZOS COUNTY, TEXAS, AIRPORT AUTHORITY, TO CONSIST
OF THE AREA WITHIN BRAZOS COUNTY, BE CREATED; AND SHALL SAID
AUTHORITY BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND
COLLECTED AN ANNUAL AD VALOREM TAX OF NOT TO EXCEED TWENTY
(20) CENTS ON THE $100 VALUATION OF PROPERTY IN ACCORDANCE
WITH SECTION 12 OF ARTICLE IX OF THE CONSTITUTION OF TEXAS
AND HOUSE BILL NO. 189, CHAPTER 374, ACTS OF THE 61ST
LEGISLATURE OF TEXAS, REGULAR SESSION, 1969?

;i Section 3. Paper ballots shall be used and the offi-
cial ballots for the election shall be prepared in accordance
with the Texas Election Code so as to permit the electors to
vote "FOR" or "AGAINST" the aforesaid PROPOSITION, which
shall be set forth on all official ballots in substantially
the following form:

Each elector shall vote on the PROPOSITION by placing an "X"
or other clear mark in the square beside the statement indi-
cating the way such elector wishes to vote on the PROPOSITION.
Section 4. It is hereby officially found and deter-
mined that certain recent decisions of the Supreme Court of

the United States of America may have created uncertainty as
to the lawful manner of calling and conducting said election;
therefore, said election shall be called,, held, and conducted
as two separate but simultaneous elections, to-wit: one elec-
tion at which only the resident, qualified electors of the
County who own taxable property within the County and who have
rendered the same for taxation shall be entitled to vote on
the PROPOSITION and another election at which all other
resident, qualified electors of the County shall be entitled
to vote on the PROPOSITION. The votes cast at each of said
separate but simultaneous elections shall be recorded,
returned, and canvassed separately.

Section 5. Notice of the election shall be given by
publication of a substantial copy of this election order at
least one time in a newspaper of general circulation in
BRAZOS COUNTY, the date of the first publication to be not
less than 14 days prior to the date set for the election.
Section 6. The election shall be held in accordance
with the Texas Election Code except as modified by Chapter
374, Acts of the 61st Legislature of Texas, Regular Session,
1969.
Section 7. It is hereby found that the need of the
County for the creation ofthe Authority and for such financ-
ing creates an emergency and an urgent public necessity for
the holding, at the scheduled time, of the meeting of the
Commissioners Court at which this order is adopted and for
the adoption of this order; and the NOTICE OF MEETING relat-
ing to said meeting and heretofore posted by the County
Clerk of BRAZOS COUNTY, and the posting thereof, are hereby
authorized, approved, adopted, ratified, and confirmed.,

The next matter presented was the purchase of the property at
24th and Washington Streets from the BLD Agency. Commissioner Stasny
moved that the property be purchased for the amount of $809000.00 upon
the terms set forth in the contract dated January 30, 1970- Motion was
seconded by Commissioner Nolan and unanimously carried. Commissioner
Stasny further moved that the following order be adopted for the
purpose of issuing a County Warrant, such motion was seconded by
Commissioner Nolan as follows:
"IT IS ORDERED that the Court approve the issuance of a Time
Warrant in the sum of $64,000.00 for the prupose of purchasing, paying
for and improving certain land and the improvements situated thereon in
Brazos County, Texas, described as Lots Number One and Two, Block Number
Twenty-Eight, City of Bryan, Brazos County, Texas, to be used°for
office space and parking for offices or agencies designated by;.the
Commissioners Court of Brazos County, Texas. The said warrant will
be payable in ten equal annual installments in the amount of $6,400.00
each, payable on the 2nd day of March of each year for ten years beginning
March 2, 1971;.: to bear interest on the unpaid portion at the rate of
6% per annum, the interest payable annually in addition to the said
installments of principal.
It is further ORDERED that there shall be an annual levy and
collection by taxation of a sufficient amount to pay all interest on.
said warrant and to create a sinking fund sufficient to retire all
annual installments on said Warrant as they shall become due and
payable. Such Warrant shall be payable to J. A. Blasienz, Joe T.,Locke,
Jr., and J. B. Don Dougherty, and shall be paid out of the+'';
PERMANENT IMPROVEMENT FUND."
Motion unanimously carried and-it is so ORDERED.
There being no further business the Court adjourned.

CONTRACT FOR COMPILING A DELINQUENT TAX RECORD

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, Article 7336f, Vernon's Revised Civil Statutes of Texas, requires that the Assessor-Collector of
Taxes shall cause to be compiled a delinquent tax record; and,
WHEREAS, Article 7336f further requires that the Assessor-Collector of Taxes shall cause to be prepared a
two year supplement, or a recompilation, when as many as two years taxes have become delinquent which are not shown
on the delinquent tax record of his county; and,
WHEREAS, the Assessor-Collector of Taxes for Brazos County, Texas deems it necessary
and expedient to contract with a competent firm to compile said delinquent tax record under his ,
supervision; and,
WHEREAS, C. R. Law Tax Records, Inc., with its principal office in Austin, Travis County, Texas, is engaged
in and now does such work and represents that it is fully equipped, competent and capable of performing the above desired
work and is willing and ready to perform said work in accordance with the provisions of law, rulings of the Comptroller
of Public Accounts, Austin, Texas and suggestions of the Assessor-Collector of Taxes for B razos
County, Texas; and, I
WHEREAS, after having made careful investigation of C. R. Law Tax Records, Inc. and after having considered
the same, the Assessor-Collector of Taxes for Brazos County, Texas desires to enter into contract
with said C. R. Law Tax Records, Inc., for compiling a delinquent tax record for the years
to i both inclusive.
NOW THEREFORE, this contract made and entered into by and between Raymond B. Buchanan
Assessor-Collector of Taxes for Brazos County, Texas hereinafter called "Collector" and C. R. Law '
Tax Records, Inc., hereinafter called "Contractor."

showing all the unredeemed, uncancelled delinquent taxes remaining charged on the official delinquent tax records and
delinquent lists of Brazos County, Texas for said years.

The general arrangement and set up of the record shall be made as required by law, rulings of the Comptroller of
Public Accounts, Austin, Texas and suggestions of Collector. The record shall be written on the paper and form pre-
scribed by the Comptroller of Public Accounts. The record shall be bound as directed by Collector. The expense for bind-
ing the two copies of the record to be delivered to B razor County shall be paid by Brazos
County in addition to the compensation paid to Contractor for compiling the record.

Contractor shall compare the credits shown on the copy of the delinquent tax records and delinquent lists of
B razor County on file in the offiice of the Comptroller of Public Accounts, Austin, Texas with the
credits shown on the original copy of said records in the office of Collector. Contractor shall report all errors in credits to
Collector.- Contractor shall also report any errors in description, or other discrepancies discovered during the compilation of
the record to Collector.

Collector agrees and binds himself to give to Contractor full and complete cooperation during the progress of the
work contemplated herein and to make available to Contractor such data and information concerning the records of his office
as may be found necessary, and to allow Contractor fulland free access to the records of the tax office.

Collector agrees to furnish contractor satisfactory space for the performance of that portion of the work contem-
plated under this contract which must be performed in the office of Collector.

This contract shall apply to and bind Collector and his successors in office and shall apply to and bind Con-
tractor, its successors, assigns and legal representatives.

Collector agrees and binds himself and his successors in office to give expeditious attention to examination and '
approval of the record and to pay to Contractor upon completion, delivery and approval of the delinquent tax record
herein provided for and approval of the account for compiling the record the total sum for said
record; to-wit: Ten Cents ($.10) per item or written line, including lines of footings and recapitulation, shown on the
original copy of the record. Said payment to be made in the manner and as is provided by Article 7336f, Verron's Re-
vised Civil Statutes of Texas. -7A-
This contract includes the year 1969 which taxes are not now delinquent. It is agreed and
understood that the compilation will not be completed until after the 1969 taxes are reported
delinquent as of June 30, 1970.

foods
through a cooperative Federal-State
program to be operated through
normal channels of trade; and
WHEREAS, this Federal Law authorized the Secretary of Agriculture to pro-
mulgate rules and regulations for the purpose of carrying out the functions
and responsibilities imposed on the State Welfare Departments in setting up
the Food Stamp Programs; and
WHEREAS, Senate Bill No. 36, Acts of the 46th Legislature, Regular Session,
1939, as amended, codified as Article 695c, Vernon's,Texas Civil Statutes, and

other related laws authorize the State Department of!Public Welfare to administer

the program; and ,
WHEREAS, Brazos County has requested participation in the Food Stamp Pro-

gram in accordance with the "Food Stamp Act of 1964"; and

WHEREAS, the Commissioners' Court of Brazos County in a meeting on the
11th day of August, 1969, authorized William R. Vance, the County Judge of

Brazos County, as evidenced by the attached copy of the official Minutes of

the Commissioners' Court, to enter into this Contract with the State Department

of Public Welfare subject to the final approval of the Commissioners' Court, as

evidenced by the attached copy of the official Minutes of the Commissioners'
Court, and empowered the County Judge to take whatever steps are necessary to per-
feet and implement this Contract.

NOW THEREFORE, know all men by these presents, that this Agreement and

Texas, hereinafter referred to as the Department.

I.
The County agrees to comply with all reasonable rules and regulations
promulgated by the Department in order to comply with Federal requirements for
the purpose of the administration of this Program, and to keep such records as
are required for the efficient and economical administration of the Program,
and to make such reports from time to time as are required by the Department.
II.

The County agrees to furnish all necessary office space, equipment, tele-
phone service, and other incidental expenses for the total operation of the Pro-
gram in the County.
III.
It is understood and agreed that the Department will employ and supervise
J all of the necessary employees for this Program. The Plan for Personnel Admin-
istration-of the Department shall be applicable to all of the employees, and this
includes among other provisions, but is not limited to, the provisions relating
to job classifications, salary scales, travel expenses, Social Security tax,
retirement benefits, and all other so called "fringe benefits" available to
State employees.
The qualifications for the supervisors, workers and other
~ , personnel re-
quired in the
processing of the Non-Assistance cases shall be set by the Depart-
ment in accordance with Merit System standards and shall be the same standards

! as applied to supervisors and'workers servicing Public Assistances cases under
the Federal-State Public Assistance Programs administered by the Department.

The Department shall have the sole authority to employ, determine qualif-
ications in accordance with the Merit System-standards, and dismiss employees
in accordance with acceptable
personnel standards.
IV.

The personnel required for the operation of the Food Stamp
Program shall be
determined in relation to the case load, provided that the case
load of each

worker on the Program shall not exceed the average case load of
the Public
Assistance worker assigned to adult programs. The supervisory
staff shall be
determined on the same basis as the supervisory staff for the P
ublic Assistance
Programs, that is, one supervisor for each six (6) workers.

The number of employees will initially be determined on the basis of
the estimated case load, and the'County agrees to make additional funds avail-
able as needed for adjustments in personnel to keep the case load in balance
in accordance with the approved personnel practices of the Department.
V.
It is agreed and understood that the County shall provide all funds neces-
sary for the operation of the Food Stamp Program in the County, and that such
funds shall be paid to the Department in advance on a quarterly basis.
It is further understood that the Federal Government will reimburse the
Department a portion of the administrative expenses incurred in the operation
of the Program.

A Special Fund will be created to be administered by the Department, and
all such funds received from the County and as reimbursement from the Federal
Government for funds advanced by the County shall be deposited in such Special
Fund and disbursed upon authorization by the Commissioner or the Deputy Com-
missioner of Public Welfare in accordance with the laws authorizing the Food
Stamp Program as they now are or as they may be amended, and in accordance with
the provisions of this Contract.
The funds received through reimbursement will continue to be available
for the purpose of the administration of the Program in said County and shall
become a revolving fund to be taken into consideration throughout the life of
this Contract in the determination of the amount of funds to be advanced in all

succeeding quarters after the initial advancement for the operation of the Pro-
gram during the first quarter.
VI.
This Contract or Agreement may be terminated or cancelled without prejudice
to any right or claim which may have then accrued to either of the parties, by
either the Department or the County upon giving to the other party, a sixty (60)
day notice in writing of the intention to cancel or terminate the Agreement.
VII.
This Contract or Agreement has been made under the authority of Public
Law 88-525 and in accordance with the rules and regulations promulgated by the
Department of Agriculture in pursuance thereof, and,,the Laws of the State of Texas.

In the event the Federal or State Laws should be amended or judicially interpreted
so as to render the fulfillment of this Contract on the part of either party un-
feasible or impossible, or if the parties should be unable to agree upon modify-
} ing amendments which would be needed to enable substantial continuation of the

Program as the result of amendments or judicial interpretations, then, and in that
event, both the Department and the County shall be discharged from further oblig-
ation created under the terms of this Contract, except for equitable settlement
' of the respective accrued interests up to the date of the termination.
i It is further agreed that modifications or amplifying Agreements between the
t Department and the County may be necessary from time to time to enable the Depart-
ment and the County to operate the-Program in accordance with the needs of the
people served in the County and in compliance with changes in the Law, and/or of-
ficial
rules and regulations, and/or judicial interpretations.
k Only the Commissioner or the Deputy Commissioner of Public Welfare and the
i, duly elected County Judge of Brazos County have the power to change, modify, or
waive any provision of this Contract.

VIII.
In the event of the termination of this Contract or Agreement between the De-
partment and the County, the funds remaining on hand in the Special Fund belonging
to the County, after all due and just accounts are paid, shall be refunded to the
County, and all equipment or property made available by the County to the Department
for the operation of the Program shall be returned to the County.
