M. on Monday, MArch 11, 1968 with the following present: William R. Vance, County Judge, presiding; Raymond A. Nolan, Commissioner of Precinct 1; George Dunn, Commissioner of Precinct 2; Clyde J: Porterfield, Commissioner of Precinct 3; W. A. Stasny, Commissioner df Precinct 4; Frank Boriskie, County Clerk.,, The minutes of the regular meeting held Monday, February 129 1968, were read and approved without change. Hamilton next reported that he had talked with Mr. Ralph Bobbitt about the removal of a housetrailer that is extending out on the Western By-Pass right-of-way property. There was next presented the following MINUTE ORDER of The Texas Highway Commission: MINUTE ORDER WHEREAS, in BRAZOS COUNTY, The City of College Station and Brazos County have requested the designation and construction • of an extension of Farm to Market Road 60 from present State Highway 6 Northeast to the proposed location of State Highway 6, a distance of approximately 1.6 miles; and WHEREAS, an analysis of the request indicates that such a road would provide a desirable traffic facility; NOW? THEREFORE, the State Highway Engineer is directed to tender the following proposal to the City of College Station and Brazos County: Provided the City and /or County will: 1. Furnish all necessary right of way clear of obstructions and free of cost and provide for the construction of continuous curb and gutter, utility adjustments, storm sewers, etc., all as may be necessary for a complete project with the exception of pavement and its support. 2. Assume responsibility for the construction of driveways and sidewalks should they be deemed necessary and agree to make such installations in accordance with governing policies and regulations of the Department. 3. Maintain that portion of the work which is its re- sponsibility in accordance with present maintenance agreement and agree to regulate traffic, provide for parallel parking and prevent encroachment on the right of way, all in accordance with governing policies and regulations of the Department. The Texas Highway Department will: 1. Provi& for the construction of pavement and its support within these limits subject to the availability of funds from future Farm to Market Road Appropriations by the Texas Legislature. 2. Maintain that portion of the work which is its respon- sibility in accordance with present maintenance agreement. It is understood that the responsibility of the Texas Highway Department is confined to the pavement and its support, and all other features necessary now or in the future to provide an adequate travel facility shall be the responsibility of the City of College Station. Upon acceptance of the provisions of this Order by the appropriate officials of the City of College Station and Brazos County, IT IS ORDERED that a FARM TO MARKET ROAD be designated over these limits and the State H q way Engineer is directed to proceed with Engineering Surveys, the preparation of Right of Way data and to turn over such data to the City of C011%e Station and Brazos. T On the recomendation of Sheriff J. W. Hamilton, the Court unanimously agreed to accept the low bid of $29872.96 from Sellstrom Pontiac- Buick, Inc. for the purchase of a 1968 Pontiac Catalina, for the Sheriff's Office. Mr. D. Brooks Cofer, Jr., attorney for the Wellborn Water Supply Corporation next presented the following written notice by the Wellborn Water Supply Corp.: RESOLUTION ACCEPTING THE PROVISIONS OF STATE HIGHWAY COMMISSION MINUTE ORDER City and County have fulfilled their obligations under this . Order and.when plans are complete, the State Highway Engineer shall submit-the work for finance consideration of the Highway Commission in the next available program. It is understood that the City and/or County may discharge their construction obligations as outlined herein in any manner as they may elect. In the event the City and/or County desires the State to include their protion of the work in the State's Construction contract, the State Highway Engineer is hereby authorized-to enter into agreement with the City and/or County for such work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of College Station and Brazos.County and if not acce6ted within 90 days of the date hereof, the action herein contained shall be automatically cancelled. THE STATE OF TEXAS ¢ COUNTY OF BRAZOS Q BRYAN, TEXAS March 11, 1968 MOTION was made by Commissioner W. A. Stasnyand seconded by Commissioner Nolan that the Commissioners' Court of Brazos County accept the provisions contained in Minute Order No. 60547 passed by the State Highway Commission on February 29, 1968, for the improvement by the Texas Highway Department on the roads described below: Farm to Market Road160 from pres6nt State Highway 6 Northeast to the proposed location of State High- way 6, a distance of approximately 1.6 miles. MARCH 4, 1968 The Commissioners Court Brazos County, Texas Bryan, Texas Re: Wellborn Water Supply Corp. Gentlemen: As required by Article 1433 of Vernon's Annotated Revised Civil Statutes, and in accordance thereto, the above named water -supply corporation is advising that it proposes to lay its pipes, mains, conductors and other fixtures for conducting water through, under, along, across and over the public roads in the vicinity of Wellborn, Millican and'College Station, Texas, as shown by the attached Map dated February 28, 1968, from Duff Consulting EVnineers, Inc., Waco, Texas, made a part of this letter for all purposes. The above referred to Map is an extension of the corporation's system dated Ocotober 11, 1965 and which t' the Court approved on November 8, 1965. If the Court so desires, it is requested that the location along said right of ways be designated where such lines shall be constructed in cooperation with Commissioner Precinct One and the Corporation's engineer. Brooks Cofer, Jr. Attorneys for Wellborn Water Supply Corporation Commissioner Nolan commented on prior work done along and across ty roads by the Wellborn Water Supply Corp. and suggested s the Court should exercise its rights to designate the location of any such lines along the County roads involved. After further discussion the Court requested that Mr. Cofer invite the Consulting Engineers on the current project to meet with the Court on Monday, March 25th at 11:00 A. M. The Court next unanimously voted to postpone the sale date of the Eastern By-Pass Bonds from March 18th to March 25th, 1968 at 11:00 A. M. On motion made, and duly seconded the Court unanimously voted to set the opening hours for the polls for voting at 8:00 A. M. instead of 7:00.A. M. in all elections, according to article #201. The Court next unanimously voted to accept the resignation of Mrs. W. D. Scoates as alternate Election Judge of Precinct #13. The Court next heard from Mr. Ralph Bobbitt conserning his housetrailer's encroachment upon the Western By-Pass right-of-way. Mr.•Bobbitt explained that the weather would not allow its removal at the present time, whereupon the Court agreed to allow him 30 days to remove same. On motion made and duly seconded the Court unanimously agreed to pay the statement of James C. Smith, Appraiser, in the amount of $2,700.00 for appraising the parcels of land which are the subject of appeals from condemnation on the West By-Pass project. The County-Judge next called attention to the fact that the. 1968 voter registration list shows that Precinct 3, 13, and 18 are larger than the maximum 2,000 voters allowed under the Texas Election Code and pointed out that changes in voting Precincts should be made at the July or August term. Clary as Principal and the United States Fidelity and Guaranty Company as Surety to the State of Texas, dated March 49 1968 was approved. There was next presented the proposed Platt for Aggie Acres, a-subdivision in the W. H. Frazier Survey, Brazos County, Texas. Action on the proposed platt was postponed until the March 25th meeting at 11:00 A. M. The statement of S. W. Kowierschke, M. D. fog pathological services rendered in connection with criminal prosecution was presented, being amounts in excess of the $100.00 Statuatory Limitation for such services. The Court unanimously voted to pay such statement in the amount of $105.00. Upon further discussion the Court agreed that the limit upon the amount of payment for such services in the future would be $100.00 for an autopsy and an additional $50.00 for laboratory services in connection therewith, to be paid only upon the receipt of an itemized statement. On motion made by Commissioner Stasny, and seconded by Commissioner Nolan, the Court unanimously passed an order requesting that the BOARD OF COUNTY AND DISTRICT ROAD INDEBTEDNESS of the State of Texas disburse to Brazos County, Texas, the sum of $6,667.78 in available funds for the construction and improvement of County lateral roads. The Court next received the bid of Mr. James R. High, of L{ Waco, Texas for video tape equipment, in the amount of $2,245.25, Y 1 which was demonstrated for the Court. The bid was taken under consideration pending receipt of an additional bid. On motion made, seconded, and unanimously passed, the Court voted to approve all reports and to pay all bills which have been i properly filed and approved.
