(SEAL) And it appearing to the Court that the above named persons are all freeholders of Brews County and of the subdivision of said County therein described and designated an Justice Precinct Number 6,which petition was filed herein on the 9th day of September, 1961, praying that this Court order an election to be held in such subdivision for the purpose of enabling the freeholders thereof to determine whether beer-for otf-premise-r caneumption only may be sold legally,in this subdivision, and, it appearing to the Court that such petition is in due form, that no election ibr such purpose has ever been carried it such subdivision, that no election to d etermine said question has been held therein within 12 months prior to the filing of such petition, that the hereinafter described subdivision stands designated as one wi thin which such an election may be held, and that such petition should be granted, it to accordingly ordered that on the 7th day of October, 1961, such date being not less than 30 days from the date hereof an election shall be held throughout Justice Precinct No. 6, of Brazos Lounty, Texas, at the l,ommunity 6enter in Edge, Texas, to determine whether or not the sale of alcoholic beverages of the type or types specified in the proposed issue shall be prohibited or legalized within said area. Such election shall be held and conducted and the returns thereof made in accordance with the laws regulating general elections, in so far as the same are applicable and the laws applicable to sale of alcoholic beverages of such character, and the bounty Judge shall issue the order therefor and cause public notice thereof to be given as provided by law. On motion made, seconded and unanimously passed, the 6ommunity (.enter in 5dge, Texas, was designated as the polling place for such alcoholic beverage election to be held in Justice Precinct No. 6, and the following judges were appointed to hold such election: Vaughn R. Upon presenta- tion of defendant Marion C. Pugh's special exceptions, the Court subsequently overruled same. No fury being demanded the trial was held before the Court, and the Court after hearing the pleadings, the evidence, and arguments of counsel thereon, finds that the plaintiff is entitled to the permanent injunction as herein granted. The Court finds that the said Millican-Sulphur Springs Road Is a Public Road, said road having been established according to law by the Commissioner's Court of Brazos County, Texas; and further by general public use without interruption or substan- tial changes for more than ten years. It is accordingly ORDERED, ADJUD06D, AND D6CRERfl by the Court that defendants, Marion C. Pugh and Veteran's Land Hoard of Texas be, and they are hereby permanently and forever, enjoined from maintAinaing the fence, gate, or any fence or obstruction, across the roadway and adjoining ditches of the public road known as Millican-Sulphur Springs Road. Field notes of the Millican-%4phur Springs Road across Marion G. Rugh's 203.25 acres of land in the James Gray Survey, Brazos County, Texas, durther described in a contract of Sale from Veteran's Land Board of Texas to Marion C. Pugh, dated June 19, 195 and recorded in Volume 198, Page 149, Deed Recorda, Brazos County, Texas, form the survey made of same by B. J. Kling, Public Surveyor on August 24, 1960, are hereby adopted by the Court as the true location of said road. Said road being 40 feet wide and being 20 feet each side of the following described centerline, Beginning at a point in the center of the road as it is now traveled and in the South line of the tract of land now or formerly owned by Marion Pugh, said point also being 1424 feet, measured in a Westerly direction along said South line of said Marion Pugh tract from the Southeastern corner same being an iron rod from which a Post Oak 9 inches in diameter bears N 59-3/40 W 13.5 varas and an Elm 10 inches ih diameter bears N 20-1/20 5 14 ears; THsN66 N 340 45' E along the center of the road for a distance of 96.2 feet; THENCE N 460 17' E along the center of the road for a distance of 272.6 feet, THEN66 N 350 35' E along the center of the road for a distance of 523.7 feet; Tft tg N 420 26' s along the center of the road for a distance of 344.3 feet; THENt,g N 790 07' S along the center of the road for a distance of 151.9 feet, this point being at a crossing of the road with an underground pipe line, TH6NCS N 540 46' E along the center of the road at a distance of 464.3 feet cross a bridge continue for a total distance of 811.9 test, THENCA N 800 46' 9 along the center of the road at a distance of 203.4 feet the high bank of the Navasota River at a total distance of 246.4 feet the water's edge of the Navasota River. , It is further ORDzRaD by the Court that Plaintiff do have and recover its coats herein expended. W. Hamilton, and upon motion duly seconded and y unanimously adopted, the Court voted to accept the bid of the Corbusier Chevrolet Company of Bryan, Texas, as being the lowest, for one Bel Air 4 Door Sedan with R. C. Heater, Powerglide, Washers ELI Glass for a total of 42,754.25, and to trade in the used 1958 Brick Special 4 Door for =1,104.29, leaving a balance on the purchase price of $1,650.00, such amount to be paid from the General Fund. On motion duly seconded and unanimously adopted, the Court voted to authorise Commissioner Raymond Nolan to secure bids for a new pick-up truck to be used in Precinct No. 1. On motion duly s econd ed and unanimously adopted, the Court voted to have a "note of thanks" published in the Bryan Daily Eagle, to the citizens of Brazos County, who aided the Civil Defends in carrying out their program in providing food and shelter for the persons from the coast who were driven from their homes by Hurricane Carla. On motion duly seconded and unanimously adopted, the Court voted to pay all bills which have been properly filed and approved.
