Dear Judge Davis:
We are attaching a co of State Highway Commission Minute Order Number
48973, dated January py 31, 1961. This Minute provides for the construction
of a railroad grade separation and approaches at the F. M. Road 60 crossing
of the Texas and New Orleans Railroad and the Missouri Pacific Railroad near
the northwest corner of the campus of the A. & M. College of Texas, and within
the City of College Station. I
Under present Commission policies it is the responsibility of the county to
furnish, at no cost to the State and free of all encumbrances, necessary
right of way for F. M. Road construction, and it is also necessary that the
adjustment of utility lines and telephone lines be provided for by the
county, outside the limits of the A. & M. college of Texas or the City of
college Station.
This Minute is being tendered to Brazos county, as well as the other agencies
involved, and upon acceptance of the ttinute by all agencies the Texas Highway
Department will proceed with the construction of this facility.
You will note that this Minute is passed conditioned upon the various agencies
to which it is being tendered accepting its requirements within a period of
ninety days after the date of the Order. it will be appreciated if the Brazos
County commissioners' Court, at its earliest convenience, will take the
necessary action required by this Minute and return to this office for
further handling two copies of the attached form complete with motion and
signatures.
The utility line outlined as your responsibility is one belonging to South-
western Bell Telephone company and having two cross arms and sixteen wires.
We estimate at this time that there will be about fifty-five of these poles
to relocate. 11 you find that a detailed explanation of what will be
required of Brazos county is necessary, personnel from this office will be
available at your convenience.

crossing of tracks of the Texas and New Or sans Railroad and t he Missouri
Pacific Railroad near the northwest corner of the campus of the Agricultural
and Mechanical college of Texas, the present and anticipated highway and
railroad traffic indicates the need for the construction of a railroad grade
separation, and
WHr.R&►S, by commission Minute Order No. 36929, dated October 26,
1954, the State Highway Lngin~er was directed to proceed with necessary
negotiations with all agencies involved furnish the local authorities with
the right of way requirements, and compete surveys and place required for
the construction of a four lane railroad grade separation and approaches at
an estimated cost of 1375,000.00, and
WHY.RaAS, subsequent engineering studies have indicated that the
cost of said grade separation will be materially increased over the above
estimate, and
WHaRteS, benefits will accrue to the railroad companies, and
A8M college, and the local governments due to the construction of said grade
separation.
NOW, THaRtFORt, it is ordered that Minute Order No. 36929 shall be
modified to authorize the State Highway tngineer to tender to Brazos county,
the City of college Station, and Agricultural and Mechanical college of Texas,
the Texas and New Orleans Railroad company, and the Missouri Pacific Railroad
company the following proposal.
Provided that Brazos county will.
1. Furnish, at no cost to the State and free of all
encumbrances and including all necessary utility adjustments

all right of way needed for the construction of the said railroad
grade separation outside the limits of the City of College Station,
the property of A&M College, and the railroad rights of way, and

Public Roads contained in Policy and Procedure Memorandum No. 21-10,
except for preliminary engineering performed by the State, and the
cost of right of way and utility adjustments as otherwise provided for
herein, and
2. Agree to enter into the customary agreements with the State for the

granting of licenses, construction, maintenance, and contribution of

costs of the grade separation,

3. Agree to prepare detail plans for any underpass structure required to

be included in the general plans for the project,

The Texas Highway Department will.
1. Make all surveys and plans, except as otherwise provided for herein,
and cause to be constructed the proposed four lane grade separation
and roadway approaches, including the necessary at grade connections
with Farm to Market Road 2154
and

2. Defray all engineering and construction costs of the proposed

railroad grade separation and roadway approaches, estimated to be
$720 000 less the contribution by the railroad companies, as

WMRsAS, The State of Texas and the City of Bryan lost a
distinguished citizen in the passing of Virgil setilll and
WHSRrAS, Virgil Latill served this State as a law enforcement
officer for twenty-two years. He had served his fifth elective term as 1, °
Constable of Precinct 4. He was a member of the Justices of the Peace d:

WHAR" , He ran in deed a dedicated Texan, serving the people
with honor and integrity. His constructive and creative life was given in
true service of his ideals and purposes for a better State; and
WHEREAS, He was a member of the Knights of Pythias Lodge No. 64,
UOKK, Nomads and Odd Fellows lodges, and was an organizer and a lifetime
member of the Bryan Saddle Club; and
rHERNAS, He was born in Mineral Wells. He is survived by his wife,
Mrs. Virgil Estill; one daughter, Virginia Mae Estill; his parents, Mre and Mrs.
C. R. Estill; and one sister, Mrs. Earl T. Akin; now, therefore, be it
RESOLVED, That the House of Representatives of the Fifty-seventh
Legislature adjourns this day in memory of the courage and wisdom and faith of
Virgil Estill, that a page in the House Journal be set aside in respect to his
inspired service, and that copies of this Resolution be sent to his family with
our humble appreciation of his good life and with our deep personal regard._

Constable of Precinct 4, of Brazos County, Texas, was brought before the Court, After
such discussion, the Court voted to Rasa on the appointment of a new Constable at thin
time.
On motion duly seconded and unanimously adopted, the Court voted to pay all
bills which have been properly filed and approved.
Whereupon the Court adjourned.
