Each voter shall mark out with black ink or black pencil one of the above ex-
pressions, thus leaving the other as indicating his vote.
None but resident qualified property taxpaying voters of said School District.
° who own taxable property in said School District and who have duly rendered the same for
taxation shall be allowed to vote at said election.
The County Sheriff shall forthwith issue a notice of said election stating in
substance the contents of this election order and the time and place of said election,
and said Secretary shall poet a copy of such notice at three different places within the
boundaries of said School District, which posting shall be done not less than ten days
prior to the date fixed for said election.
Immediately after said election has been held the officers holding the same shal
make returns of the result thereof to the Commissioners' Court of this County, as required
by law for holding a General Election.
The manner of holding said election shall be governed, as near as may be. by
the General Election Laws of this State, except as modified by Article 2786b. Revised
Civil Statutes. 1925.

B.V. Elkins, Chairman of the Brazos County Welfare Board, appeared before the
Court and requested authority to purchase clothing for indigent children sent to the
State School for Mentally Retarded Children from this county, it being pointed out that
such school will not accept such children without certain items of new clothing. On
motion duly made, seconded and unanimously passed, the Brazos County Welfare Board was
authorized to make such purchases for this purpose.
Raymond Buchanan, Tax Collector and Collector, appeared before the Court and
requested the Court to set charges for sale of poll tax lists, and on motion duly made,

seconded and approved by majority vote, Commissioner Stasny voting "no", the following
charges were approved for sale of poll tax lists to the public: Precinct #1 - $20.001
;
Precinct #3 - $10.00; Constable Precinct #4 - $35.00; and complete County list - $50.00.
The County Judge again presented the proposal of the Old Ocean Fuel Company
for permission to cross existing County Roads with their pipeline, and after discussion,

on motion made, seconded and unanimously passed, the following agreement was ordered
executed:

Ford, Back & Davis Incorporated, Engineers, are acting ?
as Agent for Old Ocean Fuel Company of Fort Worth, Texas, in con-
nection with the design and construction of a 24" Natural Gas
Pipeline from a point near Sweeny to Fort Worth. This proposed
t line will run in a northerly direction through a portion of Brazos
County, and will cross County roads as shown on the attached copy
r of a Brazos County Map.
We respectfully request that Old Ocean Fuel Company be
granted permission to effect these crossings.
w We intend to install all gravel and dirt road crossings
by the open cut method, in accordance with the attached drawing l
number 60176-T-37, without the use of casings. In all cases we
propose to maintain a three (3) foot minimum from the top of our
pipe to the bottom of the ditch. All work will be done in an
' orderly and workmanship manner, all grandee, levels, drains, pave-
ments or structures will be replaced to as good condition as when
work was commenced, all roadways, pavements or structures damaged
by this construction work will be replaced with comparable mate-
rial and workmanship, all to the satisfaction of County Engineer.
Will you please issue this permit in the name of Old
' Ocean Fuel Company, but forward the permit and all correspondence
in connection therewith to this office? We are making a separate
application to the State Highway Department for permission to cross
their highways in your County.
We shall appreciate any information that you may be able to
give us with regard to anticipated future improvement of your County
roads, such as widening, relocation, application of higher type surface,
etc., in the area of our proposed pipeline crossing, in order that your
line may be installed in a manner consistent with such improvement.
For your convenience, we are submitting four (4) copies of
this application. If you desire to use copies of this application in
granting the permit, please return two (2) signed copies to this office.

or are made farm-to-market roads or State highways whereby the State Highway
Department requires all of said pipe lines to be encased, that applicant,

On motion made, seconded and unanimously passed, the Court voted to aocept the
agreement of the Lone Star Gas Company for the County to pay 659 of the actual cost of
encasing approximately 50 feet of 8" gas line on Farm to Market Road 2154,tsuch gum not
to exceed the amount of 8677.01. "
On motion made, seconded and unanimously passed, the Court voted to pay the
Sinclair Pipe Line Company the sum of 82,875.77 for encasing pipe line on FM Road 2513•
which work had been previously authorized by the Court.

On motion made, seconded and unanimously passed, the Court voted to authorize
and empower the County Judge to execute for the County an agreement with Gulf, Colorado
and Santa Fe Railway Company pertaining to the maintenance and use of a public road
across a certain portion of the property of the Railway Company, near Allenfarm, Brazos
•
County, Texas, such agreement being as follows:
"AGREEMENT made as of the 14th day of March, 1960, between GULF, COLORADO AND
SANTA FE RAILWAY COMPANY, a Texas corporation hereinafter called'Santa Fe',
and BRAZOS COUNTY, TEXAS, a policitical subdivision of the State of Texas,
acting herein by and through its County Judge, hereunto duly authorized,
hereinafter called 'Licensee',

W I T N E S S E T H
RECITALS:
Licensee desires to use a certain portion of the property of
Santa Fe, near the station of Allenfarm, County of Brazos, State of Texas,
upon which k o maintain and use, a public road, which is agreeable to
Santa Fe upon the terms and conditions hereinafter stated.
A G R E E M E N T:
ARTICLE I
"
1. Santa Fe, for and in consideration of the sum of ONE AND NO1100
DOLLAR (81.00), cash to it paid by Licensee, the receipt whereof is hereby
acknowledged, and of the full and faithful performance by Licensee of its
covenants hereinafter set forth, hereby licensee Licensee to maintain and
use a public road on that certain portion of the property of Santa Fe,
situated near the Station of Allenfarm, County of Brazos, State of Texas,
shown in red on Print C.E.G. No. C-10-22873, dated February 199 19609
hereto attached, marked Exhibit "A", and made a part hereof.
ARTICLE II
In consideration of the aforesaid license, Licensee covenants
and agrees to and with Santa Fe as follows:
1. That it will use the licensed premises exclusively as a site
•
for a public road.
2. That it will not let or sublet the whole or any part of the
licensed premises for any purpose whatsoever or assign this license with-
out the written consent of Santa Fe, in each instance.
3. That in case of eviction of Licensee by any one owning or
claiming title to the whole, or any part of the licensed promisee, Santa Fe
shall not be liable to Licensee for any damage of any nature whatsoever.
4. If the licensed premises, or any part thereof, cease to be
used at any time for the purpose licensed, Licensee will deliver up to
Santa Fe the possession of the whole, or such part so ceased to be used.
5. That it will use the licensed premises and maintain the public

road to be located thereon in such manner as not to interfere yvith, hinder,
or in any manner obstruct the use by Santa Fe of its railroad or other pro-
perty adjacent thereto. In the event of a breach of this covenant at any
time, Licensee will, within ten (10) days after receipt of written notice
from Santa Fe thereof, do whatever may be necessary to remedy such condi-
tion, and, failing so to do within said time, Santa Fe may do so at Licen-
see's expense, bill for the cost of which Licensee will promptly pay.
6. That no legal right of Santa Fe to construct and thereafter
maintain, use and relocate any tract or tracks, or other railroad facili-
ties, as it maf desire upon or across said licensed premises, shall be in
anywise affected by the giving of this license.

7 That if it shall become necessary, in the maintenance of
said public road to make any changes or alterations in Santa Fe's right
of way fences, cattle guards, signal, power and/or communication pole and
wire lines, drainage and/or other facilities, such changes or alterations
shall be made by Santa Fe at the expense of Licensee, fill for the cost of
which will be promptly paid by Licensee.
8. That it will bear and pay the entire cost of maintaining the

public road upon the licensed premises, including any and all drainage

facilities made necessary or required because thereof.
9. That this licerse is made subject to all existing and future
contracts, agreements, licenses and/or easements covering roads, public or
private, wire lines and appurtenances, pipe lines, or other facilities i
which may now or hereafter be located upon, under or across said licensed
premises.

10 That all of the covenants hereof shall inure to the benefit
of the successors and assigns of Santa Fe, to the same extent as to Santa Fe.
ARTICLE III
The parties mutually agree that this license shall be effective

from its date until terminated by either party giving to the other six (6)
months written notice of its desire to terminate the same. Upon such or

any other termination, Licensee will surrender possession of li

On motion duly made, seconded and unanimously passed; the Couri voted to
authorize Bernard J. Vogelgesang, Juvenile Probation Officer, to attend a Juvenile
Probation Conference to be held in Kansas City, Missouri, and the County to pay his
expenses not to exceed 885.00.
On motion duly seconded and unanimously adopted, the Court noted to pay all
bills which have been properly filed and approved.
Whereupon, the Court adjourned.
