REGULAR MEETING - AUGUST-10. 1959 " A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom at the Courthouse in Bryan, Texas, beginning at 10 o'clock A.M. on Monday, August 10, 1959, with the following present: + W,C. Mr. William Grace, Liquor Control Agent for Brazos County appeared before the I Court and requested that the Court authorize him to purchase at the County's expense a two-way radio for his automobile to be used in conjunction with the Sheriff's Depart- ment radio frequency, same to cost $536.85 plus an additional charge of $27.50 for in- stallation. Mr. Grace pointed out that upon proper application, the State Civil Defense Department would probably pay 1/2 of the cost of such radio. He further stated that such communication system was badly needed in his work in this county. Upon motion duly made, seconded and unanimously passed, Mr. Grace was authorized to proceed with the purchase and installation of such radio, and that an application be made to the State Civil Defense to reimburse the county for 1/2 of such costs. On motion made, seconded and unanimously passed, a Public Weigher's Bond in the amount of $2,500.00 executed by J.B. Beard as Principal and the Glen Falls Insurance Company as surety to the State of Texas dated July 26, 1959, was approved. A request was presented to the Court by the State Game and Fish Commission and the Brazos County Civil Defense Unit for office space in the Courthouse, and after discussion on motion duly made, seconded and unanimously passed, such agencies were authorized to use office apace on the third floor of the courthouse. On motion duly made, seconded and unanimously passed, the order of the Commissioners Court of July 13, 1959, calling for an election in Precinct No. 1 to determine whether cattle and horses shall be permitted to run at large, was rescinded by the Court. The following petition was presented to the Courts "PETITION To the Honorable Commissioners Court of Brazos County, Texas. We the undersigned freeholders of Precinct 1, a subdivision of Brazos County, Texas do hereby petition that an order be entered for an election to be held to determine whether cattle and horses shall be permitted to run at large in Precinct 1 of Brazos County, Texas, which said subdivision is described with more particularity as'followss "Beginning at the intersection of Turkey Creek and Brazos River on the north; Thence in an easterly direction along line of Turkey Creek, Country Club Lake, Carters Creek, Sleepy Hollow Road, Wickson Creek to intersection of Navasota River on the east; Thence in a southerly direction along line of Navasota River where it runs into the Bra- zos River on the south; Thence in a westerly and northerly direction along line of Brazos River to where it intersects Turkey Creek on the north.' On this the 10th day of August, 1959, came on to be considered by the County Judge of Brazos County, Texas, the petition of thirty-nine freeholders of the hereinafter described subdivision of said county for an order of election in such eub-~ division for the purpose of enabling the freeholders thereof to determine whether hor- see and cattle shall be permitted to run at large therein (that being the class of animals such petitioners propose shall not run at large), and it appearing to`the under- signed judge of such court that such petition was filed with the Commissioners' Court of said county on the 13th day of July, 1959, and that such court thcreafter, on the.10th day of August, 1959, heard and granted the same and ordered that such election be held on the 19th day of September, 1959, and that the judge of said county issue an order therefor and cause public notice thereof to be given as required by laws Now, therefore, by virtue of the authority vested in me under such order and the law, I, W.C. Davis, County Judge of Brazos County, Texas, do hereby order that on the 19th day of September, 1959, in such subdivision, an election shall be held for the purpose of enabling the freeholders of such subdivision to determine whether horses and cattle shall be permitted to run at large in ouch subdivision to-wit: Being Commissioners Precinct Number One (1) in Brazos County, Texas, which said sub- division is more particularly described as follows: Beginning at the intersection of Turkey Creek and Brazos River on the North; Thence in an Easterly direction along line of Turkey Creek, Country Club Lake, Carters Creek, Sleepy Hollow Road, Wickson Creek to intersection of Navasota River on the East; Thence, in a Southerly direction along line of Navasota River where it rune into the Brazos River on the South; Thence in a Westerly and Northerly direction along line of Brazos River to where it intersects Turkey Creek on the North. The polls shall be opened for such election at the Community Center in the Millican community; the Community Center in the Wellborn Community; the Consolidated School in College Station, Texas; and at the Community Center in the Harvey Community, all in such subdivision; and Wallace Dunlap, J.D. Williams, H.E. Burgess and Clyde F. Ooen, being proper persons for such purpose and freeholders and qualified voters of such county, are hereby appointed as managers of said election, and they shall appoint their own clerks. No person shall vote at such election unless he is a freeholder, and is also a qualified voter under the Constitution and Laws of the State of Texas. All voters of such election shall be by ballot, and voters desiring to prevent the animals designated therein from running at large shall place upon their ballot the words, "For the Stock Law,' and those in favor of allowing such animals to run at large, "Against the Stock Law." On or before the tenth day after such election, the persons holding such election shall make due return of all the votes oast at their respective voting places for and against said proposition to the County Judge of said county. Public notice of this order shall be given for at least thirty days before the date of such election by publication thereof in the Bryan Daily Eagle, a newspaper published in said county.
