These amounts are the same as those shown as balance due in letter from
County Judge A.S Ware to us, dated Dec 26, 1958, and received by us
Dec 27, 1958, in the shortages of Mrs. Marjorie E. Burkhalter accounts

We will appreciate it very much if the Commissioners' Court will accept
these checks by proper order as payments for these shortages determined
by the County and State Auditors We request that the County Judge sig
the duplicate releases for the county payment, if found in order, and
also have proper authority sign the release in duplicate for the State
of Texas
The amount due the county has been established for some time, but the
shortage in the accounts due the State of Texas so far as I have been
able to lesin was not definitely established until the last days of De-
cember, 1958 I believe the letters of record in the minutes of the
Commissioners' Court will bear this statement out. It was my understand
-
ing that the County Judge preferred that the settlement for both short-
ages be settled at the same time.
Our company has been anxious to get the matter settled since it first
became known that the shortages existed The delay was due to the fact
that the amount due the State of Texas has just been finally determined
in the last days of December, 1958, so far as we know.
We trust that your minutes will record that the matter was satisfactoril
handled

Court accepted the amount of 8474.40 enclosed in the above letter as full sett

REGULAR MEETING - January 12, 1959
A regular meeting of the Commissioners' Court of Brazos County, Texas,
was held in the Commissioners' Courtroom in the courthouse, at Bryan, Texas,
beginning at 10 o'clock a.m. on Monday, January 12, 1959, with the following
presents

After an opening prayer by the County Judge, the Court received, app-
roved and ordered filed as submitted the following reports

The Court approved and ratified the action of the County Judge as of January 1,
1959, and January 7, 1959, in swearing in Wallace Dunlap as Justice of the Peace, Precinct
No. 4, Brazos County, Texas, and Fred A Wehrman as Justice of the Peace, Precinct No. 5,
Brazos County, Texas, and approved the official bonds of such Justices of the Peace, and
ordered them recorded as such official bonds
After much discussion among the Court and after hearing from representatives of the
Earl Graham Post of the American Legion, on motion duly made and seconded it was unanim~us-
ly decided by the Court to employ a County Service Officer on a part time basis and to
pay such employee a salary not to exceed the sum of $150 00 per month. The date of Monday,
January 19, 1959, at 9 o'clock a.m was set as the time for considering the applications
for such office and for the Court to appoint such service officer.
Tax Assessor-Collector Raymond B. Buchanan appeared before the Court and requested
that his Chief Deputy's salary be increased from $3,400.00 to $3,600 00, that such Chief
Deputy be paid an additional sum for0assessing taxes, and for the authority to employ
an additional deputy to work in the Tax Collector's Office. On motion made, seconded and
unanimously passed, the salary of the Chief Deputy in the Tax Collector's Office was
raised from $3,400.00 to $3,600 00 annually, and the remainder of the budget setting the
salaries of the County officials and employees was approved, with the exception of the
salary designated in the budget for the Veterans' Service Officer.
On motion made and seconded, it was unanimously decided by the Court that the law
requiring Constables and Justices of the Peace to file monthly reports be strictly adhered
to, and the County Judge was instructed to notify each Constable and Justice of the Peace
that such report would be required in the future.
On motion duly made, seconded and unanimously adopted, the Court voted to appoint
H.P. Dansby, Jr, to the Veterans' Land Board County Committee for Brazos County.
, On motion duly seconded and unanimously adopted, the Court voted to reappoint Dr.
R Henry Harrison, Jr. of Bryan, as Brazos County Health Officer for the two year term
beginning January 1, 1959, and ending December 31, 1961,
A letter was read from R B. Butler, President of the Brazos Area Planning Corporatio;
dated December 22, 1958, informing the Court that the County's part of the first payment
to the Brazos Area Planning Corporation in the amount of $2,243.15 was due and owing and
the payment of same had been approved by the Board of Directors of the Brazos Area Plannin,
Corporation at their regular meeting an December 18, 1958. On motion duly made and secon-
ded, the Court unanimously voted to pay said amount as requested.
The County Judge laid before the Court the following communication and copy of Minut

In BRAZOS COUNTY, IT IS ORDERED that a FARM-TO-MARKET ROAD be designated,
extending from he end of F.M. Road 215 at a orn, out to F.M. Road
159 in Millican, a distance of approximately 8.3 miles, subject to the
condition that Brazos County will furnish all required right of way clear
of obstruction and free of cost to the State.
At such time as the County shall accept the provision of this Order and
agree to the furnishing of the required right of way, the State Highway
Engineer is directed to proceed with the engineering development and con-
struction of the project in the most feasible and economical manner, at an
estimated cost of $176,000.00, and to assume the road for State maintenance
upon completion of the construction herein authorized.
This Order is subject to acceptance by the County, and if not accepted with-
in 90 days of the date hereof, the action herein contained shall be auto-
matically cancelled.

Thereupon the motion was made, daly seconded and the-follom~ng vpte,taken
Commissioners Nolan and Stasny and County Judge Davis voting "aye" and
Commissioners Dunn and Porterfield voting "no", whereupon the motion was declared
adopted by which the Commissioners Court of Brazos County accepted the provisions
contained in said Minute Order No. 44989, passed by the State Highway Department
on October 31, 1958, for the improvement by the State Highway Department of farm-
to-market road extending from the end of Farm-to-Market Highway No. 2154 at Well-
born southward to intersect Farm-to-Market Highway No. 159 at Millican, a distant
of approximately 8.3 miles with the understanding that Brazos County agrees to
furnish all required right-of-way free of cost to the State.
On motion duly seconded and adopted by majority vote, with Commissioners
Stasny and Nolan voting "no", the Court voted to allocate to the four precincts
on the basis of the following two items carried in the Road and Bridge budget
for 1959
I Fencing of Right-of-Way for Farm-to-Market,
Lateral and County Roads . . . . . . . . . . . . . . $10,000.00
II For County road construction and improvement,

The matter of appointing a person to serve as Veterans' Service Officer for Brazos k
County was brought before the Court and the applications of the following were read ,

' drews, Samuel A. Restivo, Edwin L. Barta, E R. Murray, E B. McLeroy, H.A. Vander Cruyssers
• and A.W Sabo. After much discussion, motion was made by C.J Porterfield and seconded
by Raymond Nolan, to delegate the duties of Veterans' Service Officer to B.V. Elkins, to ;
be in addition to his duties as County Treasurer, and to pay Mr. Elins the sum of 5100.00

per month for the handling of such duties The motion'carried by a majority vote with
Porterfield, Nolan and Davis voting for the motion, and Stasny and Dunn voting against
