B 620, as finally adopted by the recant Ly session of the legislature This contract is proposed at this time to cover additional right- of-way required by the State fbr the widening and improvement of U. S. 190 (State Highway 21) at a point 6288 feet west of the Navasota River to the said River Ono copy of this contract is to be returned to Brazos County for its record after its final approval by the State Highway i Engineer at Austin ~j Commissioner Aum presented a bid from F C Herr ling, of Eurrtaa, Tames, for $1,181.40, for the relocation of the iron bridge on his property lamediately dorm river from the bridge over the Navasota River on State Highway 21 and fot the furnishing of all labor and materials`. required for building 6725 feet of fencing for the rijbt-of-way on State Highway 21 adjacent to its crossing of the said Navasota River. On motion duly seconded and unanimously adopted, the Court voted to accept this bid for the completed work and to authorise construction to begin immediately. It is understood that the County is to bill the State Highway Department for one-half ` of the cost of constructing 2100 feet of this fencing at the rate of $800.00 per mils, all as will be provided for in a contract with the° Highway Department now being tormu]ated. Sheriff J. W. Hamilton and State Highway Patrolman 0. L. lather appeared before the • J Court and brought up the matter of livestock running at large an the highways and roads of the County. Alter discussion and upon motion duly seconded and unanimously adopted, the Court voted to authorise the Sheriff to pick up unattended livestock running at large on State highways soh where the rights-of-way are fenced an both aides, and to hold these animals fbr public sale {x t ri after legal notice, with the atponse first paid and balance of proceeds to be delivered to owners c v ~ of livestock upon proper proof. At the request of Sheriff Hamilton, rime stated the need for additional mattresses for , d r,~ the County sail, on motion duly seconded and unanimously adopted, he was authorised to purchase r 124 r r 1 t flrbm additional mattresses at the lowest and best price. n The Court received, considered, approved and ordered recorded the following letter and statement from Mac L. S Ware St Al In the abore matter, in which the Caaaaissioner's Court is a party defendant we beg to advice that we will be happy to appear sad represent all the defendants We foal that a reasonable fee in the matter is 11000.00 for a trial through the District Court In the event the matter is settled without a trial that the fee will be S500.00`and in the event of an appeal as additional amount of $300 00 to take care of the appellate work This is a serious matter, and even though it is usually the duty of the County Attorney to appear and represent the various county officials the Court, in case of a Quo Yarranto proceeding, which this is, is authorized to employ attorneys to represent the defer dents in the matter.
