A regular meeting of the Commissioners Court of Brazos County, Texas, was held in the Commissioners Courtroom in the courthouse, at Bryan, beginning at 10:00 o'clock a. m., on Monday, June 10, 19570 with the following present: A. Barron and I have been talking with fellow lawyers and with representatives of the only two mayor law book publishing companies in the nation about the feasibility of doing something toward setting up a nucleus for a County law library in this County, which is done in moat leading counties in Texas At the moment, the District Judge's office has the i complete Southwestern Reporters and the black Statutes and Texas Jurisprudence, which are maintained by Judge hcDonald at his own expense These books are used by all of the lawyers who care to use them while they have litigation and trial work going on in the District Court Ile do not have availahle any more books in the courthouse, as hr John M Barron's office has a duplication of some of the same books that are in the Judge's ofrice Both of us, and the 'srazos County Bar Association, feel that it would be a splendid thing to have four sets of pools to start this library West Publishing Coapany of St Paul, }Iinnesota, and Vernon Law Book ComparW of {ansas City, 1,issouri, have even us identical prices on the followin_ four sets d S 'Ce( ln•iotatrd 108 books $477.00 Corpus Juris Secondum 98 books 931 00 Federal Reporter, Second Series 240 books 905 00 Words and Phrases 59 books 2 00 Total 2,785 00 f LA r ci 5 f As can be seen, these prices are non-competitive and are identical, and there is no other place to purchase these books except from these two firms This fact is well }mown to Judge Ware, as it is to any other lawyer The companies are willing to sell these books to Brazos County for a small down )aytent of $200 00 cash and monthly payments of S50 00, without interest except on delinquent installments It is our thought that it would not be fair to the litigants to tax as part of the court costa mone,, to buy a law library, and appellate courts have hold that it cannot be done in criminal cases We feel that fluids for this aurpose could ri,^,htfully be paid out of the Jury Fund, which has a cash balance, and we hope th.t you gentlemen will authorize the purchase of those books We would also like to have the County continue the current subscription to Texas Tdition of Southwestern Reporters and the upkeep service on Vernon's Annotated Texas Statutes, which will run only about $40 00 per year Mr Barron and Judge IcDonald feel that they would not only profit in their work from the use of these books, but it would be beneficial to all of the lawyers and the Court and the adminis~ration of justice in general It is our thought that the County should furnish the tools of our trade to carry on the operation of our of ices dust as they furnish materials, supplies, and equipment to other County offices If we are authorized to male this purchase, we would like to divide the business approximately equally between the two firms and possibly hive the order for the U.
