Mesdames Hugo Jopp and W A Lawless appeared before the Court and presented formal

request for a suitable building in the Kurten area for the local unit of the Ground Observers
Corps under the national civil defense set-up, and showed pictures and specifications on a

suitable watchtower building which could be had from the Air Force for $383 22, delivered at
the Bryan Air Force Base, They fUrther stated that the Kurten School authorities had offered

Commissioner would transport it from the Bryan Air Force Base to the School grounds After
discussion and upon motion duly seconded and unanimously adopted, the Court voted to authorize
Goomiiseioner Dunn to purchase this watchtower from his precinct funds and to place it on the
grounds !br the official use of the Kurten unit of the Ground Observers Corps
A delegation composed of W W Humphries, J B Newcomb, Leslie Lloyd, Lloyd D

Smith and K Bruun, appeared before the Court on behalf of the proposal of the establishmerrt

by the County for a bounty on wolves and bobcats. After discussion and upon motion duly

seconded and unanimously adopted, the Court voted to place a bounty of $10.00 on grown timber
or lobo wolves (Canis lupus) and of $5.00 an grown lynx cats or bobcats (Felie lynx rota) killed
}
idthin Brazos County during the balance of the year 1957, and payment to be made on signed
statement of claimant approved by the state game warden for Brazos County.

ROAD MACHINERY WARRANTS", dated January 15, 1957, bearing interest at the rate of 3.80¢ per anwm,
payable on January 15, 1958, and semi-annually thereafter on July 15th and January 15th in each

Year, numbored7from 1 to 10D, both inclusive, in denomination of $1,000 each, aggregating
=100,000 principal amount, due serially $25,000 on January 15th in each of the years 1958 to
1961, both inclusive, issued by Brazos County, Texas, for road improvement purposes, to-wit:
the purchase of road machinery for the maintenance and improvement of the roads in and fbr
said County; and
VMREAS, pursuant to order heretofore duly passed and adopted by the Commissioners'
Court of said County, all of said warrants of the aforesaid aeries, aggregating $100,000
have been executed and delivered, and
VHEREAS, heretofore, to-wit: on the 26th day of January, 1957, the Commieeicners'
Court of Brazos County, Texas, passed and adopted an order authorising the giving of notice
of intention to issue $100,000 Refunding Bonds for the purpose of cancelling, refunding

and in lieu of a like amount of said Brazos County, Texas, Road Machinery warrants,
hereinabove described, and

WHEREAS, notice of intention to pass the order authorizing the issuance of such
refunding bonds was duly given by publication in the BRYAN DAILY EAGLE, which is a
newspaper of general circulation in Brazos County, published in the City of Bryan, Torras,
and which notice was published in said newspaper on the following dates, to-wit: January 299
1957, February 5, 1957, and February 12, 1957, the date of first publication being full
thirty (30) days before the 11th day of March, 1957, which is the date fixed by the
Commissioners' Court for the passage of the order authorising the issuance of such refunding
bonds; and
WHEREAS, the Commissioners' Court now considers it feasible and practicable
and to the beat interest of the County to cancel or refund the $100,000 of warrants

hereinabove described by issuing and delivering to the proper owners or holders of said
warrants the refunding bonds of said County in the total principal sum of $100,000, to bear
interest and to mature as hereinafter stated; and

WHEREAS, it appearing to the Court, pursuant to due investigation, that no -
petition has been filed in the office of the County Clerk by ten per cent (10%) of the

qualified property taxpaying voters of the County, praying this Court to order an election
for the purpose of submitting the proposition to issue such refunding bonds to a vote of
p
the qualified property tax paying voters of this county, and further, this Court finds that
r

no petition of any kind or character in respect of the proposed bonds oP warrants to be

refunded, has been filed either with the County Cleric or any member of this Court, or any
other official; therefore

adopted by the Commissioners' Court of Brasov County, Texas, and of record in the himutes

IN ADDITION to all other rights, the holder or holders of this bond and of the
aeries of which it is a part, is and are subrogated to all .the rights, and has and haw
all of the remedies of the holders of the original indebtedness refunded by this issue of
bonds, except only to the extent otherwise specifically provided herein and in the
proceedings relating to the issuance of the series of bonds of which this is one.
IT IS HEREBY CERTIFIED, RECITED AND REPRESENTED that all acts, conditions
and things necessary to be done precedent to and in the iasuance of these bonds, in order
to make them legal, valid and binding obligations of said County, have been done, have
happened and been performed in regular and due time, form and manner, as required by law;
that due provision ham been made for levying and collecting annually by taxation an
amount sufficient to pay the interest on these bonds as it falls due, and to provide
a sinking fund for the final redemption of said bonds at maturity, and that the issue of
bonds of which this in one, together with all other indebtedness of said County, in within
every debt and other limit prescribed by the Constitution and laws of the State of Texas.

Any surplus in the sinking fund account of the series of warrants hereby
refunded shall be passed to the credit of the atnking fund account of said refunding
bands, and any and all taxes uncollected from levies herstofbre made on account of the
warrants which are being refluided by this issue, shall, when and as the same are collected,
be credited to the sinking flaid account of this aeries of refunding bondal PROVIDED, HOWEM
that such transfer of the sinking !land account and pledge of uncollected taxes is made only
so far as may lawfully be done consistent with the rights of the holders of the oustanding
warrants
SECTION 12: AND IT IS FURTHER ORDERED that the County Judge of Brazos County, Texas,
be authorized to tale and have charge of all necessary records pending investigation by the
Attorney General and shall tale and have charge and control of the bonds herein authorised
pending their approval by the Attorney General and their registration by the Comptroller
of Public Accounts.
The above order having been read in lull, the motion for its passage and adoption
was made by Commissioner Burlin, which motion was duly seconded by Commissioner Porterfield.
thereupon, the question being called for, the County Judge put the motion to a vote of the
members of the Court, and the motion carried by the following voter Commissionere Nolan,
Dunn, Porterfield and Burlin voting "AYE", and none voting nNO" The County Judge declared
the motion carried and the order duly passed and adopted and the County Clerk was instructed
to record name in the Minutes of the Court.

Is the undersigned, County Judge of Brazos County, Texas, DO HEREBY CERTIFY that none
of the warrants being refunded by $100,000 "Brazos County, Texas, Refunding Bonde", dated
January 15, 1957, were ever purchased by or held in the sinking find created for the purpose
of paying off or redeeming said warrants, that none of said warrants will be tacen up and
paid for with money from said sinking fund, and that there is no money in the sinking fund ,
of the warrant issue being refunded with which to pay off any of the principal of the warrants
being refunded
WE FURTHER CERTIFY that there has never been and is not now pending any litigation
in any wise affecting the validity of the warrants being refunded, nor has there ever been nor
is there now any litigation pending affecting the power of the Commissioners' Court to levy

Newcomb stated that he donated many yards of gravel to the Commissioner, for which he
made no charge and that thebill of 54 50 was not a dust and proper one. On motion duly
seconded and unanimously adopted, the Court voted to cancel this charge and instructed

In conformity with the foregoing contract and agreements, the Court officially
ratified and approved the selection of The First National Bank of Bryan, at Bryan, Texas,
as the official depository bank for the County and the Brazos County common school district
funds, and thereupon officially designated said Bank as such official depository for the
two-year period beginning February U, 1957, and ending sixty days after the second Monday In
February of 1959
County Judge Ware laid before the Court the following bill from W. G. Wilson of
Madisonville, Texas, for wor* performed in accordance with the contract awarded by the Court
on February 11, 1957, and stated that the contractor had been unduly inconvenieneed and
harrassed by the arbitrary action and behavior of the offioiAls of the Brazos Electric Power
Cooperative, Inc., which had caused the contractor to suffer great inconvenience and considerable
financial lose through no fault of his He further recommended that the contractor be allowed
an additional $310 00, for extra expense incurred which would make the total payment amount
to $1,710.00, instead of the original $1,400 00 Whereupon a motion was made, duly seconded
and unanimously adopted by which the Court ordered payment of the foregoing account in
the amount of $19710 OOn
