drily authorised, said warrants being numbered from 1 to 100, both inclusive, in denomination
of $18000 "ohs aggregating the principal sum of =1000000, all of said warrants bearing
interest at the rate of 340% per armor, payable January 15, 1958, and semi-annually
thereafter an July 15th and January 15th in each year, said warrants maturing on January
15th in each of the years as follows: $25,000 1958 to 1961, both inclusive) and
WHEREAS, under the terms of the aforesaid order of January 142 1957, Warrants
Numbered 1 to 9, both inclusive, of the series above described, aggregating $9,000, were

Inclusive, of the series above described aggregating =9,000 were to be made payable to
BROMMING-FERRIS MACHI EM OCKPANY of Houston. Torras, all of said warrants were issued in
ppgmat of a portion of the purchase price of certain road machinery described in said
order. The aforesaid order at January 14, 1957 is hereby adopted by this reference and
Incorporated herein and made a part hereof for all purposes, and
WHEREAS, it was provided in said order of January 14, 1957, that said warrants

should be executed and delivered by the County Judge, County Clark and County Treasurer

upon order of this Court at such time as the machinery contracted for should be delivered

WH EMO such machinery has heretofore been delivered to Brazos County, has
been inspected and tested by and under the supervision of the Commissioners' Court,
and has been found to be in strict accordance with the specifications therefor and as
represented by the contractors, and it having been affirmatively found by the Court

machinery is therefore hereby accepted by the Commissioners' Court, and said Court hereby

SECTION 3: That in accordance with the contract made and entered into by and between
Brazos County, Teams, and MUSTANG TRACTOI AND EQUIPMENT 00 of Houston, Texas, dated the 14th
day of January, 1957, the full amount of said contract, to-wit: $49,670 77 is due and wing said
company, it having fully performed its contract by the delivery of the road machinery therein
described, and which has been found by the Court to be in all things as represented and entirely
suitable for the purposes for which intended by the County, it being therefore necessary that
the amount due said Contractor shall be discharged by the County by payment as follow:
(a) By the issuance, execution and delivery to said contractor of $490000 "Bmwo
County, Tema, Road Machinery Warrants", dated January 15, 1957, being Warrants Numbers 43 to
91, both inclusive, in the denoaination of $1,000 each, bearing interest at the rats of 3 W%
per annum, and maturing serially on January 15th in each of the years as follows: $8,000 1959,
$25,000 1960 and 916,000 19611 all as more particularly described and set forth in the Court's
order of January 14, 1957, wherein and whereby said warrants were authorised, and
(b) By the payment of $670.77 in cash out of funds which the County now has an hard
available for such purpose and unappropriated to any other purpose.
SECTION L: that in accordance with the contract made and entered into by and betwoa
Brazos County, Texas, and BROWNING-TERRIS MACHIMY WMPANY of Houston, Texans dated the 14th
day of January, 1957, the full amount of said contract, to-wit: $10,000 is due and wing said

(b) By the payamt of $1,000 in cash out of Buda which the County now
has an hand available for sub purpose and unappropriated to any other purpose.
SECTION 5e That the aforesaid warrants shall be smooated by the County
Judge, Canty Clark and County Treasurer and delivered by them to the said
Cosstractore.
SECTION It is further specifically found, ordered, adjudged and decreed _
that Brazos County, Teas, has received full value and consideration for the aforesaid
warrants authorized to be delivered to said c a tractors; and that all things squired W
law in the issuance of said warrants have happened and have been performed in due time,
fora and canner as proscribed by law; that there are no warranties concerning performance
of the aforesaid contracts which have not been fulfilled is all partieslare by said
contractors, and this judicial finding and ascertainment of fact is made for the use
and benefit of all attosueya who may pass upon the legality thereof, and ouch findings
of fact shall be binding henceforth upon the Commissioneral Court of Brazos County
and its successors in office
SECTION 7s All acts of the Commissioners' Court of Brazos County, Tons,
heretofore had and done in connection with the issuance of these warrants, and all acts
to be done by the officers of said county in the owcution, issuance and delivery of said
warrants, are hereby RATIFIED, CONFIRM AND VALIDATED, and all certificates given In
connection with said warrants and in the purchase of said machinery shall be prim facie
evidence of the facts therein stated in support of the null validity of the warrants
herein authorized to be delivered.
The above order having been read In full, it was moved by Commissioner
Burlin and seconded by Commissioner Dunn that the same be paaeeld and adopted.
Thereupon the question being called for, the motion carried by the following
votes Commissioners Nolan, Duet, Porterfield and Burlin voting •ATS■; and none voting

and freezing unit delivered at net price of $255.11.
It was further ordered that the $255.11 be prorated equally among the four
Camrissioners' precincts.

Judge in the courthouse at Bryan, Thane, beginning at 9s00 o'clock a. a., an Thur edgy, January
17, 19579 with the following presents
