Pursuant to the request made of this office for an opinion upon the
above subject with regard to employment of relations prohibited by the nepotism- '
laws, I submit the followings
Article 432, Texas Code of Criminal law, known as the Penal Code, no sf
officer of this State nor any'officer of any district, county, city, precinct, school'
district or other municipal subdivision of this State, nor any officer or member -
of any state, district, county, city, school district or other municipal board, or
fudge of any court, created by or under authority of any General or Special law of '

prohibits any "trading„ between public officers
in such appointments, and denounces trading ading as a nepotism offense.

It has been held that the employment by one county commissioner of the
nephew of another county commissioner and

payment for such services out of county
funds is a diroct violation of the provisions of the lax. Op. Atty. Gen. 1939,
No. 272.

An independent officer, such as the bistrict Clerk or County Clerk, may hire
'an employee who is related to a county commissioner without violating the law.
Op. Atty. Gen 1939, No. 329. It appears that when the hiring or appointing officer
Y`
has nothing to do with the employment or hiring of the relative, and no control over '
the salary, fee or pay of the relative, such employment by smother officer, if not
procured by the other officer, is legal and valid. Op. Atty. Gen 1939, No. 369.
And a county commissioner may not employ a person who is within the above
relation to another county commissioner of the same county. Op. 1945, No. 0-6337.
As I understand it, a first cousin is within the second degree by blood,
and the statute's inhibition extends as remotely as a second cousin by blood and
a first by marriage.
It is my opinion that a County Commissioner is prohibited from
employing his own relation or the relation of any other County Commissioner
as above, unless such employee was employed at least two years prior to the
election of the commissioner.
It is further my'opinion that any other officer may appoint a relative'
of a Coukty Commissioner as he pleases, without violating the law, such as the
appointment by the County Attorney of a relative of the Commiiscioner or a
Commissioner of any precinct of the County. The County Judge may employ a
stenographer related to a county commissioner. Op. Atty. Gen. 1942, No. 0-4585.'
It is my hope that the above ties answered the inquiry fullg and if any
further explaination is needed, please advise.

for bide thereon. Whereupon, after discussion and upon motion duly seconded and unanimously adopted,

Bide shall be submitted on forms provided by the Architects. The
required proposal form has several proposals listed. The Contractor
may bid on any or all proposals. No bid may be changed, emended or
modified by telegram or otherwise after same has been submitted or

The owner shall have the ri,ht, prior to siLming of the contract, to ,
" require the Contractor therefor to furnish a perfor•nance bond in the
amount of 100,1,' of the contract price, in :,uch forms as the owner may
prescribe sad with such sureties as he may approve. Premiums for such
bonds will not be included as a part of the Contractor's bid, but,

Couat+Attorna John M. Barron appeared before the Court and outlined the highly successful
? use and operation of a polygraph (Ile detector) now owned and being operated by Assistant County

Attorney D. B. Cofer for the benefit of the County. Mr. Barron stated that this operation was
,r saving the County more than $100.00 a month actual expense and requested that Mr. Cofer be,'allowed
r $50.00 per month for the rental and operation of his individually owned equipment. After
j discussion and upon motion duly seconded and unanimously adopted, the Court voted to allow this
expense at the rate of $50.00 per month from the Officers Salary Account an payment to Mr. Cofer
for the use and operation of his individually owned machine for the benefit of the County.
t+a On motion duly seconded and unanimously adopted, it was voted to authorise the expense
of $121.00 to the General Electric Company of Houston, Texas, for the conversion of mobile radio
unit to be installed in the State-owned automobile now assigned to and operated by State Highway
Patrolman 0. L. Luther, with headquarters at Bryan.
On motion duly seconded and unanimously adopted, the Court voted to authorize condemnation
j# proceedings on behalf of the County for the acquisition of 2-6?'l00 acres of land owned by J. N. and
F. K. Sramek and situated in the Thomas J. Wooten Survey, Abstract No. 59; which land is
required for right-of-way for the widening of the Leonard Schoolhouse County Road beyond the
terminus of State Farm-to-Market Highway No. 1688.

On motion duly seconded and unanimously adopted, the Court voted to pay.all bills that
have been properly filed and approved and for which budgeted funds are available.
Whereupon the Court adjourned.
Special Keating - February 20, 1956
A special meeting of the Commissioners' Court was hold in the offloe,of the County Judge
in the Courthouse at Bryan, Texas, beginning at 8:30 a.m. on Mondays February 20, 1956, with the
following present:
A. S. }fare, County. Judge, presiding;
Raymond A. Nolan, Commissioner of Precinct Number 1;
George Lunn, Commissioner of Precinct Number 21
Clyde J. Porterfield, Comrissioner of Precinct Number 31 and
Newton Burlin, Commissioner of Precinct Number 4.
Messrs. C. E. Lawrence, of the architectural firm of Caudill, Rowlett, Scott & Associates"',
and Paul Kaech, of the cantragting firs: of A. P. Kasch & Sons, appeared before the Court and
discussed the matter of proposed changes in the Courthouse-Jail plant heretofore unofficially,,
discussed. Mr. Lawrence presented detailed plans and specifications for the proposed changes
and Mr. Kasch presented the following communication as to the coats thereof:
