Porterfield, Commissioner, Preoinct•No. 31 Newton Burlin, Owd.ssLaner, Precinct No. 4j and, among other proceedings had were the followings Cam' sioner Nolan introduced the following order authorising the issuance of bonds: WHEREAS$ on the 9th day of November, 1953, the Commissioners' Court of Brazos County, Texas, y an order duly and legally passed, ordered that an election be-held throughout said County on the 5th day of December, 1953, for the purpose of determining whether the Commissioners' Court of Brazos County, Texas, shall be authorized to issue the bonds of said County in the total principal sum of $800,000, for permanent improvement purposes, to-wit: the construction and erection of the county courthouse and jail building in the City of Bryan, the County Seat of Brazos County, Texas, said bonds to bear interest at a rate not to exceed 2-3/4% per annum, and to mature serially within any given number of years not to exceed twenty-five (25) years from the date thereof, and whether said Court shall be authorized to levy J a tax sufficient to pay the interest on said bonds and create a sinking fund sufficiorit to pay the prinoi pal thereof at maturity; and WHEREAS, notice of said election was given by publication in the MAN DAILY EAGLE, a newspaper published in Bryan, Brazos County, Texas, and which notice was published on the same day of two con- secutive weeks, the date of the first publication being not less than fourteen (14) days prior to the date of said election, and, in addition thereto notice thereof was posted in each of the election precinc of Brazos County, and at the door of the County Courthouse in the City, of Bryan, Texas, and which said election precincts are fully set out in that certain order of the Commissioners' Court made and entered on the 9th day of November, 19531t of record in Volume "K", page 243, et seq., of the liinutee of said Court, for at least fourteen (14! full days prior to the date of said election; and WHEREAS, said election was duly and legally held on 5th day of December, 1953, and the result of a ~y said election was duly certified and returned to this Court by the fudges and clerks thereof] and UH:RZAS, on the 14th day of December, 1953, this Court considered the returns of said election and canvassed the same and found that there were cast at said election 782 votes, of which number 649 votes were cast "FOR THE ISSUANCE OF BONDS AND THE LEVYING OF THE TAE IN PAYIENT THEREOF"; and 130 votes were cast "AGAINST THE ISSUANCE OF BONDS AND THE LEVYING OF THE TAX IN PAYF:NT THtW- 11; and this Court, ; z thereupon, by order duly entered, declared that the proposition so submitted was sustained and adopted , by a majority vote of the qualified resident property taxpaying voters voting at said election; and WHEREAS, this Court has examined into and investigated the regularity of the proceedings for said election and finds that the same was duly and legally hold, that the notice required by law to be given was duly and legally given; and that said election was conducted in strict conformity with all the re- quirements of lax; IT IS ORDERED, ADJUDGZD AND DECREED BY TIM 00124LSSIONERS' COURT OF BRAZOS COUNTY, TEXAS: I.
