The Court received, considered and ordered recorded the following communication and ruling from County Attorney Davis Grant with reference to the claim of J. E. Newcomb, which he orally presented to LIT" the Court on September 14, 1953, h "September 15, 1953 Commissioners Court Brazos County Bryan, Taus Bet Claim of J. E. Newcomb Gentlemen: On the 14th day of September, 1953, you requested of me an opinion regarding O the liability of the County for alleged damages to the vehicle owned by J. E. Newcomb, by reason of an accident he had on a bridge in Precinct 2, maintained by the County. This is to advise you that the County is not liable in damages for injuries sustained in consequence of the tortious or negligent acts of its agents or sT employees. See Attorney General's Opinions Noe 0-2473, 19 Southwestern 562, 179 Southwestern-2nd 584, 163 Southwestern-2nd 855, and 11 Texas Jurisprudence, } Section 92, page 627. Therefore, I am advising you that there is no legal , way to pay Mr. Newcomb for the alleged damage sustained by reason of the acoi- dent in question.
