after conference with the County Clerk, and that these bids be made available at the next regular
session of the~Court.
The members of the Court discussed in detail the proposition of black-topping of County
roads and the desirability of the County being equipped to do such work on its own account. Whereupon
a motion was made, dully seconded and unanimously adopted by which it was agreed that the County Com-
missioners would confer with the local State Highway Engineer and secure itemised lists of machinery,
equipment, and specifications therefor, as might be necessary for such operations, and which itemised
lists of equipment and specifications could be used for requesting bids looking to the purchase thereof
by Brazos County.
On motion dully seconded and unanimously adopted, the Court voted to pay all bills which had
been properly filed and approved and for which budgeted funds are available.
Whereupon the Court recessed.

On notion duly seconded and unanimously adopted,'the Court voted to request thr:County Auditor
to make public advertisement requesting bids on machinery and squipmmt designed for use of the County in
the black-topping or hard-surfacing of Brazos County public roads. The following was agreed upon as the
form of this advertisement which the Court specified should be published in the Bryan Daily Eagle, of Bryn
Teias, for three consecutive weeks prior to the next regular meeting of the Commissioners' Courts

complete with tachometer, full circulating 201 spraybar with individual

steering, Diesel powered with electric starter, equipped with water tank and
sprinkling device on rolls.

Commissioner Conrad laid before the Court a proposal from the Benson Tractor Company of 6414
Harrisburg Boulevard, Houston, Texas, for the sale to Brazos County of one new Model D gasoline-type
Allis-Chalmers motorgrader with cab, and complete with 750 x 20 front tires substituted for standard ones,
all delivered at the Brazos County Shope, near Bryan, Texas, for $4897.13. Commissioner Conrad stated
that, he wished for the County to purchase this motorgrader at the price quoted; to have it allocated to
Precinct No. 2, of which he is Commissioner, and the purchase price cf $4798.13 paid,from funds allocated
to that Precinct.
After discussion and after determining,that the foregoing proposal was the beat available and
,most advantageous to Brazos County, on motion duly seooaded,and unanimously adopted, the Court voted to
purchase the said motorgrader at the price etated,,to be paid from flnde available to that Precinct, and
to allocate the said machine to Precinct No. 2„ of which Reuben F. Conrad is Commiseloasr..•_.

Dr• S• C. Richardson of Bryan, Seaga, appeared before the Court ad urged
that the County Commissioners conserve their road machinery and equipment 1W
Baiting its use to county road work and !a-county soil conservation and terra-
clog work. After a discussion of this matter, a motion was made and ddr
seconded that the County Commissioners hereafter do terracing and soil con-
servation work for compensation only after formal application L filed with
and approved by the whole Courtj and otherwise strictly in accordance with the
law and especially Article 2372-c of the Revised Civil Statutes of Ssrraa as
amended. Time foregoing motion was adopted by the affirmative votes of Com-
missioners Porterfield, Conrad, Burlier, and County Judge Ware, with Cm-
missioner Nolan voting ?Preaent•.

In compliance with your request, we have advertised for bide on the
relocating of the electric line, to provide for the widening of the right-ofd

on the Leonard Road.
Four bids were received and the lowest and best, as determined and

accepted by the City Commission, was that of the A & M Construction Company in the

amount of $2,391.11. This amount is based on plans and specifications drawn several

months ago. Since that time several poles and assemblies have been added to the line
which will increase that amount slightly as the fob is bid on a unit basis. It is
estimated that the final figure will not be over $200.00 more than the above.

This cost includes the labor only for the removal and relocation of the line
affected, which is the portfon'of the cost chargeable to the County. The cost of new
baterial over salvage of exiating line plus the installed cost of original line loss
depreciation is absorbed by the City.

THE CONDITIONS of the above contract are such that, whereas, the above bounden
pledgor, the First National Bank of Bryan, of D yan, Tame, was an the 9th day of February
A. D. 1953, duly and legally chosen by the Commissioners' Court of Bnaws County, Texas,
a. county depository of the school funds of said county for a period of two years ending
sixty days`from the time tired by law for the next selection of a depositary.
NOW, THEREFORE, the above bounden pledgor, the First National Bank of Bryan, Texas,
(No officer, director or stockholder of which is a member of the C 0missionars' Court),
agrees to the following, to Witt
1. That it will safely keep and faithfully disburse the school funds according to ]sew,
and pay such um ante and/or vouchers that may be legally drawn on the funds by legal authority,
and that it will account for and report annually a statement of suet to the Commissioners'
Court and to the Commissioner of Education, as is required by lawl
2. That it will comply with all the provisions of the laws of the State of Teams
relating to school fund depositories, that it will perform all duties therein specified, and will
execute any and all instruments and documents necessary to evidence its obligation to this

3. That it will pay interest daily balances on the school funds, provided such may be
authorised under rules, regulations or bylaws promulgated by the federal Reserve Board - these
payments to begin on or after the effective date of the promulgation of such ruleal
4. That, at the expiration of the term for which It has been chosen, it will turn
over to its successor all the funds, property, and other things of valus,,coming into its
hands as depository, and return the securities pledged to the pledgor. In the event of any
Indebtednees'arieing by virtue of the violation of any or all conditions of this contract,
the Commissioners' Court of Brazos County, Tetras, is hereby authorized to sell at public sale,
with or without notice to the pledgor, the securities or any part thereof, and apply the pro-
ceeds of. sale to the satisfaction of such indebtedness.
THE CONDITIONS of this contract are such that if the said bank shall perform all
obligations hereinabove specified it shall, be null and void, otherwise It shall remain in full
force and effect.
The above provisions are given in addition to any remedy the pledgee may have in any
suit brought an this contract in any court in this State. Any suit arising out of or in any
way connected with this contract shall be tried in the County of Arazoa, State of Tetras, in
any court therein having jurisdiction of the subject matter thereof.

Q. 1. "Article 1661 Civil statutes of Texas makes it mandatory upon the county auditor
not to audit or approve any bill or claim against the county unless contracted for as
provided by law. Will you please explain what constitutes a "legal" bill or claim against
the county?"
A.,A legal bill or claim against the county is one which, of course, is authorized by
law. Generally speaking, all supplies, materials, etc., contracted for by the county must
be done so in compliance with the following Articles of Vernon's Annotated Civil Statutes
1658, 1659 and 2358 through 2367. There is one notable exception to the requirement that
all supplies, materials, etc., be purchased in accordance rdth the above cited statutes,
and that is the purchase of road machinery. In the case of Patten vs. Concho County, 196
S.W. 2d, 833, which was decided October 9, 1946, by the Austin Court of Civil Appeals, the
Court used the following language: "Ws find no statutes, and none bas been cited to us,
expressly requiring competitive bids in the purchase by the county of road machinery for its
own use. Whether good business management by the Commissioners of the county's affairs re-
quires such advertisement is, under existing law, a matter within the discretion of the Coor-
mdssioners' Court". The only other exception to the method of contracting for supplies,
materials, etc., is contained in Article 3899 Verrnon's Annotated Civil Statutes, which pro-
vides for an expense account of several officers named therein. Section (b) of this Act,
which is applicable to this county, requires that * * such expenses to be passed on,
predetermined and allowed in the time and amount, as nearly as possible by the Commissioners'
Court once each month for the ensuing month, upon the application of each officer, * *
The statute further provides, "The Commissioners' Court of the county of the Sheriff's
residence may, upon the written and sworn application of the Sheriff, stating the necessity
therefor, purchase equipment for a Bureau of Criminal Identification a * wr. Such pur-
chases shall be made by each officer when allowed only by requisition in manner provided
by the county auditor, if any, otherwise by the Commmiesioners' Court. Each officer, shall,
at the close of the month of his tenure of office, make an itemized and sworn report of aU
approved expenses incurred by him and charged to his county, accompanying such report with
invoices covering ouch purchases and requisitions issued by him in support of such report.

Q. 2. "Does the individual County Commissioner have legal authority to make pur-
o chases for his precinct without the action of the Commissioners' Court?"
A. In the recent cane of Canales vs. Laughlin, cited in 214 S.W. 2d, 451, 455,
Justice Hart, speaking for the Supreme Court of Texas saye "Furthermore, the individual
commissioners have no authority to bind the county by their separate action." For further
authority on this question, I suggest that the case of Tarrant County vs. Smith, 81 S.W.
2d, 537 be read.
Q. 3. "Article 1659, among other things, states that the Commissioners' Court can or
my make emergency purchases without advertising for bids, up to $150.00. Will you please
eruplain what constitutes an 'emergency??

A. What constitutes an emergency under the tome of Article 1659, rests within the
sound discretion of the Commissioners' Court. See Attorney General's Opinion 0"2315, page
173, Volume 2, of the Attorney General's Annual Report for 1940.
Q. 4. 'Does the Commissioners' Court have the legal authority to appoint a purchasing.
egent•for this county, and if so, would he have any legal standing?■
A. There is no statutory or legal authority to appoint a purchasing agent for Brazos
County] hence, each a purchasing agent, if appointed, would have no legal standing.
