SPECIAL MSETING,,MARCH 7, 1 9 4 9 -

The commissioners court of Brazos County, Texas, met in special session in the
office of the County Judge at the Courthouse in Bryan, Texas,-at 7:00 a. m.; Monday, Marsh
7, 1949, with the lbllowing members presdnt:
A. S. Wars, County Judge, presiding;

p Raymond A. Nolen, Commissioner, Precinct No. 1;
William A. Conrad, Commissioner, Precinct No. E;
Clyde J. Porterfield, Commissioner, Precinct No. 3; and
Newton Burlin, Commissioner, Precinct No. 4.
The entire Court then proceeded in a body to-Austin, Texas, on official businesi of
Brazos County on behalf of the cause of rural roads in Texas and for the particular purpose'
of urging the passage by the Forty-First Lggialature of H. B. No. 89, which would levy a tai
on natural gas and thus provide a fund for the construction and maintenance of rural roads
in Texas which are not now provided for.
Upon return to Bryan late that night, the Court by motion duly seconded and unan-
imously adopted, voted to refund to County Judge A. S. Ware, the sum of, $14.90 paid out as

subsistence and maintenance expense for the five members of the Court for the full day on
route to, in, and from Austin, Texas.
The Court further voted to reimburse Commissioner Clyde J. Porterfield in the amount

of $12.48 for use of his personal automobile in transporting the five members of the Court
i
from Bryan to Austin and return, a total of 208 miles at E4 per mile.
These two items totaling #27.38 were ordered paid from the travel expense items of
the Road and Bridge Fund as set up in the 1949 county budget.

On motion duly seconded and unanimously adopted, the Court voted to pay from the

General Fund of the county the sum of #50.00 to Fired B. Glass of Marlin, Texas, Secretary-
Treasurer of the County Judges and Commissioners Association of Texas, as Brazos County's
pro rata of the expense of legislative service for 1949 on behalf of the cause of rural.road
. '
There being no further business, the Court adjourned.

The conditions of the above contract are such that, whereas, the above bounden
pledgor, The First National Bank of Bryan, was on the 14th day of February, A. D. 1949,
duly and legally chosen by the Commissioners' Court of Brazos County, Taxes, as County
Depository for said county for a period of two years ending sixty days from the time fixed
by law for the next selection of a depository, upon its bidding and agreeing to pay the
County of Brazos interest on "time deposits" on daily balances kept in said depository of
'said County of Brazos at the rate of one per cent per annum, said interest payable monthly
NOW, THEREFORE, if the above bounden pledgor, The First National Bank of Bryan,
Bryan, Texas, shall faithfully do and perform all the duties 'and obligations devolving on
it by law as the county depository of Brazos County, and shell upon presentation pay
checks drawn on it by the county treasurer of Brazos County, Texas; on "demand deposits"
accounts in such depository; and all checks drawn upon any "time deposit" account upon
presentation, after the expiration of the period of notice required in the case of "t Lee
deposits," and shall faithfully keep said county funds, and account for as= according to
law, and shall faithfully keep and account for all funds belonging to the county which
are deposited with it under the requirements of Article 2547, Vernon's Annotated Revised
Civil Statutes, 192*, and shall include State funds colleoted by the tax collector, and
shell pay the interest at the time and at the rate herainbefore stipulated on "time de-
posits"; and shall, at the expiration of the term for which it bas been chosen, turn over
to its successor all the funds, property, and other things of value, coming into its hands
as depository, then and in that event this ooatraot is to be and bsoome null and void and
the securities above shall be returned to the pledgor, otherwise to remain in full force
and effect, hereby specially authorizing the Commissioners' Uourt of Brazos county, Texas,
to sell at public or private sale, with or without notice to the pledgor, the securities,
or any part thereof, and apply the proceeds of sale to the satisfaction of any indebted-
ness arising by virtue of the violation of any or all the conditions of this contract.
The above provision is given in addition to any remedy the pledgee may have in any
suit brought on this contract in any court in this State.

be authorized under rules, regulations or bylaws promulgated by the Federal Reserve Board-
these payments to begin on or after the effective date of the promulgation of such rules;
4. That, at the expiration or the term for which it has been chosen, it will turn
over to its successor all the funds, property, and other things of value, coming into its
hands as depository, and return the securities pledged to the pledgor. In the event of an
indebtedness arising by virtue of the violation of any or all conditions of this contract,
the Commissioners' Court of Brazos County, Texas, is hereby authorized to sell at public o
private sale, with or without notice to the pledgor, the securities or any part thereof,
and apply the proceeds of sale to the satisfaction of such indebtedness.
THE CONDITIONS of this contract are such that if the said bank shall perform all
obligations hersinabove specified it shall be null and void, otherwise it shall remain.in
full force and effect.
The above provisions are given in addition to any remedy the pledgee may have in any
suit brought on this contract in any court in this State. Any suit arising out of or in
any way connected with this contract shall be tried in the County of Brazos, State of Texa
in any court therein having jurisdiction of the subject matter thereof.

On motion duly seconded and unanimously adopted, the Court voted to ask the Texas
State Highway Commission for early action in completing State Farm Highway No. 158, consist-
log of approximately four miles of road extending from the Williams' Raaoh headquarters to the
Navasota River at Ferguson Crossing, and of State Farm Highway No. 159, consisting of approx-
imately 10 miles of road, extending from Allenfarm to Millican and eastward to,interseot new
State Highway No. 6 on the Millioan Road, and for the completion of the Brazos Oounty section

g of the Old San Antonio road by the early construction of an underpass of the Southern-laoifio
a Railroad Linea near Benohley.
It was distinctly understood and intended that this request should not in any sense
k prejudice any other heretofore approved Brazos County farm-to-market road projects. The

County Judge was authorized to ask the State Highway Commission for an appointment-at which
f the Court could present its official request for the completion of the projects herein spoo-

if ied.
On motion duly seconded and adopted, by a majority of the members present, it was
voted to rent from Brazos A. Varisoo of Bryan. Texas, Hcoms Soo 208

p~ Varisco Building on Mein Street in the City of Bryan, at a monthly rental of $80.00, to be
rused as quarters for the State Department of Public Welfare workers in charge of Old Age
Assistance, Aid to Dependent Children and the Adult Blind; it being definitely understood the
the rental of #80.00 per month includes all utilities and heating.
On motion duly seconded and unanimously adopted, the Court voted to pay all bills
which have been properly filed and approved and for which budgeted funds are available.
On motion duly seconded and adopted by a majority of the members, it vise voted to
direct the Court secretary to write a letter to the Uounty Auditor quoting the action of the
Court on January 10, 1949, and asking him to comply with the Court's order to transfer to the
General Fund all of the balance remaining in the Officers' Salary Account on January 1, 1949,
save and except the sum of 95,500.00.
Whereupon the court adjourned.
