IT IS THEREFORE ORDERED by the Commissioners Court of Brazos County, Texas, that the said contracts be ratified and approved and that they are now and hereby ratified, J-~ approved, confirmed and adopted by this Court, which hereby declares them to be the sets and • I contracts of Brazos County, Texas, and to have all due and legal effect acoording to their tenor and purport. Seven Thousand Nine Hundred and 60/100 ($7,900.60) Dollars,-•Ybich it is desirable and con- venient to combine with the hereinabove mentioned South Texas Equipment Company, oona- tract of $32.,099.40, so as to make up the total of ,40,000.00, whioh amount is herein and hereby sougbt to be covered by the machinery warrants herein provided for. IT IS FUHTHER ORDERED by the Court that in a'coardence with the said contracts, interest bearing road machinery warrants of Brazos County, Texas, be and they are hereby ordered to be issued, numbered One (1) and Two (2), respectively, each in the denomination of $20,000.00, dated January 15, 1949, and maturing on or before May 1, 1950, and May 1, 1951, respectively. Both of said warrants shall bear interest from date until paid at the rate of two per cent per annum, the interest payable on or before May 1, 1949, and semi- annually yhereafter on November 1 and May 1, each year, until Bald warrants shall be fully paid off and discharged, which interest is part of the contract price agreed to be paid for said road me ohinery and equipment, both principal and interest being payable in lawful money of the United States of America at The First National Bank of Bryan, at Bryan, Texas. Said warrants shall be signed by the County Judge and attested and countersigned by the County Clerk and registered by the County Treasurer, and the seal of the Commiss- ioners Court shall be impressed upon each of them and the original signature of the county Budge and the County Clerk shall be signed upon each of the interest coupons. The warrants shall be typewritten, sighed, countersigned, registered and de- livered in the following form: NO. ONE $20,000.00 UNITED STATES OF AMERICA THE STATE OF TEXAS COUNTY OF BRAZOS BRAZOS COUNTY ROAD MACHINERY WARRANT THIS IS TO CERTIFY that for value received, Brazos County, Texas, is justly indebted and hereby obligates itself to pay to the South Texas Equipment Company, Inc., of Houston, Texas, and the Brazos Motor Company of Bryan, Texas, or bearer, on May 1, 1950, at The First National Bank of Bryan, Bryan, Texas, the sum of TWENTY THOUSAND AND NO/100 ($20,000.00) DOLLARS in lawful money of the united States of America, with interest thereon from th•e date hereof at the rate of two per centum, the interest being payable on May 1, 1949, and semi-annually thereafter on or before November 1, 1949, and May 1, 1950, upon presentation and surrender of the appropriate coupons for such interest which are attached to this bond; and the County Treasurer of Brazos County, Texas, is hereby auth- orized, ordered and directed to pay to the Bald South Texas Equipment Company, of Houston, Texas, and the said Brazos Motor Company of Bryan, Texas, or bearer the sold principal sum to®ther with interest thereon as evidenced by coupons attached hereto, all payable at The First National Bank of Bryan, at Bryan, Texas, out of and from any moneys to the credit of the special road machinery and equipment warrant fund created for the purpose, and if said sum or sums of money shall not be paid at maturity, the full amount thereof shall there- after bear interest at the rate of five par centum per annum until fully paid, and In the event of such default and collection thereof being placed In the hands of an attorney or attorneys for colleotion. or suit 1s brought thereon, then the said Brazos County hereby agrees and contracts to pay an additional five per cent of the amount owing as collection fees. In accordance with the terms of ArtioIs 2544 of the Revised Civil Statutes of Taxes, the Court authorized publication of advertisements for the selection of an official county depository for Brazes County for the biennium beginning April 1, 1949, and approved the following notice for such advertisements: NOTICE TO BIDDERS FOR COUNTY DEPOSITORY Notice is hereby given that Brazos County will receive bids up to ten o'clock a. M. on Monday; February 14, 1949, for a depository for the following biennium for all official county funds including those of common school districts., All funds must be protected by bond and pledge of cash or securities and also features of the Federal Deposit Insurance Corporation within the limits of its rules and regulations. All bonds must be accompanied by certified check payable to the Commissioners Court of Brazos County, Texas, for an amount not less than one-half of one per cent of the county revenues for the year 1948, which shall be forfeited if the successful bidder should fail or refuse to enter into the necessary contract and provide the re- quired bonds and pledges of cash or securities. In view of the adoption on November 2, 1948, of the amendment to Article 16, Section 61, of the Constitution of Texas, by the terms of which all constables are placed on a salary basi a rather than receiving their compensation from fees of office, the Court, ascertained from official records that the Constable of Justice Preoinot No. 4 of Brazos County, Texas, earned and retained fees amounting to $1483.95, and was paid an ex-officio salary of $750.00, thus making his compensation for the year 1948 amount to ;2233.95. In order to carry out the provisions of the Constitutional amendment as adopted by the people of Texas, therefore, the Court, upon motion duly seconded and unanimously adopted, voted to fix the salary -of the Constable of Justice Preoinot No. 4 of Brazos County, Texas, at $2250.00 for the year 1949, and directed that this salary be paid out of the Officers Salary Fund, and provided that all fees of office earned by the said Constable shall be by him col- lected and turned into the County Treasurer of Brazos County to be credited to the Officers Salary Fund of said county and that such reports shall hereafter be made monthly with the Treasurer's receipt attached as is required of other officers. Because all other constables of Brazos County have heretofore been compensated on the basis of official fees of of floe they earned, and in view of the fact that offioial reports for the calendar year 1948 showed no fees earned and collected by the constables from other Justice Precincts in the county, and in order to comply with the provisions of the foregoing Constitutional amendment, on motion duly seconded and unanimously adopted, the Court voted to fix the salaries of the constables of Justice Preoincts floe. 1, 3, 7 and 8, for the calendar year 1949, at 15.00 per month each, such payments to be made from the Officers Salary account, and provided that all of their fees of office shall be collected by them and remitted monthly to the County Treasurer as is required of other officers.
