Mr. Orubb, representing the Sinclair Refining Company, appeared before the Court md
presented a request for permission to lay a pipe line along the edge o~ the right-of-way
of a portion of Old State Highway No. 6, south of College Station=
IN THE MATTER OF THE APPLICATION
BY SINCLAIR REFINING COMPANY FOR
PERMISSION TO LAY PIPE LINES OVER
AND UNDER PUBLIC ROADS AND HIGHWAYS
On this 28th day of October, 19~?, at a special session of the Co~minsionere,
Court of Brazos County,Texas, there came on to be heard and considered the petition of
~inclair ~efining ~ompany, a Maine Corporation, .with permit to do business in the
State of Texas, for permission to lay a single 10-inch pipe line over, across, and under
Old State Highway No. 6, in Srazos County, A'exas, for an indicated point at the Jolly
Jones crossing south of College Station and continuing along the west side of said
' ~ounty read right-of-way appr~ximately one mile and to the southern line of the corpo-
ra, ts limits of the City of College Station, Texas;
· And the Court, after h~ving he~rd and duly considered the same, and being of the
opinion that said petition should be granted;
It is accordingly ordered, adjudged and decreed by the Court that said petition be
~ and the same is hereby in all things granted, and the said Sinclair Refining Company,
its successors and assigns, shall be and they are hereby granted the right and privilege
of building, constructing, maintaining, using, operating, repairing and ·removing a pipe
line, together with all appurtenances thereto, and also in connection therewith to
erect, construct, and maintain a telegraph and/dr telephone line, and appurtenances there-
to, along, across, on, in and under the public roads and highways, and the streets and
alleys of unincorporated cities and towns of the said Sra~.os County, Texas, at apprexi-
· ~ately the points shown on the map or plat attached to said petition, with all neces-
sary or appropriate rights of ingress and egress, and to so use, operate and maintain
the,s.aid lSne ,for so long a period of time as it is used for the p~rposes thereunto in-
tended by the said Sinclair Refining Company, subject, however', ~o the following pro-
visions and conditions:
(1) In ~he event any injury shall be occasioned by said Sinclair Refining Com-
pany to Brazos Coun.~y, whether real or personal property damage, by reason of the ....
building, construction, maintenances, use, operation, or removal of said pipe line
L~nd appurtenances, or of said telegraph and/or telephone line and appurtenances, then
q and. in such event', and upon. demand therefor, the said Sinclair Refining Company binds
and bbligat~s' itself to' fully pay, indemnify,, save and'keep harmless the said Brazo~,
~ 'County for any and all. damages,' COSts and expenses.occasioned, by, such injuries, ,such
payment t~ ~e made at Bryan, in Brazoe County,Te, xas:,
(2) T.he said ~inclair Refining. Company bin. ds and obligates itself to,bury and main-
rain ea~d pipe line at 'such depth and in such manner, and to · rect and maintain any
telegraph or telephone line (if erected) in such manner as not to interfere with ·

(]) At any point where such pipe line may cross a ~tate mainta~ned
Sinclair Refining Company binds and obligates itoal£ to specifications as may be
bed for a similar work by the State Highway Department of the S~ato of Texas~ and to
bore under the highway and encase tho pipe in such amnner and to such an ex~ent that the
~op of the casing will be buried to a depth of not les8 ~han eighteen (18) inches below
the low points in the borrow pits on either olde of tho roadways[ ~,nd at the poin=s
of road crossings, other than Sta~e ma~ntained hi~bways, the said Sinclair Refinin~
60mpany binds and obligates i~aelf to bury and install the pipe to a depth of not leas
than eighteen (18) inches below the low poSntain the borrow pits on either side of the
roadway.
(4) In ~he event roadway8o o~her than those indica~ed on the map or plat at~ached
to aa~d petition, 8hould hereafter bo opened or established by Brazes Countyo the~ and
in such event, and upon demand therefor0 tho said Sinclair Refining Company binds and
obli~ate8 itself to lower the pipe line os as to conform to the depth hereinabove
required a~ paint8 of crossing over presently existing roadways.
The entry by the said Sinclair Ref~ninE Company upon the public roads, high.aye and
other public ~rounds of Brazo8 County, for the purposes for which the foregoin~
of way is ~ranted, shall constitute full evidence and be conolusive of the agreement of
oaid Company to all of the terms and conditions of this &rant.
