The Commissioners' Court of Brazos County, Texas, met at nine o'olook'a. m., Tuesday r September 9, 1947, in the office of the County Judge at the Courthouse, in a recessed sessioc of the regular September term, with the following members present: A. S. Ware, County Judge, presiding; Norton R. Burkhalter, Commissioner, Precinct No. 1; William A. Conrad, Commissioner, Precinct No. 2; Clyde J. Porterfield, Commissioner, Precinct No. 3; Newton Burlin, Commissioner, Precinct ?To. 4; and A. R. Syptak, County Clerk. In view of the emergency existing after the torrential rains of approximately 14 Inches which fell in Brazos County on August 25, 19471 the Commissioners' Court found and declared an acute emergency existing with reference to the repair of damages to county roads and bridges, and that to meet such emergency it is necessary to have additional funds with which to pay for the required repairs to said roads and bridges. Whereupon the Court voted unanimously to issue and sell the remaining $18,000.00 of County Road Bonds still unissued and unsold following the election held in 1929, by which certain road bonds were authorized to be issued and sold. Upon consideration of bids and offers made for the purchase of these bonds, received by the County out of 23 firms contacted for that purpose, it was found that bids of spec- ified interest rates were as follows: T. On motion duly seconded and unanimously adopted, the Court voted to authorize the County Clerk to record the plat and dedication of "THE LARKINS SUBDIVISION", out of a tract of 19.7 acres of land in the Stephen Jones Survey, Brazos County, Texas, as submitted by Albert Larkins and wife, Frances Larkins, under date of August 29, 1947; with the distinct stipulation, however, that Brazos County shall not thereby become liable for the construction or maintenance of any streets or roads. ORDER AMIDING ORDER AUTHORIZING ISSUANCE OF BONDS: THE STATE OF TEXAS COUNTY OF BRAZOS ON THIS the 9th day of September, 1947, the County Commissioners Court of Brazos Texas, Texas, convened in regular session at a Regular Term at the regular meeting place . thereof in the Courthouse at Bryan, Texas, all members thereof, to-wit: A. S. Ware, County Judge, Norton R. Burkhalter, Commissioner Precinct No. 1, William A. Conrad, Commissioner Precinct No. 2, Clyde J. Porterfield, Commissioner Precinct No. 3, Newton Burlin, Commissioner Precinct No. 4, A. B. Syptak, County Cleric, being present, and passed the following order: WHEREAS, on the 28th day of September, 1929, an election was held in and throughout Brazos County, Texas, at which election, by more than two-thirds majority vote, the duly qual ified resident property taxpaying voters of Brazos County authorized the issuance of road, bonds in the amount of $1,100,000, for the purpose of the purchase and construction of dis- triot roads within Road Districts Nos. 1 and 2 of said county, and the further construction, maintenance and operation of maoadamized, graveled or paved roads and turnpikes, or in aid thereof, throughout said county, and authorized the levy and collection of a tax sufficient . to pay the interest on such bonds and provide a sinking fund for the redemption thereof at maturity; and WHEREAS, it appearing affirmatively that the hereinbefore mentioned election was regularly ordered upon a proper petition therefor, and that notice thereof was regularly give for the time and in the manner provided by law, and that said election was-regularly held in and throughout said Brazos County, and that only duly qualified resident property taxpaying voters of said county voted thereat; and that returns thereof were regularly made to the Com- missioners court of said County, and that said returns were regularly canvassed and the result thereof regularly declared by the Commissioners Court of Brazos County, and said Court found and declared that the proposition to issue such bonds and levy taxes in payment rs'.:.cat ~ <e+~: ..i s';s ~~1 5: ~.X tr,, d U n 0 11 j 'C P'• 35 3 September 9, 1947. -thereof was sustained by more than a two-thirds majority of the duly qualified resident property taxpaying voters of said county voting at said election; and WHEREAS, it further appearing that thereafter bonds denominated "BRAZOS COUNTY i F ROADIBONDS, SERIES "A", in the amount of $267,000, dated on or about October 10, 1929, were ; • A duly issued for the purpose of the purchase of district roads in Road District No. 1 of said County; and that "BRAZOS COUNTY ROAD BONDS, SERIES B", dated on or about October 15, 1929, in the amount of $56,000, were duly issued for the purpose of the purchase of district roads in Road District No. 2 of said county; and that bonds denominated "BRAZOS COUNTY ROAD BONDS, L. These gentlemen requested and urged the Court to open up and maintain a new county road connecting the old Dinkins-White Switch Road with the new State Farm-Highway No. 159, recently completed from Allenfaim to an intersection with State Highway No. 90 at the i Navasota River Bridge. Commissioner Burkhalter reported that his allotted funds were presently insufficient for the opening of this road and the other members of the Court were unable to suggest any method of financing the cost of such a project at the present time. The Commiss- loners' Court agreed with the visiting gentlemen, however, that such a road would be highly i desirable and that it would serve a comparatively large area ard a considerable number of people ' and that Brazos County would cooperate with them to the fullest extent looking toward the H tfuture construction of such s road, provided the land owners would furnish and deliver to the 1 t'• : ' County without cost an easement to, the 50-foot right-of--way throu&%out the length of the pro- • posed road. 1 In connection with the proceeds from the sale of 818,000.00 in Series "E" of 1947 Road ~f.
