The Commissioners' Court of Brazos County,Texas, met in'regular session in the office
of the Court Judge at the Courthouse at 10:00 a.m., on Monday, July 10, 1944, with the following
members present:
A. 8. Ware, County Judge, presiding;
Norton R. Burkhalter, Commissioner, Preoinot No. 1;
John A. Hyohlik, 'ommissioner, Precinct Ho. 2;
D. G. Cunningham, Commissioner, Preoinot No. 3;
Roy Danforth, Commissioner, Preoinot No. 4; and
A.B.Syptak, County Clerk.
On motion duly seconded and unanimously adopted, the Court accepted and approved
reports as follows:
Mrs. J.L.Brook, Chairman, Brazos County Welfare Board, for the months of May and
June of 1944;
E. 0.Paoe, Negro County Agent, for the month of June, 1944;
Fannie E. Jackson, Negro Home Demonsteation Agent, for the month of June,1944.
Laverne Reese, Negro Emergency War Food Adminiateation Assistant, for the month
of June, 1944.
County and precinct officers reports of fees collected, and duplicate receipts.
showing remittances to the County Treasurer of the amounts specified, were received and,

On Motion duly seconded e'nd unanimously adopted, it was voted to allowka credit Of
442.90 from the Hoed and Bridge rund to Precinct No. 4 for the reason that Precinct No,. 4
has heretofore furnished lumber for repair on the Navasota xiver Bridge, a county -wide
expense, as follows:
10 pos. 3x12-16: 480 board feet;
3 pca.3x12-20: 180 board feet

The Court took cognizance of the Brazos County'Tax,Jurvey issued by the East Texas
Chamber of commerce of Longview, Texas, during June of 1944, in which Brazos county. was
rated as a two -star, county for 1943 and other highly complimentary statements were made as
to the management and.present financial condition of the County.
The County Judge reported that in accordance with the authorization given on May 26,
1944, he had formally signed on behalf of the County the agreement with the Brazos County
ACA, providing for terracing and tank digging as follows:

' 1944 Production Practice No. 4 Brazos County
'-County Committee and Vendor Agreement of understanding with Respect to the Construction
of and payment for Earthen Dams or Reservoirs, 1944, Production Practice No. 4, Under
the '-enervation Materials and services Program
I, Brazos County,'rexae, acting herein by its Uounty Judge, as authorized by the Uom-
•missionere' Court, hereby agree to do all earth work, including the digging of the trench at
least four feet wide and deep enough to reach a reasonably impervious sub -soil along the
center line of the dam, and the scarifying of the entire base of the dam, necessary to
construct earthen dams or reservoirs under the Purchase Order Plan, a part of the Coneer-
ation Materials and Services Program, which meet the minimum specifications of 1944
Production Practice No. 4, as shown in SRB-801, Texas Handbook, 1944 Agricultural Con-
servation Program.
The Brazos County Committee, represented by J.E.Weedon, a member, agrees that in the event
the earthen dams or reservoirs constructed by the vendor meet the minimum specifications
as set out above, certification and recommendation for payment will be made in accordance
with the procedure set out in Conservation Materials and Services nulletin SRS -30, end
amendments thereto,
The vendor and the county committee further agree that the amount of payment to the vendor
authorized on the purchase order Form ACP-128 (revised) in the "Total" column, line 1,
,Section 1, will be computed in accordance with the provisions of the Conservation Materials
°and Services Program, SRS -30, Section 102, as amended, and will be based upon an estimated
'number of units of service to be delivered by the vendor. When the service has been de-
livered such &mount will be recomputed in accordance with the provisions of the Conserva-
tion Materials and Services Program,SRS-30, as amended, upon the basis of the number of
unite of service actually delivered. In bo event will the payment to the vendor exceed the
amount available to the farmer for'the difference between the oontraoted cost of the work
'and the amount to be paid by the AAA under the purchase order. Payment to the vendor by
the Government under any purchase order will be made only if the vendor furnishes such
additional units of service as are required tp complete dhe practice in accordance with
the specifications.

On motion duly seconded and unanimously adopted, the Court voted to approve and make
el&bigle for recording the plat and dedication of the E.W.Bullook-Subdivision of 60 sores
'• of land, lying partly in the S.F.Austin League No. 9, Abstract No. 62,'and the T.F.
McKinney League, Abstraot No. 33, in Brazos County,Texas, and shown in detail by the -
drawing submitted by Er. E.W.Bullook of Bryan, Texas.''
Came on to be'considered and canvassed the returns of special elections held by .
Brazos County Common School districts on Saturday, June 24,'1964,'in accordance with
.'proper orders heretofore entered as follows:

FOR increasing'the levy of'local school maintenanoe-tax from
thirty (300) cents to fifty (50c) cents on the $100.00 valuation

AGAINST increasing the levy of local school maintenance tax from thirty (300)
cents to fifty (500) cents on the $100.00 valuation of taxable property
within said district . 6 votes
Whereupon it was found and declared by the Court that the proposition to increase
the local school maintenance tax in Common School Dietriot No. 26, Minter Springs, had
been defeated by a majority of one vote;
In Common Sohool District No. 27, Smetana:
FOR INCREASING the levy of local aohool maintenance tax from fifty-five
(550) cents to seventy-five (750) cents on the 8100.00 valuation of
taxable property within said district 7 votes
AGAINST increasing the levy of local school maintenance tax
from fifty-five (550) cents to seventy-five (750) cents on
the 8100.00 valuation of taxable property within said district 34 votes
Whereupon it was found and declared by the Court that the proposition to increase
the local school maintenance tax in Common School District No. 27, Smetana, had been
defeated by a majority of 27 votes.
Came on to be considered the following resignation as submitted by Mr. D. D.
Dully, Constable of Preoinot No. 4, Brazos County, Texas:

Whereupon on motion duly seconded and unanimously adopted it was voted to accept Mr.
Dolly's resignation as submitted by him, to be effeotive from June 30, 1944.
On motion duly seconded and unanimously adopted the Court voted to reassign apace"
on the first floor of the Brazos County Court -house as follows:
To transfer the Justice Court for Preoinot No. 4, from the southeaat corner room
to the northwest corner room, end to reassign the room vaoated by the Justice Court to
the Brazos County Tex Assessor-Colleotor.
After detailed discussion of further space assignments, the County Judge was
authorized to make investigations and report back to the Court at a later session.
On motion duly seconded and unanimously adopted, the Court voted tp purchase from, -
Corbusier Chevrolet Company of Bryan, Texas, at a oeiling price of 81,478.71, one new
Chevrolet truck chassis, Motor No. 80626531, Serial No. 9Ddt30-14836, gross capacity
14,000 pounds, as authorized by WPB Certificate of Transfer No. 233469-C, Local Alloca-
tion No. 12D-7375, dated June 20, 1944, end telegram of July 8 from M.is.Kane, Chief,
Allocations Section, Highway Transport Department, Office of Defense Transportation
Washington D.C., to be paid from Road and Bridge Fund and to be used as county -wide
vehicle.
On motion duly seconded and unanimously adopted, it was voted to pay all bills
which had been filed and properly approved.

, TO THE HONORABLE COUNTY JUDGE OF BRAZOS COUNTY:
We, the undersigned residents and property owners of Minter Springs District #26 of ,o
Brazos Co., being a majority of the resident property tax pa'ing citizens of said dis-
trict who are entitled to vote at such an election hereby pray for an election to
determine if our local school maintenance tax shall be raised from 300 to 50$ on the
$100.00 valuation.

COUNTY OF BRAZOS I WHEREAS, on the 1st day of June, A.D. 1944, there was presented
, to me a petition for an election in Minter Springs Common School District No. 26, of
i,r„ Brazos County,Texas, to determine whether or not a majority of the resident property
taxpaying citizens who are qualified voters in said district, are in favor of in-
creasing the local so:cool maintenance tax from 30o to 500 on the 3100.00 valuation
of taxable property situated within said district; and
WHEREAS, said petition bears the signatures of J.G.rarsons and seven other
- .persons, constituting a majority of the qualified voters who are resident property tax
paying citizens within said district, and said petition is otherwise in conformity
- < with the law; and
WHEREAS, it appears that Brazos County contains a population of 26,977, according
to the 1940 United States census, and furthermore that said L,ommon Sohool District
No. 26, has heretofore been properly and legally established, and that it contains
an area of square miles; and
'..'HER^AS, it appears that said Common School District No. 26, is now collecting
end using a local maintenance tax of 300 per $100.00 valuation of taxable property
within said district.
NOW, THEREFORE, I A. S. WARE, in my official capacity as County Judge of Brazos
County,Texas, in response to said petition, do hereby order that an election be held
on Saturday, June 24, 1944, at the Minter Springs Schoolhouse in said Common School
District No. 26, to determine whether or not a majority of the resident property tax
paying'citizens who are legally qualified voters in suoh district desire to levy an
additional local school maintenanoe tax or increase the existing local school maintenance
,';tax from 300 to 500 on the 0100.00 valuation of taxable property within said district,
',and to determine whether or not the Commissioners' Court of said County shall be
*.authorized to levy, assess, and collect such inoreased local school maintenanoe tax;and
J.G.Parsons is hereby appointed presiding offioer of said election, and he shall'
• select two.olerka to assist him in holding said election, and he shall within five
days after said election has been held make due return thereof to the Commissioners'
Court of this county, as is required by law.for holding general elections.

sons who represent, themselves to be qualified voters who are resident property tax-
paying citizens within said district, and said petition is otherwise in conformity with

WHEREAS
. it appears that Brazos County contains a population of 26,977, according to
the 1940 United States census, and furhhermore that said Common School District No. 27
has heretofore been properly and legally established, and that it contains an area of
18-7/10 square miles, less the territory embraced within Hanus Addition to the City
ofBryan, which has now been incorporated within the Bryan Independent School District;
and
WHEREAS, it appears that said Common School District No. 27 is now collecting
and using a local maintenance tax of 55$ per $100.00 valuation of taxable property
.within said District. NOW, THEREFORE, I, A. O. Ware, in my official capacity as bounty Judge of Brazos
County,Toxae, in response to said petition, do hereby order that,an election be held''

him in holding said election, and he shall within five days after said election has been
held make due return thereof to the Commissioners' Court of this County, as is required by
law for holding general elections.
All persons who are legally qualified voters of this State and of this County and who
are resident property tax payers in said District shall be entitled to vote at said eleo-

their ballots the following:

of this order in each of three public places within the boundaries of said Diatriot for
at least ten (10) days before the date fixed for said election.
