COUNTY OF BR.AZOS ( PETITION FOR NEIGHBORHOOD PUBLIC ROAD
Commissioner's Court of Brazos County, Texas:
Please take notice that I the undersigned, B. T. Tarver, a resident property tax payia
citizen of Brazos County, Texas, do hereby respectfully petition said court for a public
neighborhood road not less than fifteen (15) feet wide out-let from the Macey-Edge Road to
the S.S. Yabry 100 acre farm now rented by me and along the following described points: At
a point in said road at the North corner of the A.D. Kopetsky, Sr. tract of 50 acres in sal
survey; Thence running in the southwesterly direction along the northwest line of said A.D
Kopetsky, Sr. 50 acre tract a distance of approximately 650 varas to the east bank of
Carters Branch; Thence in a northwesterly direction up said branch to the south corner of
said S.S.Mabry 100 acre tract.
The reason for this application for such public neighborhood road is that the farm I
rent is wholly enclosed by the lands of other people, and I have no outlet to a public road
and therefore, I am personally unable to go to my farm during wet weather except by walking
or horseback, and I desire a roadway which any be used for various and other purposes.
This is, therefore, a formal request for the opening of this road, as outlined above,
on land owned by A.D.L'opetsky, Sr. and George McDonald.

On motion duly seconded and adopted, the Court accepted the foregoing petition, and
directed the Clerk to issue citations to the owners of the lands specified in such petitio
said citations to be returnable to the Lurch term of the Commissioners' Court vhich convene
on March 10, 1941.
It having been brought to the attention of the Court that Frank South heretofore elect
ed
Constable of Justice Precinct No. 1, Milldcan, Texas, has removed from the rrecinot and Co
ty,
and has not taken the oath of office, and that this office is now vacant, it was voted to f
ill
such vacancy by appointment., llhereupon a motion was made that Carl E. Seely be appointed
fill the vacancy now existing in the office of Constable of Justice Precinct No. 1, Brazos
County, Texas, upon his giving bond in the sum of $500.00 as required by law, and taking
the oath of office. The motion was seconded and unanimously adopted.
On motion duly seconded and adopted, it was voted to pay all bills and accounts which
have been approved and filed with the County Clark.
V On motion of Commissioner Wehrman, and seconded by Commissioner Graham, and una~„ us
adopted, the Court voted to place a value of $300.00 on 100 acres of land owned by P. P.
Prescott in U. Howard, Assignee of A. G. Perry Survey, Abstract Number 136(not now on tax

Chamber of Commerce through its-Highway Committee, have heretofore prepared and submitted t
the Highway Department a.proposed county-vide highway plan, contemplating long range devel-
opment of,the present and future highway system in Brazos County; and
"PIMMAS, the plan,;,as submitted has been carefully studied and reviewed by the engineering
staff of the Highway Department; -

.County be, and is hereby, adopted and aecepted^substantially as proposed, with certain ame

ments and elatifying clauses hereinafter described and made conditional to this acceptance.
Reference is made to the map filed by Brazos.County and attached hereto and marked as
Exhibit "A", which is made a part of this record. On said map those sections of proposed
-
highways described as follows are hereby designated as State Highways:
1. J-E-X, extending from Highway No. 21 west of Bryan to Highway No. 6 south of Bryan.
2. A-H, extending from Highway No. 230 west of College Station tb Highway No. 21
west of Bryan.
3. B-K, extending from Highway No. 6 at or near College Station to an intersection w

Highway lNo. 6 and Highway No. 21 north of Bryan.
4. 1:-D-C-L, extending from Highway No. 6 south of Bryan to an intersection with press

State Highway No. 45 at the most practical point at or near Roans Prairie or Shiro
,
with the understanding that Huntsville is the eastern control point.
5. B-C, extending from Highway No. 6 at College Station to the designation described
above under No. (4).
"Section X41, extending from an intersection with Hi&hway No. 6 north of Bryan to an inter-
section with the O.S.R. near Wheelock, is not designated as a State Highway since it is
considered at the present time that this road is local in character and, consequently, she
d
be improved with funds other than regular State Highway Fluids. The State Highway Engineer
is directed to consult with the county relative to the routing and location of this road,
in order that such route, location, and right-of-way deeds may b e properly handled to fit
into a future highway, if and when such might be designated.
"Brazos County, through its Commissioners' Court, having advised that funds are either set
aside or available for the securing of right-of-way on the sections of highways described
her-cin, together with that portion of the O.S.R. between Highway No. 6 and U. S. Highway
No. 190, and Highway No. 21 between U. S. Highway 1:o. 190, and the present road wrest of
Bryan, and the co=ty road described above; and the Commissioners' Court having requested
that surveys and right-of-way deeds be prepared in order that proper right-of-ways may be
secured on this highway plan; therefore, the State Highway Engineer is directed to proceed
with the surveys and preparation of right-of-way deeds, turning such right-of-way deeds ovi
to Brazos County in accordance with their request.
"It is clearly understood that Brazos County will proceed with the securing of the entire
right-of-may requirements as proposed, of widths satisfactory to the State Highway Engines
,
(at Brazos county's expense) and in accordance with their proposal, no right-of-way to be
obtained until a definite plan of action has been indicated on the entire mileage. The

funds to be used for Right-of-Way, reported by the County as 0108,000.00, are to be reserv

intact until it is certain that all right-of-weV including Section K-;9 can be secured with
available money. It is further understood that the funds available for right-of-way
::will also provide for removal of obstructions and will provide for fencing with a suitable
design-of fence to be approved by the State Highway Department.

"^Nhile not made mandatory, by reason of possible legal difficulties, it is urged that at
-r_ all possible points easements be secured against billboards within 300 Peet of each right-
of-way line.

County does not contemplate priority of construction. The right-of-way to be secured and
fenced will be under the control of the Highway Commission and will be construct

the remainder of the Highway system throughout the state. No funds are available for con-

atructioa of any portion of these routes at this time. Each land owner from whom right--'
of-way is obtained is to be advised of this policy and, as far as practicable, land should

be kept in use until needed for the initial phase of the improvement.

"The State Highway Commission hereby commends the Commissioners' Court of Brazos County fcr
the farsighted policy which they have proposed and the constructive manner in which th

"This order is conditioned upon full acceptance of the provisions of said order by the
Commissioners' Court of Brazos Couapy."
Please note from the last paragraph of the Canute Order that the action taken

of the action taken should be furnished to the State Highway Department.

cooperate in this manner with your Court, and trust the final acceptance of this plan

On motion, duly seconded and unanimously adopted, the Court voted to purchase ans Jaeger
Tilting Bowl pheumatic-tired concrete mixer of 3-1/2 cubic feet capacity, fully equipped, an the low
bid of $283.00 lees two per cent discount for cash in thirty days or net $277.340 submitted by Browning'
Farris Company of Houston, Texasj and the County Judge was authorized to make the requisition therefor
against Road and Bridge Fund; and the machine to be used County-wide.
On motion duly seconded and unanimously adopted, the Court voted as being against
changing the date of eligibility from January 2, 1939, to January 2, 1941, for Bond Assumption Bill,
now pending in the Texas Legislature; and ratified the action of the County Judge in notifying the
County Judges and Commissioners AsaociAtion of Texas of this decision.
Whereupon the Court recessed to most again on Thursday, February 27, 1941, at 9:00 a.m.
for the purpose of canvassing the returns of a special school maintenance election to be held in
Common School District No. 7 (Harvey) on February 25.

There came an to be considered and canvassed the returns of a Special School Kainte4m=
Tax Election hold in Brazos County Common School District No. 7 (Harvey) an February 25, 1941, in
accordance with order heretofore issued, which said election was to determine whether or not a majority

twenty-five (251) cents on each One Hundred ($100.00) Dollars valuation of taxable property in said

District for thepurpoes of providing funds with which to make deferred payments an a school bus to be
used in transporting the shhool children of said District from their home to the City Schools of Bryan,
Texas, or elsewhere if necessary, with the understanding that when bus payments of approximately Twelve
Hundred ($1200.00) Dollars have been completed, there will be no further levy of said tax.
Whereupon said returns were duly canvassed by the Court and it was found that there were
a total of 16 votes for increasing the levy of ashool maintenance tax from fifty (500) cents to seventy

' five (731) cents on the $100.00 valuation of taxable property within said District, and no votes against
the proposition, or a aAjority in favor of said proposition of 16 votes.
Whereupon it was found and duly declared and ordered by the Commissioners' Court or Brazes
County, Texas, in session as aforesaid that said election had carried by a Kajority of 16 votes as afore.-

It is therefore ordered by the Commissionera' Court that there shall be levied and collecte
„ on the property lying within Common School District No. 7 of Brazos County, Texas, an additional School

' Maintenance Tax of 251 on the $100.00 valuation making a total School Maintenance Tax on property within

r said District of 731 per $100.00 valuation; which said additional 250 shall be used for the purpose of
-providing funds with which to make payments on a suitable school bus for use in transporting the school
