Brazos County, Texas, on July 31, 19400 open public hearing will be bold In the office of
the County Judge of Brazos County,Texas, in the Court House of said County, In Bryan,
Texas, at 10:00 a.m., on Tuesday, August 20, 1940, for consideration of the 1941 budget
for Brazos C__.ty, submitted to the Court on July 31, 19409 and now remaining on file in
the office of the County Clerk of said County, all In accordance with law.
"Taxpayers and others interested are invited and urged to acquaint themselves with
the said budget during the time It remains on file with the Clerk before the hearing.
"At the conclusion of the hearing, final action will be taken by the Commissioners'
Court of Brazos County,Texas, for the adoption of the budget for 1941 as finally agreed
upon.

Subject to approval by A. W. Snyder and Company of Houston, Texas, our fiscal agents
in the premises, you are hereby employed to handle the legal phases of the refunding of
$14,000.00 in Road and Bridge Bonds of Brazos County, Texas, in accordance with our con-
tract of even date with said fiscal agents: provided, tour charges shall be paid out of
the $300600 agreed upon as the full fee for such services with said fiscal agents.

September 3, 1940
The Commissioners' Court of Brazos County,Texas, met in recessed session of the regular
August Term, at 9:00 a.m., Tuesday, September 3, 1940, with the County Judge and all four
Comaissionere present.
Coming on to be considered and oanvessed were the returns of a special election held•in-
School District No. 24, Shady Grove, a Common school district of Brazos County, on Satudd$y
August 31, 1940, in accordance with proper order heretofore entered; which said election wa
on the proposition to determine whether or not the school maintenance tax in said District
should be increased from the present rate of fifty cents to one dollar on the $100.00 value
tion of property within said District. It was found that the returns of said election show
ed there had been twenty-one (21) votes oast in favor of such increase in tax and ten (10)
votes against the increase; so that the increase in tax received a majority of eleven (11)
votes. The Court, on such canvass, found said returns in due and regular order and that
a majority of the voters in such election had expressed themselves in favor of such inoreas
tax. It was, therefore, ordered by the Court that the election be declared to have car-
ried; that the maintenance tax in such District shall be increased from fifty cents (boa)
to one dollar (91.00) on the $100.00 valuation of property in said District; beginning
with the next tax year on October 1, 1940; and that the appropriate levy be made by the
Commissioners' Court of this County; so that the levies for common school District for
1940-1941 tax year beginning October 1, 1940, shall be and they are as follows:

Oeluation of taxable property situated within said District, which said petition carried
the signatures of Mike Triola and 23 other petitioners and has been determined to bear the
requisite number of signatures of resident property tax paying citizens who are qualified
voters within said District and otherwise in conformity of the law; and,
MMREAS, it appearing that Brazos County contains a population of twenty-seven thousi
fifty-two, according to the preliminary figures of the United StatesCensus; and,
It further appearing that said Common School District No. 23 has been heretofore
properly established; and,
It further appearing that said District so established contains an area of 7.55
square miles and that no other District has been reduced in area below nine square miles
by reason of the creation of this District;
NOW, THEREFORE I, A. S. Ware, in my official capacity as County Judge of Brazos
County,Texas, do hereby order that an election be held on the 24th day of August, A:D.
1940, in said Common School District No. 23, of Brazos County,Texas, at Snot Prairie
School House, to determine whether a majority of the legally qualified property taxpaying
voters of that district desire to levy a maintenance tax of Fifty (501) Cents on the
$100.00 valuation of taxable property situated withih said District, and to determine
whether the Dommissioners' Court of said County shall be authorized to levy, assess and
collect annually a tax of and at the rate of Fifty (50d)Cents on the $100.00 valuation
of taxable property within said District for maintenance of free public schools therein.
Roland F. Crenshaw is hereby appointed presiding officer of said election, and he
shall select two olerke to assist him in holding said election, and he shall within five
days after said election has been held make due return thereof to the Commissioners'
Court of this County, as is required by law for holding general elections.
All persons who are legally qualified voters of this State and of this County and whc
are resident property taxpayers in said District, shall be entitled to vote at said eleo-
tion, and all voters who favor taxation for school maintenance purposes, shall have wri-
tten or printed on their ballots the words:
"F levying a maintenance tax of Fifty
(8090 Cents on the ;100.00 valuation of
taxable property within said District."
And those opposed to such taxation shall have written or printed on their ballots

COUNTY OF'BRAZOS On this 9th day of September, 1940, the Commissioners' Court
of Brazos County, Texas, was convened in regular session at the regular meeting place,
thereof in the Courthouse in Bryan, Texas, with all the members of said Court present, viz:

at which time the following, among other business, was transacted:
Commissioner Graham, introduced an order and made a motion that it be passed. The
motion was seconded by Commissioner Rychlik. The motion, carrying with it the passage of
the order, prevailed by the following vote:
AYES: Commissioners Graham, Rychlik, Wehrman and Parker.
NOES: None.
The County Judge'announced that the order had been finally passed. The order as
passed is as follows:
WHEREAS, heretofore on the 8th day of February, 1926, an order was passed by this
Court, authorizing the issuance of $14,000.00 Brazos County Bridge Construction Bonds, dated
October 10, 1925, numbered from 1 to 14 inclusive, in denomination of ,11,000.00 each, bear-
ing interest at the rate of five per cent per annum, and maturing thirty-six years,frcm
date, with option of redemption ten years from date, all of which are now outstanding and
'unpaid; and
WHEREAS, the above described bonds, aggregating $14,000.00, can now be refunded by the

It is hereby found, ordered and affirmatively adjudged that the financial condition
of Brazos County will not permit such bonds to be made to mature in such installments as
will make the burden of taxation to support the same approximately uniform throughout the,
term of said bonds unless the maturities as herein listed make the burden of taxation to
paythe same approximately uniform.
III.
Said bonds shall bear interest at the rate of one and one-half per cent per annum,
payable :day 15, 1941, and Semi-annually thereafter on November 15 and May 15 of each year.
Both principal and interest of said bonds shall be payabl@ in lawful money of the united
States of America upon presentation and surrender of bonds or proper coupons at the First
National Bank, Bryan, Texas.

Each of said bonds shall be signed by the County Judge, oounteraigned by the County
Clerk and registered by the County Treasurer, and the seal of the Commissoners' Court of

The facsimile signatures of the County Judge and County Clerk may be lithographed or
printed upon the cuopons attached to said bonds, and shall have the same effect as if they

It is further ordered by the Commissioners' Court of Brazos County, Texas, that to
pay the interest on said bonds and to create a sinking fund sufficient to discharge them
at maturity, a tax of three and one-half (3J¢) cents on each 0100 valuation of taxable
property in said-County of Brazos, Texas,' shall be annually levied on said property and
annually assessed and collected until said bonds and-the interest thereon are paid, and
said tax is'hers now levied, out of the fifteen cents constitutional Road and Bridge Tax
for the current year 1940 and for each succeeding year while said bonds, or any of them,
are outstanding, and the same shall be assessed and collected for the current year and
annually thereafter, or so much more, if any,as may be necessary, and applied to the pur-
pose named.
X.
The taxes heretofore levied for the payment of the bonds being refunded by this order
are hereby ratified, brought forward and appropriated by this order for the payment of in-
terest and provision for sinking funds of the refunding bonds taking the place of said
bonds.
XI.
The County Judge is hereby authorized to take and have charge of said bonds pending
investigation by the Attorney General and registration by the Comptroller of Public Ao-
counts, and he is hereby authorized and directed to deliver said refunding bonds, in ex-
change for the surrender and cancellation of an equal amount par value of the hereiabefore
described Brazos County Bridge Construction Bonds, either all at one time or in install-
ments.
