Trustees of June 20th, 1925, and recorded in 'Volume 1, page 188, of i its Minutes, and also recorded in volume 1, page 29, of the Record of School Districts in * i ' the Office of the County Clerk of Brazoa County,Texas; and it further appearing that said , `•~„5 District as so established contains an area of thirty five (35) square miles, and that no l ~f other existing district has been reduced to an area of less than nine square miles by rea- son of the creation of this District and that no other district has been reduced in area r R by as much as nine square miles by virtue thereof; and it further appearing to the Court ' that the geographical center of said District is not more than four miles from the farthest boundary line thereof; and that said District does not now embrace any territory which was i taken from any other school district (either independent or common) that had an outstanding { issue of bonded indebtedness at the time of inclusion of said District; and it further ' y appearing that the terms, amounts, maturities, option of redemption and maximum rate of } t interest such bonds shall bear if authorized and issued and other pertinent details are all ' included in such petition; Now, therefore I, A.S. H~ Said bonds to be issued upon the faith and credit of said Tabor Common School District No. 12 of Brazos County, Texas, for the purposes of constructing and equipping public free G school buildings of wooden materials, to-wit: One five room school and combination audi- , torium and gymnasium and the purchase of sites therefor, and further to tear down the pro- sent school building and auditorium and use the material in the construction of the new buildings, within said District, and to determine whether or not the Commissioners' Court ; s of said Brazos County,Texas, shall be authorized to levy, assess and collect and disburse F' while said bonds or any of them are outstanding or unpaid, a tax upon all the taxable ; property within said District, sufficient to pay the current interest om said bonds and r provide a sinking fund sufficient to pay the principal as the same became due, which said levy is estimated at twenty three cents (230) per one hundred dollars of valuation. a John L. Walker is hereby appointed Presiding Officer for said election, and he shall be the Presiding Judge, and he is hereby authorized and directed to select two Judges and r_ the necessary clerks to assist him in holding said election, which shall be conducted from 8:00 a.m. to 7:00 p.m., on said date of Saturday, Way 11th, 1940, as aforesaid, and a he shall within two days after said election has been held, make due returns thereof to ' the Commissioners' Court of Brazos County, Texas, as required by law in such matters as for General Elections. The work to be performed on Railroad's property shall conform in general, to typical cross section shown on map so designated hereto attached, and made a part hereof. and all of said work shall be done to the satisfaction of Railroad's Division Engineer or Roadmaster. • r- (b) The County agrees to keep mowed and free of vegetation; in the mama manner that the highway embankment slope is mowed and cleaned of vegetation, that portion of Rail- °t road's property lying between the highway right of way,line and a line parallel with and ten (101),feet southwesterly therefrom. The County shall have the right to enter upon `~t• the Railroad's property with work animals and mowing machines or motorized mowing machines, t including the drivers or operators thereof, as may be necessary to perform mowing opera- }7i Lions and ditch cleaning operations. SECOND: (a) The County shall not claim an easement over any portion of Railroads propertybbetween the limits above set forth, by reason of the construction of a drainage ditch thereon, or the removal of vegetation therefrom, and no additional drainage ditches shall be out or established on Railroad right of way, nor will any changes be made in ditches which will divert additional drainage onto Railroad's property. 3 (b) The-engineers, contractors and employees of the County shallrespect and maintain ' i•h all track clearances as required by law or by the Railroad's rules and regulations and 'will perform all work on Railroad's property between the limits hereinabove set forth, An such a manner as to insure against persons, work animals or work equipment encroaching -within a distance of leas than fifteen (151) feet from the center line of any track. , THIRD: (a) In the construction of said Common ditch existing road crossing culverts- , . ,t% . ~ r, shall be relocated, new culverts provided if necessary and Railroad's roadbed shall be ' reinforced at points where such reinforcement is necessary, in the opinion of Railroad. S. Ware, in my-official capacity as County Judge of Brazos County,Texas, do hereby order than an election be ]Aeld on the 25th day of May A.D. ' 1940, at the Steele Store School House, at Steele Store, Texas, in said Common School District No. 18 of Brazos Couaty,Texas, to determine whether a majority of the legally qualified property tax paying voters of that district desire to inevease the present maintenance tax on said district, from twenty five (250) cents to fifty (500) cents on, the 9100.00 valuation of taxable property in said district, for the purpose of sup- plementing the State School fund apportioned to said District and to determine whether the Commissioners Court of this county shall be authorized to levy, assess and collect annually a,tax of and at the rate of fifty (500) cents on the $100.00 valuation of tax- able property in said district for said purpose.
