It is ~herefore ordered ~y the Co~ssioner's ~urt ~hat since said fees have been tu~ed over ~ the Cowry Clerk of Brazes County, Texas, and the s~e is ~ ~ 0ff~oer's salary ~d, that ~id Clerk Is hereby ordered to refund s~e to the applicants that ~ve paid same es sho~m by t~ records In said office., and this order ~all be h~s aut~l to pay ~e ~d ta~e their receipt for s~e. City of B~an, end which dedication was a~ta~ed to a ~p or plat of said Watch'S ,~dition, ~d ~lch street above referred ~ 'desig~ted os ~a~n Street" on said ~,~; and Whereas~ no acceptance of any kind was ever made or had by ~e Cowry of Brazes , and no use was ever ~de of such ~od or street by the public but said reed or roedw~ has been continuously used ~d occupied by the o~ners of the property abutting thereon ~d ~e~t by. them ~der fence ~d continuously e: closed since such dedication or attemDte~ ,.dedication; a~ whereas, Brazes County has never used or imp~ved said street or ~ad in . any m~er but ~s at all-time refused to accept the sene for ~y purpoae; ~d whereas, ']W. S. Howell has this dey'conveyed to the cowry of Brazes ~ts Nos. 3 and 1~ in Block No. es ~o~,on 'the above mentioned map for the pu$ose of'using such p~perty, es e road to . 'co~ect the streets fo~erly ~o~ on said Map %o have, been co~.eoted by Watch ~$treet,' ~ch lots ~ conv~-ed to con~itute ~ cont~nuation of."~len~od Street" as short on the~p .{ 328 of '$uher Addition", making a direct connection between said two original streets; E, ow, therefore be it resolved by'the Commissioners Court of Brazes County, in open Court, that the County do hereby accept said conveyance from W. S. Howell of such lots- and that it do accept same for street and road purposes, assuming the duty of impro,ving and grading same and of keeping same in suitable condition as a first class road.' Be it further resolved that Brazes County has never had nor claimed nor used any ~o'. tion of the above mentioned, ".Watson Street" and same was never accepted; that the County of Brazes do convey said street to ';:. S. H~well, the present owner of the entire Watson ~ddition including all property abutting on said Watson Street, by way of exchange for'th property this day conveyed by -. S. Howell to the County; that the County Fudge be, and he is hereby, authorized and empowered to execute and deliver unto.said U.. S.
