as Brazes county ~oad Bonds, Series A, dated October 10, 1929, are presented for exchange ~
end sensellation.
It is fun'that ordered ,that while said bonds, or any of them, are outstanding and un-
paid, there shall be.annually lev/edt assessed and collected, in due t:~e, form and m~nner~
an ed valorem tax upon all the taxable property in said Brazes County sufficient to pay the
current interest thereon and create a 8inkin~ fund sufficient to pay ~ach installment of the
princip~l as the same becomes due, end to pay the interest on sam bonds for the f~rat year
end to create a sinking ffund with which to pay the princip~l ae the seine becomes due, there
is hereby levied a tax of 15 Cents on each $100.00 valuation of taxable property in sa~d
County for the year 19350 and the name e~all be assessed and collected end applied to the
purpose nmed; and ~nile 8aid bonds, or any of them, are outstanding and unpaid, a tax for
each year at a ~ate from year to year, as will be ample and suf~tcient to provide funds to
paY the current interest on said bonds and to provide the necessary etnlctng fund, full allow-
enos being made for delinquencies end costs of collection, shall be, and ts hereby levied
for each year, respectively, while said bonds, or any of them, are outstanding and unpaid,

Co~ssione~s Cou~ a~ were advised by t~e Cowry ~udge t~t ~ portion of ~e seventy
(75~) cents ~inten~ce t~ could be used to purchase equipment. All ~t~t~oners
t~t twenty ~ve (25~) cents of this ~ax for a per[od of two years would be
t~ purc~se the needed e~ent ~d at ~e end o~ the two year per~od the twenty ~ve
(~5~) cent excessive ~nten~oe ~x could be added to t~ twent~ f~ve (~5~) cent bon~
t~, which ~uld retire ~e bonds ~th~n one-h~ff o~ ~e t~me th~ would othe~ise be
retired by o~y a twenty ~ve (25~) cent bond tax.
Petitioners ffurther sh~ to the Co~t that It was the ~ntention off the
the Cowry Superintendent and the Co~ssionere Court ~or ~e seventy ~ve (75~) cent
~lnten~ce t~ ~ ~e levied flor t~ years 19~9 and 19~0, and flor the ~nt~mnce
to be reduced a~ter 19~ to ~fty (50~) cents, on the $100.00 v~lon and t~t ~e bond
~ would be increased to flay (~0~) cents sifter 19~0. All P~es ~ve ~a~led to
out this ln~ention not~th~tand~ the ~act t~t the tr~tees were advised t~
Co~d be done.
Petitioners show to Re court that the excessive maintenance tax has produced ~n
money more than the school has needed to carry on its work and there Is a surplus of
~00.00 in the county depository which is idle and which is not needed to maintain the
schools in said distr~cto The present trustees of the district have been advised that
local maintenance tax ~oney could not be transfferred to the bond fund by them and the
County Superintendent.
~EP~FORE Petitioners pray the court that an order correotin~ the error above
out and authorizin~ a transfer of the surplus now in the local maintenance f~nd of S~ld
school district to the bond l'und and an order direotins the trustees and the County Super-
intendant to apply all of said money so transferred on the out-standins bonds of said
school d lstrict.
Petitioners further show to the Court that the record off the bond tax election is
shown in Co~niselonera Court record, Volume H, pages 567, to 573, and that there ia no
record of any nmintenanoe tax election, returns, pet~tion, order or anyth~n~ of the k~ndo
On pa~e 567 off Volume ~, there is a statement from the County Superintendent to the Com-
m~ssionere Court eettin~ out taxable valuations and ~u6geetin~ a twenty-five (~5~) cent
bond tax and a seventy five {?55) cent maintenance taz for the year 1929, and on -~aid pa~e
.there is a levy by the Con~LtseiOners Court of said tax in said amounts for that year.
This is the only record we have of any reference to a maintenance tax followLu~ the
election of April ~0, 19~9,
