Acknowledge receipt of the annual report from each of the four Constables summarizing and analyzing law enforcement contact data 21. To make arrangements, call (979) 361-4102. 9L. • COMMISSIONERS' COURT REGULAR MEETING MARCH 4, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, • Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, March 4, 2003 with the following members of the Court present: Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. • Under citizen input/and or concerns the following made comment : Dan Bates - quoted from the Bryan Eagle concerning "Brazos County Health" being "free". On January 22, 2003 Commissioner Cauley sat next to him at a meeting and Vol 41 Page ) 4 01 0 Commissioners' Court meeting March 4, 2003 2 coughed on him throughout the entire meeting. When he asked to be tested, the Health Department stated that they were on a limited budget, which was not what the Eagle says today. They would not test him for free. He then asked where Commissioner Cauley was today. He told the Court that it was time to answer where he is and that he has an attorney and will take the issue to court. The Court next considered Budget Amendment #02/03- 17.1, that would transfer funds from Community Public Health to the Reserve Fund Balance. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20039816 through 20040063 On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Mallard, Vol Lt I Page 1 i~R • Commissioners' Court meeting March 4, 2003 3 seconded by the County Judge, the Court voted unanimously to approve the changes as submitted. The Court next considered an Order Adopting a New Voting System. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to adopt the eSlate Electronic Voting System for use through out the county in all election precincts. The next matter before the Court was an Order dividing three voting precincts, creating four additional voting precincts and consolidating the four additional voting precincts. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to adopt the Order. A copy is attached. The Court next considered the lease of office space for the Justice of the Peace and Constable, Precinct 1. Term of the lease is for the period of July 1, 2003 through September 39, 2003 then will establish October 1 as the commencement date of the 1st option period. On motion by commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to enter into a lease agreement with Southwood West for the period stated above. The next matter for consideration was an Addendum to Administrative Services Agreement with Employment Benefit Services to reduce the service charge percentage rate for past due payments from 1.5% to 1% as allowed by statute. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the Addendum. A copy is attached. The Court next considered a request from Constable Precinct 2, Donald Lampo, to appoint Jeffery Wayne Reeves as unpaid Reserve Deputy Constable. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to approve the request from Constable Lampo to appoint Jeffery Wayne Reeves as unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. The next matter before the Court was a request by Constable, Precinct 3, for the replacement of a storage building utilizing contingency funds. On motion by Commissioner Peters, seconded by the County Judge, the Court voted unanimously to approve the request. The Court members continued to discuss the subject and then on motion by Commissioner Jones, seconded by Commissioner Vol 41 Page 161 C~ Commissioners' Court meeting March 4, 2003 5 Mallard, the Court voted unanimously to approve the purchase of the 10 foot x 12 foot mini storage building by J. M. Portable Buildings and to take the $1,318.00 from Contingency funds. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to adopt a resolution endorsing the efforts of the concerned • citizens in obtaining the placement of a traffic signal at the intersection of highway 21/190 and FM 2776/Andert Road. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to authorize the County Judge to execute the following Tax Resale Deeds to the following individuals: a. Bennie Taylor, Jr. - Part of Lot 22, Block 1, James Addition, City of Bryan, Brazos County, Texas. b. Bennie Taylor, Jr. - Lot 23, Block 4, Bryan's First Addition, City of Bryan, Brazos County, Texas. is c. Bennie Taylor, Jr. - Lot 13, Block 4, Bryan's First Addition, City of Bryan, Brazos County, Texas. The Court next considered renewing the maintenance agreement with Fujitsu Computer Products of America, Inc. to service the scanners located in the District Clerk's Vol 41 Page ) 5 2, • Commissioners' Court meeting March 4, 2003 6 office and the Information Technology Department. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve renewing the maintenance agreement at a cost of $4,485.00. The next matter before the Court was the cancellation of Bid # 2002-063 - Asphalt, Oil and Emulsion and authorizing the Purchasing Department to advertise for a re-bid of Bid #2002-063. This action is necessary due to fluctuating crude oil prices. The Purchasing Department suggests re-biding on a cost-plus mark-up basis. On motion by Commissioner Jones, seconded by the County Judge, the Court voted unanimously to approve the recommendation of the senior buyer, cancel the original bid and then re-bid it on a cost-plus mark- up basis. The Court next considered awarding RFP #2003-021 - Inmate Telephone System. The Purchasing Agent recommended awarding the RFP to Evercom. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the bid to Evercom. The representative from T-Netix pointed out an error on the bid tabulation but it was a moot point. Vol 41 Page )53 • Commissioners' Court meeting March 4, 2003 7 The Court proceeded to consider the following blanket Purchase Order: Kwik Kar Oil Sheriff $2,000 On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered the request from Verizon • to construct a road bore in the right-of-way of Lake Front Drive and approximately 684 feet of buried cable in the right-of-way of Woodview Drive. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the request from Verizon and authorized the installation. Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Jones a) Reminded everyone of a workshop today in room #108 scheduled to begin at 1:30 p.m. The topic will be facilities. Commissioner Mallard a) He just received the agenda for the High Speed Rail meeting in Houston tomorrow. He asked if anyone else could attend the meeting. He commented that more notice should be given on future meetings. Dan Bates a) Asked if a request needed to be filed in order to receive the minutes on this meeting in Houston. Commissioner Mallard said he would ask. b) Asked Court to look at the Health Department. Yesterday he was informed by a well-known person that Carey Cauley was stepping down. Asked the Court if this was true. The County Judge suggested he call Mr. Cauley. Mr. Bates then asked why the health of Brazos County citizens had not been protected. There were no agency/board/committee reports by Court members. Vol q-!
