To make arrangements, call (979) 361-4102. no; 1....:- t • COMMISSIONERS' COURT REGULAR MEETING FEBRUARY 25, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, February 25, 2003, with the following members of the Court present: Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioners Mallard gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns The Court first heard a presentation by Kay Parker on the • United Way First Call for Help Program (211). The County Judge read aloud a Proclamation designating of March 1 through April 26, 2003 as eight weeks of fun and fitness called "Walk Across Texas". The Court joins with the Cities of Bryan and College Station to promote physical activity and overall good health. On motion by the County Vol L41 Page ( 9~ 0 Commissioners Court meeting February 25, 2003 2 Judge, seconded by Commissioner Jones the Court moved to proclaim the week of March 1 through April 26 as eight weeks of fun and fitness called "Walk Across Texas" throughout Brazos County. The County Judge then presented the signed Proclamation to Ms Alma Fonseca, representing the Texas Cooperative Extension Service. The online website is www.brazoswat.com The Court next considered Budget Amendment #02/03-16.1 through 16.4, which would transfer funds to Community Support, Road & Bridge and Treasurer from Contingency, and reallocate funds for the 272°d District Court. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20039587 through 20039815 On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Mallard, seconded by Vol L+t Page l~ u Commissioners Court meeting February 25, 2003 3 Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered authorization for acceptance of donated property for Constable, Precinct 2. The Department of Public Safety has donated a video camera box with an estimated value of $3,900.00. On motion by Commissioner Peters, seconded by Commissioner Jones, the Court voted unanimously to accept the donated property. The next matter for consideration by the Court was a request submitted by the Director of the Information Technology Department seeking approval for out of state travel for three (3) staff members. The staff members would be traveling to Napa Valley, California to attend the 2003 Pentamation West Coast Client Conference April 13th through the 16th, 2003. On motion by Commissioner Jones, seconded by Commissioner Mallard, the Court voted unanimously to grant the request from the Director of the Information Technology and approved payment of out of state travel expenses for three (30) staff members. • The Court next considered designating a Commissioners Court representative to the Texas High Speed Rail and Transportation Corporation. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to appoint Commissioner Kenny Mallard as Brazos County's Vol 1+ ~ Page , I a 0 Commissioners' Court meeting February 25, 2003 4 representative to the Texas High Speed Rail and Transportation Corporation. The next matter for consideration was approval of tax refund applications from the following individuals and/or companies: a. Larry Lawless, over payment, $214.10 b. La Voz Hispana, corrected value, $171.30 C. Jerry A. Smith and Marcell Etal, $210.00 d. Carrie B. Smith, $210.00 e. Howard L. & Idabell Dehart, $86.86 f. Nicolad D. & Esther Ponce, over age 65, $154.10 g. Devon Gas Services, over payment, $3,612.44 h. Billie Swonke, over payment, $25.19 i. Thomas W. Winder, over payment, $7.74 j. Boral Bricks, over payment, $13.19 k. Delores Krause, over payment, $47.71 On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the previously listed refund applications. The Court next considered a request by the Information Technology Department to negotiate with Sunguard Pentatmation for the upgrade of the financial software program. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the blanket maintenance agreement. A copy is attached. The Court next considered the request from Verizon to construct a road bore in the right-of-way of Elmo Weedon Road approximately 1,950 feet from its intersection with Grassbur Vol Li ~ Page 1.02` - 0 Commissioners' Court meeting February 25, 2003 6 Road. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the request by Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the minutes of the Commissioners' Court meetings held in December 2002 on the following dates: Regular Meetings - 10", 17th, 31st Special Meeting - 4th Workshop - 10th On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the minutes as submitted. Vol LL ( Page 13-5 Commissioners' Court meeting January 7, 2003 The Court next acknowledged the receipt of the annual report from Sheriff Chris Kirk summarizing and analyzing law enforcement contact data compiled by the Sheriff's Office deputies. The report is required by racial profiling legislature. Said that the Board interviewed for a new MPO Director but no decision had been made yet. b. Tomorrow, in Austin, it is Bryan/College Station Day. The Chamber has a bus going there for the festivities. Commissioner Jones made the following comment: a. Reminded everyone about the workshop being held next Tuesday at 1:30 p.m. to discuss facilities. He needs input from officials. Commissioner Mallard made the following comment : a. Commissioner Jones will be speaking to the Small Business Development Board on issues concerning the water board. The County Judge continued with the following comment: c. He commended the elected officials and department heads for making themselves accessible to other counties by providing help. There was no citizen input and/or concerns. There were no Agency/Board/Committee reports by Court members. There being no further business to come before the Court, the meeting was adjourned. SOURCE OF FUNDS: N/A REQUIREMENTS: 1) No work will be permitted between front slope and/or back slope. 2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line. 3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so and to remove all cleared brush, trees etc from county right-of-way. 4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698, test shall be conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. 5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction. This will be a 50 feet bore at a minimum depth of 36 inches. The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that the tender of this notice by the Verizon Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void.
