29. Acceptance of Warranty Deed from Edward L. Zweifel and wife, Eva Zweifel, for
improvements to Zweifel Road located in Precinct 2.
30. Approving the Treasurer's Reports for the months of November, 2002 and
December, 2002 and the Quarter Ending 12/31/2002.
31. Approving the minutes from the following Commissioners Court meetings:
a. Regular meetings conducted on November 5, November 12, November 19, and

REGULAR MEETING
FEBRUARY 4, 2003
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, February 4, 2003, with the
• following members of the Court present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4, Absent;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input/and or concerns, Dan Bates made the
following comments:

1. He spoke about health issues
of concern to
the
county. He inferred that there
was corruption.
He
then vowed to run against the
County Judge in
the
next election because he was
tired of people
not
telling the truth.
The Court next considered Budget Amendment #02/03-14.1
through 14.2, which would reallocate funds for the Sheriff's
Administration and the Road and Bridge Department. On motion

by Commissioner Jones, seconded by Commissioner Peters, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Mallard, seconded by
Commissioner Jones, the Court voted unanimously to approve the
changes as submitted.
The Court next considered the appointment of a member to
the Expo Center Citizens Advisory Committee. On motion by
Commissioner Peters, seconded by Commissioners Jones and
Mallard, the Court voted unanimously to appoint Alvin W. Jones
as a voting member to the Citizens Advisory Committee.
The next matter before the Court was the selection of
additional candidates to serve on the 2003 Salary Grievance
Committee. On motion by Commissioner Jones, seconded by
Commissioner Peters, the Court voted unanimously to appoint

the following individuals:

The Court next considered appointing a representative and
reappointing current members to the Brazos Valley Council of
Governments Criminal Justice Advisory Committee. On motion by
• the County Judge, seconded by Commissioner Mallard, the Court
voted unanimously to appoint Bob Wiatt as the new member and
then on motion by the County Judge, seconded by Commissioner
Peters, the Court reappointed the following individuals:
1. Linda Castoria
2. Doug Weedon
3. Chris Kirk
4. Dan German
5. Robert Reed
6. David Patterson
7. Ed Feldman
The next matter for consideration was the appointment of
a representative to the Brazos Valley Council of Governments
Revolving Loan Fund 2003 Loan Administration Board. On motion
• by the County Judge, seconded by Commissioner Mallard, the
Court voted unanimously to appoint Al Scott from Wells Fargo
Bank to the Brazos Valley Council of Governments Revolving
Loan Fund 2003 Loan Administration Board.
The Court next considered appointing a County

representative to the Brazos Valley Council of Governments
TMPA Feasibility Study Team. On motion by the County Judge,
seconded by Commissioner Peters, the Court voted unanimously
to appoint Commissioner Mallard to Brazos Valley Council of
Governments TMPA Feasibility Study Team.
The next matter before the Court was the appointment of a
member and reappointing a current member to the Brazos Valley
Council of Governments Regional Advisory Committee on Aging.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to re-appoint Alice Stubbs
but did not appoint a new member.
The Court next considered reappointing two current County
representatives to the Brazos Valley Council of Governments 9-
1-1 Regional Advisory Committee. On motion by the County
Judge, seconded by Commissioner Peters, the Court voted
unanimously to re-appoint Roy Galny and Demerle Giordano to
the Brazos Valley Council of Governments 9-1-1 Regional
Advisory Committee.
The Court next considered authorization for acceptance of
donated property by the Constable, Precinct 3. The State of
Texas has donated three (3) M-7-2TX Mobil Vision, Car video
Camera, Serial #090928, #090932 & #090936 with an estimated
value of $11,985.00. On motion by Commissioner Mallard,

seconded by Commissioner Peters, the Court voted unanimously
to accept the donated property.
The next matter for consideration by the Court was a
request submitted by the Sheriff seeking approval for out of
state travel for himself. Sheriff Kirk would be traveling to
Nashville, Tennessee to attend the National Sheriff's
Association 2003 Annual Conference & Exhibition during the week
•
of June 21st through the 25th, 2003. On motion by Commissioner
Peters, seconded by Commissioner Jones, the Court voted
unanimously to grant the request from the Sheriff and approved
payment of out of state travel expense for Sheriff Kirk.
The Court next considered a request from Constable
Precinct 1, James Marrow, to appoint James H. Taylor as unpaid
Reserve Deputy Constable. On motion by Commissioner Jones,
seconded by Commissioner Peters, the Court voted unanimously
to approve the request from Constable Marrow to appoint James
as unpaid Reserve Deputy Constable subject to appointment
being within the allotted number of deputies.

The next matter before the Court was the approval of a
resolution providing for the sale of property (described as
Lot 10, Block 1, Sweet Briar Addition to the City of College
Station) acquired by the County of Brazos at delinquent tax
sale. On motion by the County Judge, seconded by Commissioner

Mallard, the Court voted unanimously to adopt the Resolution
providing for the sale of property to Mr. and Mrs. Mark A.
Doucet for $116,000.00.
On motion by Commissioner Mallard, seconded by the County
Judge, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deeds to the following
individual and organizations:
a. Elder-Aid - Lot 1, Block 1, West Park Addition,
City of Bryan, Brazos County, Texas.
b. Elder-Aid - Lot 2, Block 2, West Park Addition,
City of Bryan, Brazos County, Texas.
c. Richard Sanchez, Lot 2 and the adjacent one-half
(1/2) of Lot 3, Block 2, Sunset Addition, City of
Bryan, Brazos County, Texas.
The next matter for consideration was Tax Refund
Applications and Appraisal Review Board Supplement Refunds to
the following individuals or businesses:
a. Associates Housing, over payment $602.99
b. Leonard Bewley, over payment $17.63

On motion by Commissioner Jones, seconded by Commissioner
Mallard, the Court voted unanimously to approve the Tax Refund
Applications and Appraisal Review Board Supplement Refunds in
county taxes for the previously named companies and
individuals.
The Court next considered authorizing the County Judge t.c
• accept the Award of Grant funds for Indigent Defense from the
Task Force on Indigent Defense and execution of all necessary
documents. On motion by Commissioner Jones, seconded by
Commissioner Peters, the Court voted unanimously to authorize
County Judge to accept the Award of Grant funds, in the amount
of $76,274.00, for Indigent Defense from the Task Force on

Indigent Defense and execute all necessary documents.
The Court next considered authorizing the Road & Bridge
Department to utilize Capital Expenditure Funds for the
acquisition of a vehicle. This is necessitated because the
vehicle used by the Right-of-Way Agent was found to be unsafe
for driving. On motion by Commissioner Jones, seconded by
Commissioner Peters, the Court voted unanimously to authorize
the Road & Bridge Department to utilize Capital Expenditure
Funds for the acquisition of a vehicle.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(4). This is for the purchase of professional
engineering services from Rabon Metcalf Engineering. On
motion by Commissioner Jones, seconded by Commissioner Peters,
the Court voted unanimously to approve the Exemption from
Competitive Bidding Requirements.
The next matter for consideration was the extension of
the following bids:
a. Bid #2002-037 Auctioneer Services
Jim Swigert has agreed to extend this bid at the same
price and in accordance with all terms and conditions
previously agreed to and accepted with Swico auctions
through September 10, 2003.
b. Bid #2002-033 Gasoline and Diesel Fuel
Prtimary Vendor, Petroleum Traders, Secondary Vendor,
K. D. Timmons, Inc. A six month renewal to allow for
evaluating the need for a new fuel system.

On motion by Commissioner Jones, seconded by Commissioner
Mallard, the Court voted unanimously to approve the
extensions.
The next matter for consideration was the renewal of the
following bids:
a. Bid #2002-030, Decking Timber, Primary Vendor, Bayou
Forrest Products, Inc., Secondary Vendor, Kennedy
Saw Mills for the same cost and for the term of
• February 15, 2003 through February 15, 2004.
b. Bid #2002-031, Bridge Pilings, Colfax Treating
Company, for the same cost and for the term of
February 15, 2003 through February 15, 2004.
C. Bid #2002-032, Bridge Repairs, Jay-Reese
Contractors, Inc., for the same cost and for the
term of February 15, 2003 through February 15, 2004.
On motion by Commissioner Mallard, seconded by the County
Judge, the Court voted unanimously to approve the renewals.
The Court proceeded to consider the following blanket
Purchase Order:
• Labatt Instit Juvenile Services $8,500
On motion by Commissioner Peters, seconded by the County
Judge, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the

general public. The Road and Bridge Department requested
permission to enter the private property of Deliah Fleming on
I&GN Road in Precinct 1 to remove a berm of dirt from the
fence line of the proposed I&GN Road project for drainage
purposes. On motion by Commissioner Jones, seconded by
Commissioner Peters, the Court voted unanimously to authorize
the work.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the

Zweifel Road.
On motion by the County Judge, seconded by Commissioner
Peters, the Court voted unanimously to receive, approve and
order filed as submitted the Treasurer's report for November
and December 2002. A copy of each is attached to and made a
part of these minutes.

The Court next considered approval of the minutes of the
Commissioners' Court meetings held in November 2002 on the
following dates:
Regular Meetings - 5th, 12th, 19th, 26th
Public Hearing - 19th
Workshop Session - 26th
Commissioner Jones moved to approve as submitted.
Commissioner Peters seconded the motion. Commissioners Jones,
Peters and Mallard-voted "Aye". The County Judge abstained.
The motion carried.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) There will be a facilities workshop either
in evening on February 17th at the Brazos
Center or during the day on March 4th in the
Commissioners Courtroom. He plans to send
out a memo to all department heads
beforehand for input.
b) The V. G. Young Institute of County
Government Conference will be coming up
soon.
Commissioner Mallard made the following
comment :
a) He asked about an update on the Expo Center.
The County Judge's Administrative Assistant
said she was working on having the
commissioner attend the evening meeting
February 11, 2003.
There was no citizen input and/or concerns.

Under Agency/Board/Committee reports by Court members,
made the following spoke:
a. Commissioner Peters reported that he met with Brazos
Beautiful and that they are planning a fundraiser to
raise enough money to plant memorial trees in honor of
Dorothy Miller.
b. The County Judge asked department heads not to bring
hourly staff to the evening Commissioners Court
meetings so as not to have to pay overtime.
There being no further business to come before the
• Court, the meeting was adjourned.

On this the 4th day of February 2003 at a regular meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on February 4, 2003 the Court heard and approved a
budget amendment for the 2002-2003 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted August 23, 2002 the following amendment(s)

AT DELINQUENT TAX SALE
WHEREAS, Lot 10, Block 1, Sweet Briar Addition to the City of College Station, Brazos County,
Texas being that property more particularly described in Vol. 466, Page 80 of the Deed Records, Brazos
County, Texas and Volume 4683, Page 111 of the Official Records, Brazos County, Texas was offered
for sale by the Sheriff of Brazos County, Texas at a public auction pursuant to a judgment of foreclosure
for delinquent taxes by the District Court; Cause No 46,763-361; County of Brazos et al vs. Karl
Dahlstrom; and
WHEREAS, no sufficient bid was received and the property was struck off to the County of Brazos,
Texas, passant to TEx. PROP. TAx CODE §34.01(c); and
WHEREAS, TEx. PROP. TAx CODE §34.05(a), (h) and (i) provide that a taxing unit may accept a
sufficient bid. A bid of One hundred sixteen thousand and no hundredths dollars ($116,000.00) having

I am pleased 1o inform you that the Texas Task Force on Indigent Defense has awarded Brazos
County a grant in the amount of $76,274. Your Formula Grant Award Statement for fiscal year
2003 is attached.
Last week, the Task Force was directed by the Governor, Lt. Governor and Speaker of the House
to submit a plan to reduce current spending this fiscal year by 7 percent. The purpose of this
request is to assist Texas m keeping the Texas budget balanced. The Task Force will address the
specifics of this issue at its next meeting in April. Once a date and time is set, notice will be
posted immediately on the 'Task F'orce's website. Please be aware that your county may not
receive the full award amount. Any necessary reduction will be tailored to minimize the impact
on direct services and will not compromise the mission of the Task Force. Your cooperation,
efforts and understanding concerning this budget issue are most appreciated.

The Task Force on Indigent Defense (Task Force) has awarded the above-referenced grant. The
authorized official named on the grant application must sign this Statement of Grant Award and
return it to the 't'ask Force by February 16s'. The grantee will not receive any grant funds until
this notice is executed and returned to the Task Force.
Standard Grant Conditions:
• The authorized official for the grantee accepts the grant award.
• The authorized official, financial officer, and program director, referred to below as grant
oiiiciais, agree to lite tears of the grant, including the Mies and documents adopted by
reference in the Task Force on Indigent Defense's Grant Rules in Title 1, Part 8, Chapter
M, Texas Administrative Code.
• The grant officials understand that a violation of any tens of the grant may result in the Task
Force placing •a temporary hold on grant funds, permanently deobligating all or part or the
grant funds, requiring reimbursement for funds already spent, or barring the organization
from receiving future grants.
• The indigent defense plan(s) submitted on behalf of the county shall comply with the
indigcrt Dofer se Givat Program Acknowledgment contained in the formula grant
application. The Task Force will notify the authorized official if it determines that one or
more of the plans submitted for a county does not comply with the Acknowledgment
requirements. If a new plan or plan amendment addressing the deficient areas of the plan is
not submitted to the Task Force within 45 days of the date the authorized official is notified
of the deficiency, then the Task Force will place a hold on grant funds until the county
complies with the Acknowledgment requirements. If a county fails to comply by the end of
the grant period (September 30, 2003) any funds disbursed to the county under the FY 2003
formula grant must be returned to the Task Force.
Special Grant Conditions:
The grant officials understand that they must satisfy all special conditions placed on this
grant as listed below 1wfore receiving any funds:
+ The judges of district and county courts trying criminal cases and the juvenile board shall
submit to the Office of Court Administration, on behalf of the Task Force, copies of the plan
used for timely and fairly appointing counsel in criminal and juvenile cases required by
Government Code Section 71.0351(a) to have been submitted by January 1, 2003. Pursuant
to the 2003 Indigent Defense Countywide Plan Instructions issued by the Task Force on

PPRI Is providing business support services to the Task Force on Indigent Defense

As we have discussed, RME may require some assistance from the County and your office in
mapping, graphics, guidance in the SWMP format, oversight on County regulatory limits, and
other issues relevant to the permit. Since this permitting and SWMP will have to be assembled
in a relatively short time period, I would anticipate having routine, bi-monthly meetings with
you, your WA commissioners, and other parties involved
