COMMISSIONERS' COURT
REGULAR MEETING
JANUARY 21, 2003
A regular meeting of the Commissioners' Court of
Brazos County, Texas was held in the Brazos County
Commissioners Courtroom in the Courthouse in Bryan,
Brazos County, Texas, beginning at 9:00 a.m. on Tuesday,
January 21, 2003, with the following members of the Court
present:
Randy Sims, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the
citizens and officials that were in attendance.
Commissioner Peters gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns
The Court next considered Budget Amendment #02/03-
12.1, which would transfer funds from Contingency to Road
& Bridge Contingency. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted

unanimously to approve the budget amendment as submitted,
a copy of which is attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims
as submitted.
The Court proceeded to consider the change of status
of employees as submitted on the attached Personnel
Action Requests. On motion by Commissioner Cauley,
seconded by Commissioner Mallard, the Court voted
unanimously to approve the changes as submitted.
The Court next considered approving Terri G. Lee as
a paid Deputy Constable for Precinct 2. On motion by
Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve Terri G. Lee.
The next matter for consideration was the appointing
of a member to the Community Healthcare Endowment Fund
Review Committee. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted
unanimously to appoint Effie Perry to the Community
Healthcare Endowment Fund Review Committee.

The Court next considered authorizing the County
Judge to execute agreements for discounted rates with
health providers outside of the Network. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the County Judge to
execute agreements for discounted rates with health
providers outside of the Network.
The Court next considered approving the following
requisitions for the Road & Bridge Department:
a. Bid No. 2003-015R Hydrated Lime $35,000
b. Bid No. 2003-016R
c. Bid No. 2003-017R
d. bid No. 2003-018R
Concrete $10,000
Material Hauling $200,000
Herbicides & Surfacants
$10,000
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
previously noted requisitions.
The Court next considered the request from Verizon
to construct a road bore and 2,112 feet of buried cable
installations in the right-of-way of Bird Pond Road. The
site is located in Precinct 3. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Mallard, seconded by

Commissioner Cauley, the Court voted unanimously to
approve the request from Verizon and authorized the
installation. A copy of the request is attached hereto.
The Court next considered the request from Verizon
to place 125 feet of buried cable and two (2) telephone
poles for aerial cable installation in the right-of-way
of Dilly Shaw Tap Road at Mathis Creek. The site is
located in Precinct 2. The County Engineer noted the
following exception:
Due to this relocation being related to bridge
construction, the poles should be as far away from
the bridge construction as possible and right
against the right-of-way fence line.
On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to
approve the request from Verizon and authorized the
installation contingent upon Verizon complying with the
exception noted by the County Engineer. A copy of the
request is attached hereto.
The Court next considered the request from Wickson
Creek Special Utility District to construct a road bore
for waterline installation in the right-of-way of Elmo
Weedon Road approximately 300 feet southwest of Steep
Hollow Road. The site is located in Precinct 3. The
County Engineer stated that all appeared to be in order

and recommended approval. On motion by Commissioner
Mallard, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request from Wickson Creek
Special Utility District and authorized the installation.

The Court next considered the request from Wellborn
Special Utility District to construct a road bore for
waterline installation in the right-of-way of Stousland / -
Road approximately 650 feet from its intersection with
Straub Road. The site is located in Precinct 1. The
County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner
Jones, seconded by Commissioner Peters, the Court voted
unanimously to approve the request from Wellborn Special
Utility District and authorized the installation. A copy
of the request is attached hereto.
The Court next considered approval of the Re-Plat of
Peach Creek Estates, Lots 28A (2.00 Acres) and 28B
(2.4257 Acres) in Precinct 1. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted
unanimously to approve the re-plat of Peach Creek
Estates, Lots 28A (2.00 Acres) and 28B (2.4257 Acres) as

submitted.
Under announcement of interest items and possible
future agenda topics the County Judge made the following
comments :
a. Thanked the members of the Court for being "on
call" as we dealt with mediation for the Bienski
property.

Commissioner Mallard made the following
comment:
a. He asked about a meeting to organize
the agenda. This is called consent
agendas where some items are grouped
together and voted on in groups.
Commissioner Jones made the following
comments :
a. He commented on (2) bills before the
legislature that he is concerned
about.
1. HB 297 requiring voter approval
for Certificates of Obligation
funds over 2 million dollars. He
recommended that the Court write
a letter to our representatives
requesting that the limit remain
at 10 million dollars.
2. HB 398 that would allow public
housing projects in any town with
a university and that they would
be tax-free.
b. He received an E-Mail saying that the
county failed to submit grant
information for an indigent defense
program. The County Judge replied
that he is in the process of
submitting the necessary paperwork.

The County Judge continued his comments:
b. There will be a Commissioners Court
meeting tomorrow at the Brazos Center
with Congressman John Carter. It will
begin at 9:00 a.m.
There was no citizen input and/or concerns.
Under Agency/Board/Committee reports by
Court members, the following made comment:
a. County Judge - had a meeting
with the architect on the Expo
Center concerning the
environmental study being
conducted.
b. Commissioner Jones - he and
Commissioner Mallard met with
the intergovernmental committee
and discussed the issue of
county money and health care.
He will meet today with the
health care consultant who has
already met with the two cities.
There being no further business to come before the
Court, the meeting was adjourned.

Commissioners' Court, the following members were present:

THAT WHEREAS, on January 21, 2003 the Court heard and approved a
budget amendment for the 2002-2003 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted August 23, 2002 the following amendment(s)
to the original are hereby authorized, as described on the attached
page(s).

ITEM: Request from Verizon to construct a road bore and 2.112 feet of buried cable
installations in the right of Bird Pond Road. Site is located in Precinct 3.
• SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All Installation(s) shall be constructed In designated utility easements, if applicable. If no utility
easement exists, the Installation(s) shall be 1) within 3-5' of and parallel to the right-of--way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicants
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall
be conducted by an independent geotechnical testing firm; copies of all test results shall be
furnished to the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all
other State and Federal laws governing utility construction.

To The Commissioner's Court of Brazos County
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will construct a
communication line within the right-of-way of a County Road in Brazos County, Texas
as follows:
Verizon will place a buried communications cable along Bird Pond Road. We will
Place 1200 feet of cable 2 feet inside the northwest right-of-way at a minimum
depth of 30 inches. We will then bore under Bird Pond Road and place the cable
inside a 4" PVC conduit under the road at a minimum depth of 36 inches. We will
proceed placing the cable 4 feet inside the southeast right-of-way for a distance
of 300 feet. We will also place 612 feet of cable along Bird Pond Road 2 feet
inside the northwest right-of-way in front of Wellborn Water Supply building
before Carter's Creek.
The location and description of this line and associated appurtenances is more fully
shown by five (5) copies of drawings attached to this notice. The line will be
constructed and maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that
tender of this notice by the Verizon Southwest does not constitute a waiver, surrender,
abandonment or impairment of any property rights, franchise, easement, license,
authority, permission, privilege or right now granted by law or may be granted in the
future and any provision or provisions so construed shall be null and void.
Construction of this line will begin on or after December 16, 2002.

ITEM: Request from Ver'Izon to place 125 feet of buried cable and two (2) telephone
poles for aerial cable installation in the right of way of Dilly Shaw Tap Road at Mathis
Creek See Notes/Exceptions for further requirements. Site is located in Precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698: test shall
be conducted by an Independent geotechnical testing firm; copies of all test results shall be
furnished to the office of the Brazos County Engineer.
5) Construction shalt be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all
other State and Federal laws governing utility construction.
Due to this relocation being related to bridge construction, the poles should be as
far away from the bridge construction as possible and right against the right of
way fence line.

To The Commissioner's Court of Brazos County
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Verizon will place two (2) telephone poles and anchors at a
creek crossing along Dilly Shaw Tap Road where a new
bridge is under construction. We will also place 125 feet of
buried cable 3 feet in the right-of-way from an existing pedestal
# 16 to a new pole being placed on the southwest side of the
creek.
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after January 20, 2003.
