REGULAR MEETING
DECEMBER 31, 2002
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the 85tt' District Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 31, 2002, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1, Absent;
Wm. S. Thornton, Commissioner of Precinct 2;
C. B. Jones, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
The first matter before the Court was a presentation to
P. David Romei of the Arts Council of Brazos Valley. The
County Judge presented Dr. Romei with a plaque in recognition
and appreciation for his part in the construction of the
Veteran's Memorial and other art sculptures in the Brazos
Valley. Dr. Romei thanked the Court.

There was no citizen input/and or concerns.
The Court next considered Budget Amendment #02/03-11.1,
that would transfer funds from the Juvenile Services TYC
Reserve Funds to contract placement. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached.
• The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve

On motion by Commissioner Cauley, seconded by Commissioners
Thornton, the Court voted unanimously to approve the official
bonds.
The next matter before the Court was the approval of a
cash incentive for Universal Computer Services, Inc. On motion
by Commissioner Thornton, seconded by Commissioner C. B.
Jones, the Court voted unanimously to approve the payment of
$30,000 cash incentive to Universal Computers.
The Court next considered receipt of funds from the
County's depository for fee reimbursement. On motion by the
County Judge, seconded by Commissioner Thornton, the Court
voted unanimously to remove this item from the agenda.
The next matter for consideration was a request by a
County employee for payment of mileage expenses incurred in
previous fiscal year and submitted in non-compliance with
policy. Commissioner Thornton moved to deny the request.

The motion was seconded by the County Judge. Commissioners
Thornton, C. B. Jones and the County Judge voted "Aye".
Commissioner Cauley abstained. The motion carried.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Texas Voting
Systems, Inc. for temporary storage of new voting equipment.
Cost to Brazos County will be $50.00 per month for the two (2)
• spaces until such time as the permanent storage area is
completed. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to enter into
contractual agreement with Texas Voting Systems, Inc. A copy
of the contractual agreement is attached.
The next matter for consideration by the Court was a
request submitted by the Jail Administrator seeking approval
for out of state travel for himself. Mr. Wayne Dicky would be
traveling to Albuquerque, New Mexico to attend the American
Jail Association Conference during the week of May 4th through
the 8th, 2003. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to grant the
request from the Jail Administrator and approved payment of out
of state travel expense for Mr. Wayne Dicky.
The next matter before the Court was the appointment of a
representative of the City of Bryan to the Brazos Valley

Ground Water Conservation District Board of Directors. On
motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to appoint W. T. McDonald,
Jr. to the Board of Directors.
The Court next considered appoint members to the Brazos
County Historical Commission. On motion by Commissioner
Cauely, seconded by Commissioner C. B. Jones, the Court voted
unanimously to appoint the following members to the Brazos
County Historical Commission:

The next matter before the Court was authorizing the
payment of indigent health care invoices incurred in previous
fiscal year. On motion by Commissioner C. B. Jones seconded by
Commissioner Thornton, the Court voted unanimously to
authorize the payment of the invoices.

The court next considered authorizing the Maintenance
Department to expend a maximum of $3,500.00 to concrete the
floor of the old juvenile recreation yard to convert the area
to storage space. On motion by Commissioner Cauley, seconded
by Commissioner Thornton, the Court voted unanimously to
authorize the Maintenance Department to expend a maximum of
$3,500.00 to concrete the floor of the old juvenile recreation

The Court next considered a request from Constable
Precinct 1, James Marrow to appoint Archie P. Clark and Ernest
R. Ortiz as Deputy Constables for the Constable of Precinct 1.
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the request
from Constable Marrow to appoint Archie P. Clark and Ernest R.
Ortiz Deputy Constables.
The Court next considered a request from Constable
Precinct 1, James Marrow, to appoint Robert F. Huet as an
• unpaid Reserve Deputy Constable. On motion by Commissioner
Cauley, seconded by Commissioner Thornton, the Court voted
unanimously to approve the request from Constable Marrow to
appoint Robert F. Huet as an unpaid Reserve Deputy Constable
subject to appointment being within the allotted number of
deputies.

The Court next considered a request from Constable
Precinct 2, Duane Peters, to appoint Christopher A. McDermott,
Agustin G. Rubio and Steven L. Emert as Deputy Constable. On
motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the request
from Constable Peters to appoint Christopher A. McDermot,
Agustin G. Rubio and Steven L. Emert as Deputy Constables.
The Court next considered a request from Constable
Precinct 2, Duane Peters, to appoint Gene Schiller, E. Duane
Peters, Steve Allen Cruse, Donald Wayne Folterman and Adrian
Tijerina as unpaid Deputy Constables. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request from Constable
Peters to appoint Gene Schiller, E. Duane Peters, Steve Allen
Cruse, Donald Wayne Folterman and Adrian Tijerina as unpaid
Deputy Constables subject to appointment being within the
allotted number of deputies.
The Court next considered a request from Constable
Precinct 3, D. Wayne Thompson to appoint Thomas Coleman as
Deputy Constable for the Constable of Precinct 3. On motion
by Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request from Constable
Thompson to appoint Thomas Coleman Deputy Constable.

Thornton, the Court voted unanimously to approve the request

The Court next considered a request by Constable,
Precinct 4, Isaac Butler, to appoint Steven Winthrop Sprague
as an unpaid Reserve Deputy Constable. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request from Constable
• Butler to appoint Steven Winthrop Sprague as an unpaid Reserve
Deputy Constable subject to appointment being within the
allotted number of deputies.
The Court next considered a request by Constable,
Precinct 4, Isaac Butler, to appoint James T. Armstrong,
Hezekiah Carter, Jr. and Carlos Ybarra as Deputy Constables.

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the request
from Constable Butler to appoint the previously named as
Deputy Constables.
The Court next considered a request by Constable,
Precinct 4, Isaac Butler, to appoint Glenda Bosley, Adrian
Thomas, Marcus Griffin, Monica Bell and Steven Sprague as
unpaid Reserve Deputy Constables. On motion by Commissioner
Cauley, seconded by Commissioner Thornton, the Court voted
unanimously to approve the request from Constable Butler to
appoint the previously mention individuals as unpaid Reserve
Deputy Constables subject to appointment being within the
allotted number of deputies.
The Court next considered awarding the following bids:
a. Bid No. 2003-015R, Hydrated Lime, Annual Bid
Becky Stephens, Senior Buyer, recommended
acceptance of the bid submitted by Austin
White Lime.
b. Bid No. 2003-016R, Concrete, Annual
Bid (renewal of 2002-026)
Becky Stephens, Senior Buyer, recommended
acceptance of the bid submitted by
Transit Mix Concrete as primary and the
bid submitted by Boyd Ready Mix as
secondary.

On motion by Commissioner Cauley, seconded by Commissioner
• Thornton, the Court voted unanimously to accept the
recommendations of the Senior Buyer and awarded the contracts
as noted. A copy of each bid tabulation is attached.
The next matter for consideration was approval for the
Purchasing Agent to advertise the following bids:

On motion by Commissioner C. B. Jones, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the Purchasing Agent to advertise for the previously noted
bids.
The Court next considered approval of the Re-Plat of Lots
1-5, Block 2 of Rustic Oaks Subdivision Phase One, 16.35 Acres
in Precinct 2. Richard Vance, County Engineer, stated that he
had reviewed the plat and offered the following comments:
1) Add notation to Note #9: "However, Lots 3R
through Lots 7R are subject to flooding'' (per
Art. IV, Para. C, Line 8 of the Subdivision and
Development regulations).
2) All lots in this re-platted subdivision shall
have driveway access to internal subdivision
roads only (per Art. V, Para. C, Line 5).
On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Re-Plat of
Lots 1-5, Block 2 of Rustic Oaks Subdivision Phase One, 16.35
Acres subject to the developer complying with the exceptions
noted by the County Engineer.
The Court next considered approval of the Vacating and
Final Plat of Lot 1, Block 4 of the First Installment of
Rainbow Acres Subdivision in Precinct 3. Richard Vance,
County Engineer, stated that he had reviewed the plat and

recommended acceptances as submitted. On motion by
Commissioner C. B. Jones, seconded by Commissioner Cauley, the
Court voted unanimously to approve the Vacating and Final Plat
of Lot 1, Block 4 of the First Installment of Rainbow Acres
Subdivision as submitted.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Koppe Bridge Road in Precinct On

motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from Wesley T. Bissett, Jr. and wife Tammie L. Bissett for the
expansion and improvements to Koppe Bridge Road.
The next matter before the Court was the acknowledgement
of receipt of evidence that the four County Constables have
been issued permanent peace officer licenses under Chapter
1701, Occupations Code. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously

to acknowledge receipt of evidence.
The Court acknowledged receipt of the Extension Service
reports for September, October and November 2002 and
acknowledged receipt of reports from the following County and
Precinct Offices showing revenues collected and remitted to
the County Treasurer:

A copy of the Officials' reports can be viewed in the County
Auditor's office.
There were no announcements of interest items.
There was no citizen input and/or concerns.
The County Judge commented on the achievements of the
court during his administration:
1. Completion of the Expo center plan
2. Thanked the Expo Committee
3. New Juvenile Justice Center
4. Expanded Jail by 144 beds
5. Courthouse renovations - for more space
6. Transportation - thanked the Chamber of Commerce
(Highway 21 East, Highway 6 South and Greens Prairie
Road Extension, thanked Richard Vance, County
Engineer and the Road & Bridge Department. TxDOT
has allocated money to replace several bridges.
7. Economic Development - thanked the EDC for luring in
such businesses as Sanderson Farms and USC.

8. Court has worked with both cities on Tax Increment
Financing for projects like Wolf Creek area and
Traditions Golf Course

9. Redistricting - the Court worked to align the county
and make the precincts more consistent. He feels
there is one more step to be taken, with a
Magistrate in the Courthouse we no longer need two
(2) Justices of the Peace in Precinct 2. He also
said that the offices of County Attorney and
District Attorney needed to be consolidated.
10. Budget - the Court has been a good steward of Brazos
County's funds. There has been no tax rate increase
in the eight (8) budgets he presided over. His only
regret is that he was unable to reduce the tax rate.
11. Automation - Implementation of the TSG program,
Pentamation and the purchase of new voting machines.
12. Improvements - Road & Bridge has new equipment and
other departments have new vehicles.

He said that every decision he made, he felt was in the best
interest of Brazos County.
He said that he would miss the people and then thanked
some individually.
At 9:55 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in Closed

Executive Session to discuss the acquisition of real property
as allowed under Section 551.071 and 551.072 of the Texas
Government Code.
At 10:03 a.m. the County Judge announced the meeting open
to the public and on motion by Commissioner Thornton, seconded
by Commissioner C. B. Jones, the Court voted unanimously to
approve, through Attorney Kyle Hawthorne, the mediation for
condemnation case for the Exposition Center.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 31st day of December 2002 at a regular meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;
C. B. Jones, Commissioner, Precinct 3;
Carey Cauley, Jr., Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on December 31, 2002 the Court heard and approved a
budget amendment for the 2002-2003 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted August 23, 2002 the following amendment(s)
to the original are hereby authorized, as described on the attached
page(s).
ADOPTED AND APPROVED this the 31st day of December, 2002.

Re: Request for Cash Incentive- Universal Computer Services, Inc.
Dear Judge Jones:
The Bryan - College Station Economic Development Corporation (EDC) requests Brazos County's consideration
for $30,000 to met the requirement under Performanoe Agreement Between Universal Computer Services, Inc and
Bryan - College Station Economic Development Corporation (see attached agreement)
Under the terms of the agreement, EDC will pay to UCS a total of $90,000 over a three year period according to the
schedule below:
• $30,000 within ten (10) working days of the date of issuance of a Certification of Occupancy for
the new building In the Business Park at College Station.
• $30,000 on the first anniversary of issuance of the aforementioned Certificate of Occupancy.
• $30,000 on the second anniversary of issuance of the aforementioned Certificate of Occupancy.
The Certificate of Occupancy has been issued and is attached. In addition, there Is an Invoice from the EDC for the
amount of $30,000. Also attached is a summary of all Brazos County Incentive Fund transactions sure Inception.
A copy of the signed Performance Agreement is attached for your review and record.

This agreement is made this 31' day of December, 2002, by and between TEXAS VOTING SYSTEMS, INC., a
Texas Corporation, and the COUNTY OF BRAZOS, State of Texas.
WrI NESSETIL:
Whereas, Texas Voting Systems, Inc. is the business of renting office space to the public, and
Whereas, the BRAZOS COUNTY is desirous of renting temporary storage space for storing various components of
the eSlate Voting System until such time as the permanent storage area is completed.
Now, Therefore, in consideration ofthe premises and mutual promises and obligations herein set forth, it is agreed that:
TEXAS VOTING SYSTEMS, INC. agrees to rent to Brazos County two climate controlled office spaces located at
1512 South Texas Avenue, Bryan, Texas Texas Voting Systems agrees to make the space available to Brazos County until
such time as the permanent storage area is completed and ready for occupancy.

The COUNTY OF BRAZOS, State of Texas, will be responsible for having the components of the voting
equipment delivered to office building located at 1512 South Texas Avenue, Bryan, Texas. Brazos County will provide
personnel on site to receive the equipment when it is delivered and account for the all delivered equipment. Brazos
County will provide Texas Voting Systems with a list of all equipment stored at 1512 South Texas Avenue. Brazos
County will provide Texas Voting Systems with a list of all equipment removed firm the premises and the date removed.
Brazos County will be responsible for packing and moving all equipment to the permanent storage location.

The consideration to be paid by BRAZOS COUNTY to TEXAS VOTING SYSTEMS, INC. for rental of the
temporary storage space will be FIFTY DOLLARS AND NO CENTS ($50.00) per month until such time as the equipment
is moved.
IN WITNESS WHEREOF, the parties have hereunto set their hands, this 31• day of December, 2002.
