REGULAR MEETING
NOVEMBER 12, 2002
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, November 12, 2002, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
C. B. Jones, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.
The County Judge read aloud a Proclamation designating
November 15, 2002 as "Texas Recycle Day". The Court joins
with Brazos Beautiful to commemorate the 10th Anniversary of
the recycling program. On motion by the County Judge,
seconded by Commissioners Tony Jones, Thornton, C. B. Jones,

Cauley and the County Judge then presented the signed
Proclamation to Ms. Laura Tankers lay-Glenn, representing
Brazos Beautiful.
The Court next considered Budget Amendment #02/03-7.1
through 7.3, which would transfer funds to Road & Bridge from
Contingency, increase the minor furniture account and
reallocate funds for the 85"' District Court. On motion by
• Commissioner Tony Jones, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Tony Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
• Requests. On motion by Commissioner Tony Jones, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.

The Court proceeded to canvas the results of the General
Election held November 5, 2002. The County Judge read aloud
the votes cast in each state wide race. On motion by
Commissioner Tony Jones, seconded by Commissioner Cauley, the
Court voted unanimously to accept as true the totals as
tabulated by the County's automated tabulating equipment and
ordered the results to be certified to the Secretary of State
and recorded in the Official Election Records of Brazos
County. On motion by Commissioner- Tony Jones, seconded by
Commissioner Thornton, the Court voted unanimously to accept
as true the local races' totals as tabulated by the County's
automated tabulating equipment and ordered the results to be
certified to the Secretary of State and recorded in the
Official Election Records of Brazos County A copy of all
election results as tabulated are attached hereto.
The Court next considered the proposed job description
for Classification 1512 Detention Officer-Transport Deputy as
submitted by the Sheriff's Office-Jail Administration. On
motion by Commissioner Tony Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the fob
description.

The next matter for consideration by the Court was a
request submitted by the Jail Administrator seeking approval
for out of state travel for himself along with Sheriff C.
Kirk, and Commissioner Tony Jones. They would be traveling to
Longmount, Colorado to attend the "National Institute of
Corrections, Planning of New Institutions (PONI) Program
November 18-22, 2002. On motion by the County Judge, seconded
• by Commissioner Thornton, the Court voted unanimously to grant
the request from the Jail Administrator. Commissioner Cauley
will be included in the group attending. This trip is at no
cost to the County.
On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to cancel the
December 3, 2002 Commissioners Court meeting.
The next matter for consideration was a tax refund to the
following individuals:
1. Thomas L. Hardee, Jr., acct. # R106806
is On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to
refund $295.40 in county taxes for 2001.
2. Rudolph W. and Rosalie Zalobny, acct. #R16751
On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously
to refund $210.00 in county taxes for 2001.

3. Richard A. and Mary Volz, acct. # R83080
On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to
refund $210.00 in county taxes for 2001.

On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to
refund $210.00 in county taxes for 2001.
5. Dr. Terry M. Jones, acct. #N8814133 and N8823014

On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously
to refund $6.20 and $79.37 in county taxes for
2001.
6. Herman E. Jackson, Sr. and Estella Rittenhouse
acct. # M102611
On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to
refund $178.07 in county taxes for 2001.
The Court next considered a request by the County
Treasurer to change the payroll distribution date from Friday,
November 29, 2002 to Wednesday, November 27, 2002. This is
necessitated due to payroll falling during the Thanksgiving
Holidays. On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve

the request to change the payroll distribution date from
Friday, November 29, 2002 to Wednesday, November 27, 2002.
The next matter before the Court was consideration of an

Amendment to Contract with St. Joseph Hospital for County
Group Health Insurance. St. Joseph Hospital is offering an
exclusive discount rate of 45% if St. Joseph is the only
hospital covered in-network on our medical plan or a non-
exclusive discount rate of 35% if St. Joseph and the College
Station Medical Center are both covered in-network. On motion
by Commissioner Tony Jones, seconded by Commissioner Thornton,
the Court voted unanimously to approve the 35% non-exclusive
discount rate and to become effective January 3, 2003.
The Court next considered a change in benefits for the

On motion by Commissioner Tony Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the benefits
and that it become effective January 3, 2003.

On motion by Commissioner Tony Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
Prescription Drug Service and that it become effective January
3, 2003.
The next matter before the Court was the change in
monthly medical insurance premiums for dependent coverage.
The changes are as follows:

Commissioner Tony Jones moved to approve. Commissioner
Thornton seconded the motion. Commissioners Tony Jones,
Thornton, C. B. Jones and the County Judge voted "Aye".
Commissioner Cauley abstained. The motion carried.
The Court next considered an Amendment to the Plan
Document & Summary Plan description for the County's Section
125 Plan (Flex Plan) to increase the out of pocket expenses
• for medical prescription and dental expenses from $3,000.00 to
$4,000.00. On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve

order is attached.
The Court next considered a policy for the number of
handicapped parking spaces and time-restricted spaces on East
26th Street. On motion by Commissioner Tony Jones, seconded by
Commissioner Thornton, the Court voted unanimously to adopt
• the attached policy.
The Court next considered authorization for acceptance of
donated property by the Texas Department of Transportation
(TxDOT). TxDOT has donated in-car video cameras, Serial
Numbers 090928, 0910932, 090933,090934,090935, 090936 with an

estimated value of $3,995.00 each. These are to go to all the
Constables. On motion by Commissioner Cauley, seconded by
Commissioner Tony Jones, the Court voted unanimously to accept
the donated property.
The next matter before the Court was an application for
service renewal agreement with Verizon for two main data line
to the Courthouse. On motion by Commissioner Tony Jones,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the application for service renewal agreement with
Verizon for two main data lines to the Courthouse.
The next matter for consideration was approval for the
Purchasing Agent to advertise the following bids:
RFP 2003-020, Purchase of Financials/HR Server
Bid 2003-013, Office Supplies.
On motion by Commissioner Cauley seconded by Commissioner
Thornton, the Court voted unanimously to authorize the
Purchasing Agent to advertise for the previously noted RFP and
bid.
The Court next considered renewal of bid #2002-013 (to be
renumbered Bid 2003-004R), Road Signs and Sign Posts for an
additional year at current prices. On motion by Commissioner
Cauley, seconded by Commissioner Tony Jones, the Court voted

unanimously to renew Bid #2002-013 for an additional year.
The next matter before the Court was the renewal of the
Maintenance Agreement with IKON for copier at the Brazos
Center. This is the third year State Contract Agreement at a
cost of $255.64. Term of the Agreement is October 25, 2002
through October 24, 2003. On motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously
•
to approve the renewal.
The Court next considered approval of a revised Mail
Processing Agreement with DeLucia Mail Service. This would be
for the period of one (1) year with an option to renew for
four (4) additional years. Cost to the County would be 5.7
cents per piece of first class mail. On motion by
Commissioner Tony Jones, seconded by Commissioner Cauley, the
Court voted unanimously to approve the revised Mail Processing
Agreement.
The Court next considered acceptance of Bryan Texas
•
Utility's cost estimate of $1,090.90 for relocation of power
poles on Edge School House road to accommodate the
reconstruction of a bridge. The site is located in Precinct
2. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to accept the

The Court next considered the request from Wellborn
Special Utility District to construct a road bore for water
line installation in the right-of-way of Stousland Road
approximately 0.25 mile south of Wade Road located in Precinct
1. The County Engineer stated that all appeared to be in
order and recommended approval. On motion by Commissioner
Tony Jones, seconded by Commissioner Cauley, the Court voted
• unanimously to approve the request from Wellborn Special
Utility District and authorized the installation. A copy of
the request is attached hereto.
On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to receive,
approve and order filed as submitted the Treasurer's report
for Quarter Ending September 30, 2002. A copy of which is
attached to and made a part of these minutes.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
• a) He has received several requests for used
Sheriff's Department vehicles. He will wait
until all vehicles are turned in before
making a decision.
b) He will set up a Workshop to discuss cell
phone usage and health insurance.

c) There has been an $800,000 over run on
health insurance that was funded from the
Fund Balance. We will need to discuss if
this is a loan, etc.
d) He received a report from the Auditor on
budget ending September 30, 2002.
e) Coca Cola Company wants to know if the
County is interested in buying their
building.
Commissioner Elect, Precinct 3, Kenny Mallard stated
that the Court should make employees aware that even
though they did not receive a raise, the County is
picking up the cost of Health Insurance.
Under citizen input and/or concerns the following spoke:

a. Demitrios Basdekas asked who is the third Party
Administrator for the health insurance. Ruth McLeod
explained it to him. He also commented on the
purchase of right-of-way saying that it was not
handled consistently. Some was handled in executive
session and some in open court. Commissioner Tony
Jones and the County Judge stated that they did not
remember any discussion of right-of-way in executive
session.
At 10:34 a.m. the County Judge announced the meeting closed
to the public so that the Court could meet in Closed Executive
Session to discuss the acquisition of real property as allowed
under Section 551.072 of the Texas Government Code.

At 10:59 a.m. the County Judge announced the meeting open to
the public and announced that no action would be taken on the
Closed Executive Session.

On this the 12th day of November 2002 at a regular meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on November 12, 2002 the Court heard and approved a
budget amendment for the 2002-2003 budget year for Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to meet
unusual and unforeseen conditions which could not be reasonably included
in the original budget adopted August 23, 2002 the following amendment(s)
to the original are hereby authorized, as described on the attached
page(s).

Exclusive discount rate of 45%, effective 1/1/03: St. Joseph's Hospital would be
the only hospital coveted in-network on our medical plan; or
~b Non-exclusive discount rate of 35%, effective 1/1/03: St. Joseph's Hospital,
and, The College Station Medical Center would be covered in network on our
medical plan.
Authorization to change benefits of the Brazos County group insurance coverage:
Medical Plan;
Prescription Plan; and
Monthly Medical Insurance Premiums for Dependent Coverage (employee paid)
Authorization to change Flexible Spending Account (FSA):
Effective 1/1/03, increase annual out-of-pocket medical, prescription, and dental
expenses from $3,000.00 to $4,000.00, due to increased medical and prescription
drug co-pays. The plan changes will result in additional out-of-pocket expenses
ptrtl~i~ for employees, which are eligible for the FSA Plan. Monthly premium increases

Re: Flexible Spending Account
It is recommended that the group medical plan benefits be changed due to the rising cost of
medical services, providers, and prescription drugs. If the changes are approved, this will result
in more out-of-pocket expenses for employees and their dependents.
It is suggested that the maximum out-of-pocket medical, dental, and prescription drug expenses
for the new Flex Plan year be increased from $3,000.00 to $4,000.00. This will assist the
employee by saving him/her tax dollars, and it will also assist the county, by decreasing the FICA
responsibility.
If approved the maximum Flex out-of-pocket amount of $4,000.00 for medical, dental, and
prescription drug expenses will be effective January 1, 2003.

Following are examples of the savings realized when pre-taxing the monthly premiums.
Pre-taxing means this deduction is taken from your gross pay, per pay period, before
taxes are deducted. The savings is estimated at 22.65%.
Spouse only premium: $250.70 full amount paid when not pre-taxed
Estimated savings when pre-taxed: -56.78
Estimated payment after savings deducted $193.91
Child(ren) only premium: $151.80 full amount paid when not pre-taxed
Estimated savings when pre-taxed; -34.38

This estimated savings also applies to the out-of-pocket medical, prescription drug, and
dental expenses. For example, if an employee expects to have a total estimated out-of-
pocket expense of $4,000.00, the estimated savings is $906.00 for the calendar year.
Remember, estimating your total out-of-pocket expenses, is very crucial. If your actual
expenses do not total your estimate, and you do not have receipts to verify your expenses,
you will loose the balance in your account. So be very careful, especially if you do not
completely understand how it works. If you have questions, please call the Personnel
Department.

MAIL PROCESSING AGREEMENT
This is an agreement between Brazos County and DeLucia Mail Service for the processing of first
class mail with postage affixed by the County.
DeLucia Mail Service agrees to pick up the mail from location specified by Brazos County Monday
through Friday except on postal holidays. The mail shall be transported to Houston by bonded
courier where a barcode is applied and the mail processed and dispersed.
DeLucia Mail Service will charge 5.7 cents per piece of first class mail, which receives a discount.
Brazos County will apply postage of .301 cents per piece. The end cost for the County will be
.358 cents per piece, a savings of .012 cents per piece of first class mail.
Jury post cards will be processed at a charge of .01 cent per piece. a savings of .01 cent for the
County.
All other mail from the County will be handled at no charge.
Should DeLucia Mail Service have to apply postage due to an equipment failure, there will be a
surcharge equal to 10% of the postage used.
DeLucia Mail Service shall provide adequate documentation for all items presented for payment on
monthly invoices to Brazos County Auditor's office. This includes an accurate log of pieces
processed, and Postal Service receipts when vendor applies postage and surcharge is incurred.
Payment will be contingent upon submission of adequate documentation.
Effective date of this agreement shall be November 12, 2002, and shall continue in force for a
period of 12 months with an option for renewal for the next four (4) years.
It is understood and agreed that the continuation of this agreement for the services performed by
DeLucia Mail Service is contingent upon the satisfactory performance of such services. Brazos
County shall have the right to review and evaluate the performance of DeLucia Mail Service in the
furnishing of services required by this Agreement and shall notify vendor of any deficiencies in the
performancc of such services. In the event vendor shall fail to correct such deficiencies to the
satisfaction of Brazos County within thirty (30) days of receipt by vendor of such notice, Brazos
County shall have the right, without further notice, to terminate this agreement.
