To make arrangements, call (979) 361-4102. 0 COMMISSIONERS' COURT REGULAR MEETING NOVEMBER 5, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, November 5, 2002, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct l; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Tony Jones gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #02/03-6.1, which would reallocate funds for Constable, Precinct 4. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20036261 through 20036406 Vol 3 9 Page Co 4 l~ u Commissioners Court meeting November 5, 2002 2 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court proceeded to set the holidays to be observed by Brazos County for 2003: • January 1, 2003 January 20 April 18 May 26 July 4 September 1 November 27-28 December 24-26 January 1, 2004 The Court next New Year's Day Martin Luther King Birthday Good Friday Memorial Day Independence Day Labor Day Thanksgiving Christmas New Year's Day considered adopting an Order for Cremation. Mr. Mario Alberto Cazares died on October 26, 2002 with no family member with financial resources to take possession of the body. Pursuant to Section 694.002 Texas Health and Safety Code and on motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to release the body to Callaway-Jones Funeral Home Vol 38 Page U Commissioners' Court meeting November 5, 2002 3 for cremation. The expenses for said cremation will not exceed $600. The next matter for consideration was adopting a policy allowing the County Judge or one Commissioner to sign orders for the burial or cremation for deceased that are determined to be indigent. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to adopt a policy allowing the County Judge or one Commissioner to sign orders for the burial or cremation for deceased that are determined to be indigent. The Court next considered approval of a contract with DeLucia Mail Service for the processing of first class mail. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the contract with DeLucia Mail Service for the processing of first class mail. A copy is attached. The Court next considered entering into agreement with IBM for software support for Universe database software /lawk-, licenses for the period of July 1, 2002 through June 30, 2003. The cost to Brazos County will be $12,240.00. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to enter into agreement with IBM Vol 2 9 Page • Commissioners' Court meeting November 5, 2002 4 and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached. he next matter before the Court was a request to renew the West group CD-ROM Law Library subscription service for fiscal year 2003. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve • the request. The Court next considered authorization for acceptance of donated property consisting of a System 7 with Overhead Console Texas Version Serial Distribution 090933, 090934, and 090935 to the office of Constable, Precinct 1. On motion by the County Jude, seconded by Commissioner Thornton, the Court voted unanimously to table consideration pending more information. On motion by Commissioner Thornton, seconded by • Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed for undivided 66.67% interest to the following individual: Curtis Capps - Lots 7, Block S, Washington Heights Addition, City of Bryan, Brazos County, Texas. Vol ~ f Page (Q I 0 Commissioners' Court meeting November 5, 2002 5 The Court proceeded to consider the following blanket Purchase Orders: IOS Capital District Clerk $6,245 On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered approving a requisition to HGAC for two (2) utility tractors and two (2) rotary cutters for the Road & Bridge Department. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition in the amount of $71,165.96. The Court proceeded to consider approval of another requisition. This one is to Houston Trane for Centrifugal Chiller System for Building Maintenance. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the requisition in the amount of $5,200.00. The Court next considered establishing a date and time for a public hearing to discuss the posting of speed limits on I&GN Road, located in Precinct 1. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to hold a public hearing on Tuesday, November 19, 2002 beginning at 10:30 a.m. • Commissioners' Court meeting November 5, 2002 6 The next matter before the Court was the acceptance of Wixon Oaks Drive and Silver Oak Drive and drainage structures in Wixon Oaks Subdivision for Brazos County maintenance. The site is located in Precinct 2. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to accept Wixon Oaks Drive and Silver Oak Drive and drainage structures in Wixon Oaks Subdivision for Brazos County maintenance. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Frank Hernandez on Pleasant Hill Road in Precinct 4 to clean fence line of brush and over-hanging limbs for site distance. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the work. The Court next heard a presentation of the quarterly delinquent tax report presented by Shelburne Veselka, representative of McCreary, Veselka, Bragg & Alen, P.C. Attorneys at Law. Vol 38 Page P;70 • Commissioners' Court meeting November 5, 2002 8 Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) A study conducted by Dean International was sent around to the Commissioners asking us to join the Texas Rail Coalition. The fee is based on population for a one year period. He will have someone make a presentation to the Court before deciding on joining or not. • b) He received request from Justices of the Peace Precincts 1, 2 Place 2 and 3 to go back on the Oasis system. Commissioner Cauley pointed out that this request had been denied by the Software Committee. c) The Brazos Valley Council of Government is asking if we want to participate in the legislative update costing $911.00 to participate. He will put this on a future agenda for consideration. d) Brazos County along with sixty (60) other counties is being sued over the collection of the Justice of the Peace Technology fee. e) He received a document from the CUC stating that the Commissioners Court could not set different reimbursement rates for grand jury members. He will • talk with the Auditor to make sure we are in compliance. f) Twin City Endowment Inc., represented by Mervin Peters has provided the Court with a copy of the minor changes in their bylaws. Vol Page 1 40 Commissioners' Court meeting November 5, 2002 9 Under citizen input and/or concerns, the following spoke: a) The Sheriff announced that the County had met the United Way goal of $15,000. b) DeMerle Giordano, Emergency Management Coordinator reported that because of all the rain, they had been very busy with wrecks and flooding. Or both can be let at the same time should all components be in place. If this is acceptable I will forward a contract for procurement that will contain a payment schedule and a desigdreview schedule that will contain intermediate submissions at 25% and 75% completion for your review and commenting. The design timeline from mobilization to plan approval should encompass approximately 3 Vz months. An October i, 2002 start time will work well with my schedule.
