Id COMMISSIONERS' COURT REGULAR MEETING OCTOBER 29, 2002 A regular meeting of the Commissioners' Court of Brazos • County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, October 29, 2002, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. Under citizen input/and or concerns the following people spoke: George Englebrewster - spoke about the septic system on his property. Commissioner Tony Jones • suggested that he speak with the Road & Bridge Department. Tommy Lyons, candidate for County Judge - addressed the county debt issue. The Court heard a presentation and considered approval of the candidate for the County Extension Agent, 4-H and Youth Development position. C. On motion by the County Judge, seconded by Commissioners Tony Jones, Thornton, C. B. Jones and Cauley, the Court voted unanimously to approve the candidate for the County Extension Agent, 4-H and Youth Development position. The members of the Court welcomed Mr. Gregson to Brazos County. The Court next considered Budget Amendment #01/02-45.1 through 45.9, which would transfer funds to Purchasing, i Justice of the Peace, Precinct 4, Juvenile Services, Treasurer, District Clerk, Constable, Precinct 1 and Health and Life Insurance Fund from Contingency, adjust the budget for the Dispute Resolution Center and correct a posting error to the Narcotic Task Force Grant. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered Budget Amendment #02/03-5.1 through 5.4, which reallocate funds for the Magistrate, Constable, Precinct 2, Constable, Precinct 1 and Constable, Precinct 3. Commissioner Cauley moved to approve as submitted. Commissioner Thornton seconded the motion. Commissioners Tony Jones, Thornton, C. B. Jones and Cauley voted "Aye". The County Judge voted "No". Vol 3K Page a- ~J Commissioners' Court meeting October 29, 2002 3 The Court next considered the following Claims as submitted by the County Treasurer for payment: 20035962 through 20036260 On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. • The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. Commissioner Cauley moved to approve as submitted. Commissioner Thornton seconded the motion. Commissioners Tony Jones, Thornton, C. B. Jones and Cauley voted "Aye". The County Judge voted "No". The motion carried. The next matter for the Court's consideration was the adoption of a Resolution requesting the State Legislature to limit the ability of a Higher Education Authority to obtain property tax exemption. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to entreat the Legislature of the State of Texas • to limit the ability of a Higher Education Authority to obtain property tax exemption to a property within the boundaries of the enabling City or require some form of "payment in lieu" of property taxes to each entity that would otherwise receive tax revenue from the property. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to renew the current contract with ChoicePoint Business and Government Services, Inc. A copy is attached. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to appoint the following persons as presiding judge and alternate judge for the current voting year at the following voting precincts: Pct Election Judge Alternate Judge 7ab Gladys Dominik (R) 8 Slade Burkeen (R) 10ab Noreen Johnson (D) 36 Lola Peterson (R) 62 Virgle Hare (D) Central Count Tabulation Manager M. J. Deen The next matter for consideration was authorizing Don Gray and Associates to assist with the preparation of an RFP for the Group Medical Insurance Plan. On motion by Commissioner Tony Jones, seconded by Commissioners Thornton and Cauley, the Court voted unanimously to authorize Don Gray and Associates to assist with the preparation of an RFP for the Group Medical Insurance Plan. Mann for military service credit with the Texas County & District Retirement System. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the application of James M. Mann for military service credit and forward the application to the Texas County and District Retirement System. • The Court next considered authorization for acceptance of donated property by the Sheriff's Office, Criminal Investigation Division. The Brazos County Sheriff's Citizen Academy Alumni would like to donate a Nikon 4500 digital camera with an estimated value of $1,100.00. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to accept the donated property. The Court next considered authorization for acceptance of donated property by the Sheriff's Office, Jail Division. The College Station Bank of America would like to donate five (5) desks with an estimated value of $500.00. On motion by • Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to accept the donated property. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2003-011, Dump Truck, 15-16 yards. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize Vol 312 Page j s 40 Commissioners' Court meeting October 29, 2002 6 the Purchasing Agent to advertise for bids for a dump truck. The Court next considered approval of the Final Plat of Rock Prairie West Business Park Phase I, 46.17 Acres in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Final Plat of Rock Prairie West Business Park Phase I, 46.17 Acres as submitted. Vol 39 Page 1( ~J Commissioners' Court meeting October 29, 2002 7 The Court next considered approval of the minutes of the Commissioners' Court meetings held in August and September 2002 on the following dates: Regular Meetings - August 6th, 13th, 20th, 27th September 3rd, 10th , 24th Special Meeting - August 23rd Public Hearing - August 23rd Workshop - September 24th On motion by Commissioner Cauley, seconded by Commissioner • C. B. Jones, the Court voted unanimously to approve the minutes as submitted. The Court next considered adopting an Order Authorizing the Issuance of Brazos County, Texas Certificates of Obligation, Series 2002 and other matters related thereto. Demetrios Basdekas, citizen, said this was done to avoid tax increase and that it was not appropriate. It will cost the county more because the county will have to pay interest. He said that this smelled. Tommy Lyons, candidate for County Judge asked when the County had started borrowing money rather than paying as it went along. On motion by Commissioner Tony • Jones, seconded by Commissioner Thornton, the Court voted unanimously to adopt an Order Authorizing the Issuance of Brazos County, Texas Certificates of Obligation, Series 2002 and other matters related thereto. The Court voted acknowledged receipt of and ordered filed Vol 3'S Page 1-3 U Commissioners' Court meeting October 29, 2002 8 as submitted the Treasurer's Quarter Ending September 30, 2002 Investment Report. A copy of which is attached to and made a part of these minutes. The Court acknowledged receipt of the Extension Service reports for September 2002 and acknowledged receipt of reports from the following County and Precinct Offices showing revenues collected and remitted to the County Treasurer: County Clerk Justice of the Peace Precinct 2, Place 1 Justice of the Peace Precinct 2, Place 2 Justice of the Peace Precinct 4 Constable Precinct 1 Constable Precinct 2 Constable Precinct 3 Constable Precinct 4 Brazos County Events Facilities Road & Bridge Sheriff A copy of the Officials' reports can be viewed in the County Auditor's office. The County Judge skipped Item 22 and proceeded to consider agenda item number 23, the report from the Steering Committee for Justice Systems. Commissioner Jones handed out a summary of the discussion that was held during the meeting on October 22, 2002 with the Justices of the Peace, representatives from various county departments, the Information Technology Department and the Software Group Project Manager. A copy of which is attached. Vol 39 Page I~ • Commissiouers' Court meeting October 29, 2002 9 Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He told the Court that the Coca Cola building was for sale and asked if the Court was interested in entering into negotiations for the property. b) He has received some options on how to fund the health insurance. • c) He has the proposed holiday schedule for the Court's review. d) He expressed concern over utilization of cell phones and the need to address the issue in a Workshop session. e) The Auditor's office has been recognized by the Government Finance Officer Association for it's reports and audits. He congratulated the Auditor. f) The estimated cost to fix the detention pond is $38,000.00. We need to determine what fund this will come from. g) He received a request for vehicles that have been turned in from the Sheriff's Office. He will consider these requests after all the vehicles are turned in. The Sheriff made the following announcement: • He informed those in attendance that the United Way fund Drive would end on Wednesday. Paul Martin, Bond Attorney, announced that they had taken eight (8) bids so far this morning on the Certificates of Obligation. At 9:55 a.m. the County Judge recessed the meeting for five (5) minutes while Bill Newman gathered Vol 3~e- Page l • Commissioners' Court meeting October 29, 2002 10 information for his pricing report. At 10:00 a.m. the County Judge reconvened the meeting and Bill Newman announced that they had taken a total of nine (9) bids and he then presented his pricing report. He told the Court that 3.36 was the best bid received, showing that the County's AA rating was reflective of its outstanding financial standing. Then on motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to accept the bids received on the Certificates of Obligation. There was no citizen input and/or concerns. There being no further business to come before the Court, the meeting was adjourned. The Higher Education Authority (HEA) is an entity formed by a City for the purpose of acquiring housing to be used exclusively for students and/or employees of institutions of higher education. The property does not have to be located within the boundaries of the City seeking the exemption. WHEREAS, Section §53.46 of the Texas Education Code grants a Higher Education Authority exemption from all taxes. This statute also gives the HEA the authority to issue tax exempt debt, i.e., municipal bonds. Therefore, their borrowing cost is lower than that for a similar private sector financing. WHEREAS, The school funding system in Texas is largely dependent on the local property taxes that are levied on taxable property. Any reduction in the value of local taxable property reduces the amount of funding available for the operation of Texas school districts. After a one year time lag, the State of Texas is then required to provide additional funding to make up the shortfall resulting from these exemptions. WHEREAS, The Cities where such property is located are required to provide police, fire, infrastructure, utility and other services to these properties. However, a City where such • property is located will receive no tax revenue from these properties. WHEREAS, County government services are also provided to these properties and their residents with no tax revenue from them to the County Government. WHEREAS, Because the State of Texas makes up the shortfall to Texas school districts after a one year lag time, these exemptions constitute a granting of State funds without action by the Legislature. A City has the authority to grant State funds by causing the increase in State funding required for Texas school districts. WHEREAS, The exemption makes it a very favorable investment for a City as compared to a private sector investment in an apartment complex. The HEA can finance the acquisition of the property with tax exempt bond proceeds, resulting in lower interest rates. In addition, their ji x 0 operating expenses are lower because they pay no ad valorem taxes. The private sector property owner is paying higher interest rates on the acquisition costs and also paying property taxes annually. Yet, the rental income market is the same for both. THEREFORE, BE IT RESOLVED that the Commissioners Court of Brazos County, Texas does hereby entreat the Legislature of the State of Texas to: • Limit the ability of a Higher Education Authority to obtain property tax exemption to a property within the boundaries of the enabling City - Or • Require some form of "payment in lieu" of property taxes to each entity that would otherwise receive tax revenue from the property. MISUSE OF SERVICES OR INFORMATION. Subscriber agrees to tales appropriate measures so as to protect against the =ususe of CPBG's Services. Subscdber agrees that CPBG may, if it is concerned about Subscriber's use, temporarily suspend Subscnber's access for up to tan (10) business days pending an investigation of use. Subscriber agrees to cooperate fully with any and all iavestlgations If misuse is confirmed through investigation. CPBG may rmmodiately terminate this Agreement 14. CHANGES IN USE OR ACCESS. CPBG may, at any time., Impose restrictions and/or prohibitions on the Subscriber's use of the Services at certain data. Subscriber undentards that such restrictions cc changes In access may be the result of a modification in CPBG POLICY, a modification of Third Party agmemenia, a modification in lniduatry standards, or a change in law cc regulation. Quarter Ending 09/30/2002 Investment Report • This report is made in accordance with provisions of Gov Code 2256, The Public Funds Investment Act, which requires quarterly reporting of investment transactions to the Commissioners' Court The Brazos County Investment portfolio earned an average yield of 1.8779% for the quarter ending 09/30/2002. Total investment interest deposited during the quarter was $124,584.34 producing a year-end total of $580,520.54. The average Earnings Credit Rate on checking account interest during the past quarter was 2 1466% netting $111,344.70 of interest earned generating the year-end total of $413,727 64. The total of all interest earned for the quarter was $235,929.04. The yearly total of investment and checking account interest combined was $994,248.18. In July 2001, Brazos County purchased a callable coupon note with the maturity date of July 2003 and a one-time call date of July 16, 2002. The Federal Reserve chose to use the call option in July; consequentially, all remaining funds invested for Brazos County are in TexPool. The weighted average maturity of the invested funds was 1 day due to the liquidity of funds invested with TexPool. Brazos County had an investment cost of $17,394,960.21 that carried a book value of the same because all invested funds with TexPool carry a net asset value of $1.00. The October 2002 TexPool Newsletter provided the 09/30/2002 ending market value of $17,407,484.58. The Brazos County Investment portfolio stated an unrealized gain of $12,524.37 as of quarter end. Commercial Paper uncertainties, yields on Agency Discount notes falling below Fed funds rates and even the 2-year Treasury dropping to 1.72% at one point have all contributed to the lack of investment opportunities in today's market. In July, when the Federal Reserve opted to call in the only FNMA note left in the investment portfolio, Brazos County joined many other counties and investing entities that have all of their portfolios invested in one form of a pool or another, The current Earnings Credit Rate with the County depository bank is 50 basis points above the 3- month Treasury and is 102% collateralized providing a safe and liquid port for funds that normally would be invested. Money Market Mutual Funds, an approved investment option, may provide another tool to be utilized in the future.
