To make arrangements, call (979) 361-4102. • COMMISSIONERS' COURT REGULAR MEETING AUGUST 20, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 20, 2002, with the following members of the Court present: • Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Tony Jones gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The Court first considered a request by the 272nd District Court for additional funding. On motion by the County Judge, • seconded by Commissioner Tony Jones, the Court voted unanimously to transfer $2,000 in additional funds to allow for the payment of a visiting court reporter. The Court next considered Budget Amendment #01/02-37.1 through 37.3, which would transfer funds to the Sheriff's Vol 3`f Page 1 53 U Commissioners' Court meeting August 20, 2002 2 Department Administration from the Jail Administration, transfer funds from Contingency to the 272nd District Court and provide funds for the first three months of the Juvenile Accountability Grant. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20033761 through 20033954 On motion by Commissioner Tony Jones, seconded by commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The Court next considered adopting a Resolution authorizing the submission of a Texas Community Development Program application to the Texas Office of rural Community affairs for the Community Development Fund, and authorizing the County Judge to act as the County's Executive Officer and Vol 34 Page IS4 • Commissioners' Court meeting August 20, 2002 3 authorized representative in all matter pertaining to the County's participation in the Community Development Program. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to adopt the resolution authorizing the submission of a Texas Community Development Program application and authorized the County Judge to act as the County's Executive Officer. This application is for a • grant to provide first time sewer collection service to the residents on W. 28`h Street in Bryan. The next matter before the Court was consideration of the recommendations of the Salary Grievance Committee if required. Commissioner Thornton moved to reject the recommendation of the Committee and deny the raise for Constable, Precinct 1. The motion was seconded by Commissioner Tony Jones. Commissioners Tony Jones, Thornton, C. B. Jones and the County Judge voted "Aye". Commissioner Cauley voted "No". Commissioner Tony Jones stated that the Court had worked too hard to get the salaries consistent. Had this been across the • board for all the Constables then he might have considered it. The motion carried. The next matter for the Court's consideration was the Contract with Texas A&M University for Psychological Evaluations of Deputy Sheriff and Detention officer Applicants. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve 40 Commissioners' Court meeting August 20, 2002 4 the contract. Cost to the County will be $200 per evaluation. Term of the contract will be from October 1, 2002 through September 30, 2003. A copy is attached. On motion by the County Judge, seconded by Commissioner Tony Jones, the Court voted unanimously to remove the following Tax Resale Deeds from the agenda: a) Sharon A. Lewis - Lot 20, Block 1, James Addition, City of Bryan, Brazos County, Texas b) Sharon A. Lewis - Lot 21, Block 1, James Addition, City of Bryan, Brazos County, Texas The next matter for consideration was approval of the recommendation by a consultant for a communications system for the offices of the Justices of the Peace, Precincts 1 and 3. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to remove from the agenda until the relevant information is received. The Court proceeded to consider a request by the Information Technology Department for the acquisition of communications hardware for the offices of Justice of the Peace, Precincts 1 and 3. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to remove this item from the agenda. The next matter for consideration was a request by the Purchasing Department to cancel RFP #2002-059, Underground Storage Liability Insurance. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the proposal. An engineering fee of $21,500 will be required and should oversize participation be • required, then a fee of $3,500 would also be required. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He asked the Commissioners to remain after Court to sign several resolutions fo the North Girls Little League Team. Fees and Reimbursement The County agrees to pay and TAMU agrees to accept, as fill compensation, the sum of $200.00 per psychological evaluation. Payment will be based on the timely submission of evaluation reports for the time period during which the referral for evaluation was made. Evaluation Reports TAMU, prior to receiving reimbursement under this Agreement, agrees to provide the County with a copy of psychological evaluation reports generated on persons served under this Agreement. Financial Statements for Services Rendered TAMU will provide the County a Snancial statement by the 1 Oth day of each month for services rendered during the previous month. The County agrees to pay TAMU for services by the 8th working day of the month following receipt of the financial statement. This contract maybe subject to termination with 30- datys notice for lack of timely reimbursement. Early Termination This Agreement may be canceled upon 30 days written notice by either party. Professional Uability and Credentials Professional liability insurance provided to faculty supervisors and graduate students in clinical psychology through the Department of Psychology will cover services provided through this Agreement. TAMU agrees to provide the County, if requested, with a copy of current professional credentials and professional liability insurance applicable to acts, omissions, or negligence in the course of performing services under this Agreement. TAMU will not be held liable for information communicated in evaluation reports that may result in a decision to dismiss or fail to hire an applicant. TAMU will not be held liable for misconduct, poor fob performance, or poor judgements made by officers following an evaluation TAMU completes. • Additional Professional Issues Students and faculty supervisors appointed by TAW agree to comply with policies established by the TAMU Psychology Clinic regarding code of ethics, confidentiality, and other issues relevant to provision of consultative clinical services. This contract in no way obligates the County to rely exclusively on TAMU for the services described in this contract. Renewals Pending authorization from both the County and TAMU, this agreement may be renegotiated for a specified period beginning October 1, 2003. Renewals of this agreement may include an annual increase for services rendered. Other Direct Costs Regarding other direct costs, the County will pay the amount per completed evaluation specified in the preceding section entitled "Fees and Reimbursement"; the number of evaluations will vary over the months in which this contract is in effect.
