To make arrangements, call (979) 361-4102. 0 /0"kCOMMISSIONERS' COURT REGULAR MEETING AUGUST 6, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 6, 2002, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment ##01/02-35.1, which would reallocate funds for Constable, Precinct 4. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20033255 through 20033482 Vol Page °10 • Commissioners' Court meeting August 6, 2002 2 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. . The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. The Court next considered establishing the date and time for a public hearing regarding the proposed budget for Fiscal year 2003 and tax increase if necessary. Mr. Frank Thurmond asked the Court to look carefully at the budget and to hold the line on the tax rate. He said he supported the tax exemption for those over age 65, and if necessary to reduce the salary of the commissioners if a tax increase is required. On motion by the County Judge, seconded by Commissioner C. B. Jones, the Court voted unanimously to set 9:00 a.m. on August 23, 2002 as the time and date of the budget hearing. The • hearing will be held in the 3615` District Courtroom. Elected officials will get five (5) minutes each to speak and citizens will be given three (3) minutes each. The next matter for consideration was increasing the personal property tax exemption for persons over 65 years of age from $50,000 to $75,000 per year effective for the 2003 Vol 13q Page -21 0 Commissioners' Court meeting August 6, 2002 tax year. The following individual spoke on the topic: Roy Flores, told the Court that this sounded good but would only affect 4,000 people who live in homes over $75,000. Those people can pay the additional amount. He asked where the county will make up for the short fall of funds caused by this exemption. He asked the Court to give more attention to this before voting on the matter. Demetrios Basdekas said the property valuation had gone up 1009. this year. He disagreed with Mr. Flores statement. He said he supported the over 65 exemption. 3 On motion by the County Judge, seconded by Commissioner C. B. Jones, the Court voted unanimously to approve the over 65 exemption and that it be effective for the 2003 tax year. The Court next considered approval of the 2003 options for the County Retirement Plan. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to make no changes to the County Retirement Plan. The Court proceeded to consider an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024 (a) (a) (4) . The Commissioners' Court determined that Managed Network Solutions was a single source supplier for Network cabling and data communications. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for all professional services from the designated vendor for Vol 3y Page 10, Commissioners' Court meeting August 6, 2002 4 the 2001-2002 fiscal year. The next matter for consideration was approval for the Purchasing Agent to advertise Request for Proposal (RFP) #2002-059, Underground Storage Liability Insurance. On motion by Commissioner Thornton, seconded by Commissioner C. B. Jones, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for Underground Storage Liability • Insurance coverage. The Court next considered approval of a Maintenance Agreement with IKON for the County Judge's copier. This is the second year State Contract Maintenance Agreement. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Maintenance Agreement at a cost of $196.64 covering the period of August 25, 2002 through August 24, 2003. The next matter before the Court was the approval of a requisition for a copier for the Purchasing Department utilizing Capital Improvement-Equipment funds. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition in the amount of $6,706.18. The Court next considered an extension and renewal of Elevator Maintenance Agreement with Kone, Inc. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Vol 3~ Page `73 • rw'L',, Commissioners' Court meeting August 6, 2002 5 Court voted unanimously to extend the agreement through September 30, 2002 so that the contract period runs concurrent with the County fiscal year and renew the contract for an additional year beginning October 1, 2002 through September 30, 2003. The Court next considered a request by the Information Technology Department to purchase communications hardware for the offices of the Justice of the Peace, Precinct 1 and Justice of the Peace, Precinct 3. Commissioner Cauley moved to approve. Commissioner Tony Jones seconded the motion. Commissioner C. B. Jones asked for an explanation as to why the IT department wanted to spend $60,000. After some discussion, Commissioners Cauley and Tony Jones withdrew their motion and second. Then on motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to table consideration. The Court considered another request by the Information Technology Department. This was for authorization to upgrade the network cabling in the office of the Justice of the Peace, Precinct 3. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the request. Vol 3q Page '-7 • Commissioners' Court meeting August 6, 2002 6 The Court next considered the request from Sprint/United Telephone Company to construct a road bore and buried cable installation in the right-of-way of McCrory Road and Robertson Road in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Sprint/United Telephone Company and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Final Plat of JMM Subdivision, 1.624 acres, One Lot, One Block in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the final plat of the JMM Subdivision as submitted. The Court next considered approval of the Final Plat of The Fields of Runnymede, Lots 1-5, Block One, 5.593 Acres in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner C. B. Jones, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the final plat of The Fields of Runnymede, Lots 1-5, Block One, 5.593 Acres as submitted Vol 35 Page 7s 0 Commissioners' Court meeting August 6, 2002 7 The Court next considered acceptance of a warranty Deed for right-of-way on Lometa Lane in Precinct 1. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Lynn Elliott and wife Marsha Elliott for the expansion and improvements to Lometa Lane. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for June 2002 and the Quarter Ending June 30, 2002 Report. A copy of each is attached to and made a part of these minutes. The Court next held a discussion of funding for Emergency Medical Services. Commissioner Tony Jones informed the Court that he met with the City of College Station to secure an agreement for services. The City wants the County to pay 10% of their budget which is $190.000 per year plus assume some of the liability for services. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He, the Architect and Engineer on the Exposition Center met with the City of Bryan for support of the Exposition Center and help with utilities on the west side of Bryan. Vol 314 Page L • Commissioners' Court meeting August 6, 2002 b) He presented his budget for the 2002-2003 budget year which included the following: r~ 1) Reduce tax rate from .42 to .4044 per $100 evaluation 2) No across the board salary increase 3) 20 merit increase 4) Very few new positions created 5) Line item requests reduced 6) Conference and Seminar fees reduced 7) Health insurance increase may require employees to pay a portion of their coverage 8) Increase in family coverage 9) Increase in some elected official's salaries a) Sheriff $3,302 increase b) Justices of the Peace $1,118 increase c) County Judge $8,435 increase 8 Under citizen input and/or concerns, the following spoke: Karen Hall, referred to agenda item 6, establishing the date and time for a public hearing regarding the proposed budget for Fiscal year 2003 and tax increase if necessary. She asked if this could be scheduled at a later time. She said that the Court did hold the Exposition Center meetings at night. She asked the Court to set a more favorable time. There was no requirement to convene into Executive Session. There being no further business to come before the Court, • the meeting was adjourned. UNIMPROVED ROADS (dirt) - Same as improved, unless because of ditches, trees and other terrain features, it is more practical to plow in the center of the road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30" except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36". The following are requirements which are made on the contractor: 1. The plowing equipment shall be subject to the approval of the - Engineer and the Public Authorities having jurisdiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be immediately repaired to the satisfaction of the Engineer and Public Authorities having jurisdiction over highway and road right-of- way where involved. 4. Trenches shall be promptly back-filled with earth, and mechanically tamped at six (6) Inch lifts so that the earth is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight. 5. The County Commissioners Court may require the owners to relocate this line, for valid reasons under the law, by giving thirty (30) days written notice. a. Where communication facilities are located on county road ROW the Telephone Company will relocate said facilities at no expense to the County. b. Where communication facilities are located on private property the county will reimburse the Telephone Company for the relocation of said facilities. At any place where a communications line crosses over a county road, it shall be constructed and maintained at least eighteen (18) feet above • the surface of the traffic lane. Please notify forty-eight (48) hours prior to starting construction of the line, in order that a representative may be present. The locations of the proposed lines are more fully shown by the copies attached to this notice. Construction of this line will begin on or after the 5th day of August , 2002.
