To make arrangements, call (979) 361-4102. u COMMISSIONERS' COURT REGULAR MEETING JULY 30, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 30, 2002, with the following members of the Court present: • Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner C. B. Jones gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #01/02-34.1 through 34.3, which would transfer funds to Community • Supervision, and reallocate funds for the District Clerk, and 3615` District Court. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to approve the budget amendment as submitted with the exception of amendment 34.2 which was decreased from $1,000.00 to $675.00. A copy is attached. Vol 34 Page 4-3 L Commissioners' Court meeting July 30, 2002 2 The Court next considered the following Claims as submitted by the County Treasurer for payment: 20032304 through 20032307 and 20033049 through 20033254 On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The next matter before the Court was the County's response to TNRCC's proposed rule regarding On-Site Sewage Facilities. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to forward a letter the TNRCC expressing the County's opposition to the proposed On-Site Sewage Facilities charge back fee rules. The Court next considered approval of an Application for Authority to Appoint Employees and Resolution granting authority to appoint employees for the County Tax Assessor- Collector's Office. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously Vol 3,q Page 4-q- J Commissioners' Court meeting July 30, 2002 3 to approve the Application for Authority to Appoint Employees and Resolution granting authority to appoint employees for the County Tax Assessor-Collector's Office. . The next matter for consideration was a refund of taxes to the Marden Family Trust resulting from an Appraisal Review Board adjustment. The property was incorrectly sited as being within the limits of the City of Kurten. On motion by • Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to refund the Marden Family Trust $280.67 in county taxes. The Court next considered the 2003 Plan Options for the county retirement plan. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to remove this item from the agenda to allow the insurance committee time to review the options. The next matter for consideration was the cancellation of the September 17, 2002 Commissioners Court meeting. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the • Court voted unanimously to cancel the meeting to allow the Commissioners to attend the South Texas Conference. The next matter for consideration was approval for the Purchasing Agent to advertise Request for Proposal (RFP's) 2002-056, Legal Representation to Indigent Juveniles. Lane Vol 3q Page 45 40 Commissioners' Court meeting July 30, 2002 4 Thibodeaux, announced that he, Patricia Bonilla Harrison and Patrick Gendron had decided because of the controversy surrounding this issue, they voice their support for soliciting RFP's. He felt their qualifications would hold up against any other firm. The County Judge pointed out that an RFP is not a bidding process but a way to look at a company's qualification, etc. He said that he is satisfied that we are in compliance with statues. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Purchasing Agent to advertise for RFP's for Legal Representation to Indigent Juveniles. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2002-058 Oil Change Annual Contract. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for oil changes. The Court next considered approval of a requisition for a van cell for the Sheriff's Office utilizing departmental "Equipment-Other" funds. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the requisition in the amount of $5,500.00. On motion by Commissioner C. B. Jones, seconded by Commissioner Thornton, the Court voted unanimously to accept BTU's cost estimate of $1,349.81 for relocation of an electrical distribution pole on Nunn Jones Road. Attorneys at Law. Vol 34 Page 4-77 0 Commissioners' Court meeting July 30, 2002 6 Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He asked DeMerle Giordano to tell the Court what the current KBI# was. She stated that she did not have the current figure but could tell the Court that no grass fires had been reported. The County Judge asked her to give the Court the figure as soon as possible. Under citizen input and/or concerns, the follwoing individuals spoke: a) J. D. Langely, Judge of the 85''x' District Court announced that Dana Zachary, the new Magistrate, had just had a baby girl. The baby weighed 7lbs 9 oz. and that mother and child were doing well. b) Judge Langely said he would like a facility for the Magistrate on the next Commissioners Court agenda. c) The County Judge asked for some recommendations on a facility. At 9:26 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss the acquisition of real property as allowed under Section 551.072 of the Texas Government Code. At 10:00 a.m. the County Judge announced the meeting open to the public. Commissioner Tony Jones moved to negotiate contract with Jim Woods and Jeff McDowell in reference to leasing a site for the office of Justice of the Peace, Precinct 1 located on Wellborn Road, just south of Rock Vol 34 Page 49 • Commissioners' Court meeting July 30, 2002 7 Prairie Road. Commissioner Cauley seconded the motion. Commissioners Tony Jones, Thornton, and Cauley voted "Aye". The County Judge voted "No". Commissioner C. B. Jones abstained. The motion carried. Box 13087 Austin, Texas 78753 RE: On-Site Sewage Facilities Dear Gentlemen and Madam: The purpose of this letter is to express the opposition of Brazos County, Texas to the proposed On-Site Sewage Facilities charge back fee rules (Log No. 2001-100-285-WT). • Brazos County, Texas currently operates as a local agent under State law in administering the On-Site Sewage Regulations of the State of Texas. Brazos County has worked long and hard to establish a program in this county. It is, we believe, a model program and is serving the public well. However, the County is greatly concerned by the proposed rule of the TNRCC as it relates to "charge back fees". This proposal damages the cooperative relationship which Brazos County has worked so hard to establish with the TNRCC in administering this program. The prospect of suffering or being subject to charge back fees in the event Brazos County wishes to withdraw as a local agent for a material change to the program made by the TNRCC, "which may not necessarily require significant additional human resources or financial obligations of the County", is of great concern. The County and the TNRCC should be partners in developing and administering changes to this program. Brazos County has discussed the possibility of and will probably take official action in the month of August to withdraw as the local agent for this area before this change is enacted in order to avoid the unwarranted financial burden being placed on the County if it wishes to withdraw in the future for legitimate reasons. The County hopes to avoid such action as it is being asked to choose between the physical health and financial health of the County taxpayers.
