To make arrangements, call (979) 361-4102. 34 0 COMMISSIONERS' COURT REGULAR MEETING JULY 23, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 23, 2002, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Jones gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, the following people spoke in support of attorney Patrick Gendron and his associates and the quality of representation they provide to juvenile offenders.: Patrick Munoz April Tamez Kenneth Payne Randy Michel Tommy Ramirez Lane Thibodeaux The following spoke in support of advertising the RFP: Margaret Lalk Reva Corbett Vol 34 Page 9 C7 Commissioners' Court meeting July 23, 2002 2 The County Judge explained the conditions of the contract that allows for a one year renewal and that the year has nearly ended. A law suit could be filed against the county if we do not go out for RFP's. The Court proceeded to consider a request by the information Technology Department to purchase a laser printer for the Purchasing Department and the 3615t District Court • office utilizing Contingency - Printer Replacement funds. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the request. The Court next considered Budget Amendment #01/02-33.1 through 33.4, which would transfer funds to 361" District and Purchasing from Contingency, and reallocate funds for Constable, Precinct 1 and the District Attorney's office. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20032761 through 20033048 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the changes as submitted. The Court next considered a request from Constable Precinct 1, James Marrow, to appoint Michael R. Bewley as unpaid Reserve Deputy Constable. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Constable Marrow to appoint Michael R. Bewley as unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. The next matter for consideration was the adoption of a Resolution concerning Unclaimed Property Credits for Brazos County received by the State Comptroller's Office. on motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to adopt the Resolution claiming the County's portion of unclaimed funds under Texas Property Code 74.602 and requested the State Comptroller forward the funds to the Commissioners Court of Brazos County. The Court next considered approval of a lease agreement between Brazos County and Bryan Independent School District for rental of a portable classroom building for use by the Vol 3 Page IO • Commissioners' Court meeting July 23, 2002 4 juvenile justice program. Term of the lease is for the period of one year commencing on May 31, 2002 and ending on June 30, 2003. The County agrees to pay to Bryan Independent School District the amount of one dollar ($1.00). On motion by Commissioner C. B Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the lease agreement between Brazos County and Bryan Independent School District for the period stated above. A copy of the Lease Agreement is attached. The next matter before the Court was a request from the Community Supervision and Corrections Department to pay severance for eliminated FY03 positions. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from the agenda. The next matter for consideration was an application made by Richard F. Vance for military service credit with the Texas County & District Retirement System. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, • the Court voted unanimously to forward the application of Richard F. The Court next considered authorizing the Purchasing Department to advertise RFP #2002-056, Legal Representation for Indigent Juveniles. Commissioner Thornton moved to renew the contract through December then go out for RFP's. Commissioner Tony Jones seconded the motion. After some discussion, Commissioners Thornton and Tony Jones withdrew their motion and second. Then Commissioner Tony Jones moved to table consideration. Commissioner Cauley seconded the motion. Commissioners Tony Jones, Thornton and Cauley voted "Aye". Commissioner C. B. Jones voted "No". The County Judge abstained. The motion carried. This is being done in response to a request by the Maintenance Department that the contract run concurrent with our fiscal year. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to extend the contract with Steamatic through September 30, 2002. • The Court next considered the request from Verizon to construct 780 feet of buried cable installation in the right- of-way of Democrat Road to accommodate road improvements project. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the request from Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Re-Plat of Ravenwood Subdivision Lots 15A, 16 and 17, 8.7575 Acres in • Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the re-plat of Ravenwood Subdivision Lots 15A, 16 and 17, 8.7575 Acres as submitted Vol 34 Page 13 Commissioners' Court meeting July 23, 2002 7 The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Duane Peters on Democrat Road in Precinct 2 to dump excess dirt excavated from drainage channel on same property. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to authorize the work. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He said there was a need to look into options concerning utility providers to see if there could be any savings. • b) The Court may need to write a letter to Verizon to complain about the delay in service. c) The Commissioners Court meeting scheduled for September 17th will be canceled because of an out of town Commissioners, Conference. The September 3rd meeting might also be canceled. d) He will schedule a workshop to discuss requirements for on site sewage facilities. e) Kerbow Engineering has applied for a grant for the installation of a sewage system on West 28th Street. The City of Bryan will assist them. f) He received a memo from the County Clerk in reference to the voting machine demonstrations. He will post this as a workshop so that all the Commissioners • may attend. The re was no citizen input and/or concerns. This lease will become effective when adopted by the Brazos County Commissioners Court and extends through June 30, 2003. Terms of the lease are as follows: 1. The District will provide to the County a double portable classroom building of the District's choice, complete with AC units, skirting, access ramp, and blocks. The District will be responsible for all utility disconnects. The County agrees to accept the building as is, with all faults. 2. The County is responsible for moving the portable classroom building, by July 1, 2002, from its current location at 1918 N. Earl Rudder Freeway to the County site. The County is responsible for all fees, permits, licenses, and labor to move, set up and install. 3. Before the end of this lease, the County agrees to move the portable classroom building from the County site to a site to be determined by the District.
