attach the 10 ft. Public Utility Easement along the side and back roperty lines of the
Replat of Lot 15R, Ravenwood Subdivision. Site is located in Precinct 2.
22. The Amending Plat of Lots 5, 6 and 7, Block 1, Whitetail Run, 6.71 acres, Moses A.
Foster League. Site is located in Precinct 2.

23. Request from Verizon to construct 1,300 feet of buried cable installation in the right-
of-way of Enchanted Oaks Drive. Site is located in Precinct 3.
24. Request from Wellborn Special Utility District to construct a road bore/water line
installation in the right-of-way of Greens Prairie Road. Site is located in Precinct 1.
25. Convene into Executive Session pursuant to §551.072 of the Texas Government
Code to discuss the acquisition of real property.
26. Consider and take action on Executive Session.
27. Announcement of interest items and possible future agenda topics.

REGULAR MEETING
JULY 9, 2002
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, July 9, 2002, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding; 'look"
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2, Absent;
C. B. Jones, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input and/or concerns, the following people
spoke:
Dan Bates asked if anyone has done an investigative
report on the discussion last week concerning
"Corporate Welfare" (tax abatement) for Red Oak.
He said he should receive a tax break along with
every citizen just like Red Oak. "The County needs
to wake up," he claimed. He said he would keep
coming back each meeting until the Court "gets it
right."
The Court next heard a presentation by representatives of
Dean International, Inc. concerning the "Brazos Express" High

Speed Rail Corridor. James Massey, College Station City
Council member, introduced Stanford Lynch who made the
presentation. Mr. Lynch cited all the benefits including the
fact that 58 percent of the Brazos Express Corridor could be
built on existing right-of-way. Commissioner Cauley asked if
new rails would have to be constructed whereupon Mr. Lynch
said "yes." Demetrios Basdekas asked for consideration for
• the Defense Department' s use of the system to move troops from
Fort Hood to Florida. Mr. Lynch said the Defense Department
was aware of this. The County Judge thanked Mr. Lynch for the
presentation.
The Court next considered Budget Amendment #01/02-31.1
through 31.7, which would transfer funds to Non-Departmental,
Road & Bridge, Auditor and Jail Administration from
Contingency, and reallocate funds for Sheriff's Office and
Constable, Precinct 4. On motion by Commissioner Cauley,
seconded by Commissioner Tony Jones, the Court voted
unanimously to approve the budget amendment as submitted, a
• copy of which is attached hereto.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The next matter before the Court was' consideration of an
Order Prohibiting Outdoor Burning. The drought index currently
stands at 400 with a projection of rain. On motion by the
County Judge, seconded by Commissioner Cauley, the Court voted
unanimously to remove this item from the agenda.
The Court next considered ratifying the nomination by the
City of College Station of Lynn McIlhaney to fulfill her term
as a member of the Brazos Valley Council of Governments' Board
of Directors. On motion by Commissioner Tony Jones, seconded
by Commissioner Cauley, the Court voted unanimously to ratify
the nomination by the City of College Station of Lynn
McIlhaney to fulfill her term as a member of the Brazos valley
Council of Governments' Board of Directors.
The Court next considered an application for authority to
appoint employees and resolution granting authority to appoint
employees for the District Attorney's Office. On motion by

Commissioner Tony Jones, seconded by Commissioner Cauley, the
Court voted unanimously to approve the application and adopt
the resolution granting authority to appoint employees for the
District Attorney's Office.
The Court next considered an application for authority to
appoint employees and resolution granting authority to appoint
employees for the County Attorney's Office. On motion by

Court voted unanimously to approve the application and adopt
the resolution granting authority to appoint employees for the
County Attorney's Office.
The Court next considered an application for authority to
appoint deputies and resolution granting authority to appoint
employees for the Sheriff's Office. On motion by Commissioner
Tony Jones, seconded by Commissioner Cauley, the Court voted
unanimously to approve the application and adopt the
resolution granting authority to appoint deputies for the
Sheriff's Office.

The Court next considered an application for authority to
appoint reserve deputies and resolution granting authority to
appoint employees for the Sheriff's Office. On motion by
Commissioner Tony Jones, seconded by Commissioner Cauley, the
Court voted unanimously to approve the application and adopt

the resolution granting authority to appoint reserve deputies
for the Sheriff's Office.
The next matter for consideration by the Court was a
request submitted by Jim Locke, Judge, County Court at Law II
seeking approval for out of state travel for his Court
Coordinator, Tommy Munoz. Mr. Munoz would be traveling to
Savannah, Georgia to attend a "Managing Court Financial
Resources" seminar for three days in September 2002. On
motion by Commissioner Tony Jones, seconded by Commissioner
Cauley, the Court voted unanimously to grant the request from
the Judge Locke and approved payment of out of state travel
expense for Tommy Munoz.
The Court next considered a request from Constable
Precinct 3, Wayne Thompson, to appoint Dennis R. Crain as
unpaid Reserve Deputy Constable. On motion by Commissioner
Tony Jones, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request from Constable Thompson to
appoint Dennis R. Crain as unpaid Reserve Deputy Constable
subject to appointment being within the allotted number of
deputies.
On motion by Commissioner Cauley, seconded by
Commissioner Tony Jones, the Court voted unanimously to
authorize the County Judge to execute a Tax Resale Deed to the

following individual:
Richard Pena - 3.5 acres, more or less C it y of
Bryan, Brazos County, Texas.
The next matter for consideration was the amending of
policies and fees for the Brazos County Events Facilities. On
motion by Commissioner Tony Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes
made in the policies and fees for the Brazos County Events
• Facilities. A copy of the amended policies and fees is
attached.
The Court next considered a request for the purchase of
two (2) replacement Laser Printers for the Jail Administration
utilizing Non-Departmental Contingency - Printer Replacement
Funds. On motion by Commissioner Cauley, seconded by
Commissioner Tony Jones, the Court voted unanimously to
approve the purchase of two (2) replacement Laser Printers.

The Court next considered acceptance of a Warranty Deed
for right-of-way on Nunn Jones Road in Precinct 3. On motion
by Commissioner C. B. Jones, seconded by Commissioner Tony
Jones, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from the Walker Family Partnership for the expansion and
improvements to Nunn Jones Road.
The Court next considered a request from Brazos Electric
Cooperative for variance to plat a 0.249 acre tract and not be
required to dedicate the normal setbacks and utility easement.
The site is located in Precinct 2. On motion by the County
Judge, seconded by Commissioner Cauley, the Court voted
unanimously to table consideration to allow time to gather
further information.
The Court next considered a request from Carlomagno
Surveying, Inc. for variance from the Brazos County
Subdivision and Development Regulations, to not be required to
plat and attach the 10 feet Public Utility Easement along the
side and back property lines of the Replat of Lot 15R. The
site is located in Precinct 2. On motion by the County Judge,
seconded by Commissioner Tony Jones, the Court voted
unanimously to approve the request for variance.

The Court next considered approval of the Amending Plat
of Lots 5,6 and 7, Block 1, Whitetail Subdivision in Precinct
2. Richard Vance, County Engineer, stated that he had
reviewed the plat and offered the following comments:
1) The water line along the northwest public
utility easement was sleeved (as required) as it
went under the original location of Buckhorn Drive;
however, it is not sleeved at the proposed re-plat
location of Buckhorn Drive. Developer is
submitting a letter stating it will be sleeved.
• Recommended approval of this re-plat with the
understanding that final acceptance of the road for
county maintenance depends on a letter from Wickson
Creek Special Utility District stating that sleeve
is in place at the Buckhorn Drive location.
On motion by Commissioner Tony Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Amending
Plat of Lots 5,6 and 7, Block 1, whitetail Subdivision subject
to the developer complying with the exceptions noted by the
County Engineer
The Court next considered the request from Verizon to
construct 1,300 feet of buried cable installation in the
right-of-way of Enchanted Oaks Drive located in Precinct 3.
• The County Engineer made the following note:
Due to the age of this subdivision, there are no
dedicated utility easements along the road frontage
of the lots. Recommend approval of this request.
On motion by Commissioner C. B. Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve

On motion by Commissioner C. B. Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the request from Verizon and authorized the installation. A
copy of the request is attached hereto. Commissioner C. B.
Jones mentioned that Verizon has been difficult to work with
and has delayed some work six (6) months to a year. The
County Judge suggested that the court write a letter to
Verizon.
The Court next considered the request from Wellborn
Special Utility District to construct a road bore for
waterline installation in the right-of-way of Greens Prairie
Road. The site is located in Precinct 1. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Tony Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the request from Wellborn Special Utility District and
authorized the installation. A copy of the request is
attached hereto. Commissioner C. B. Jones moved to charge
$3,000.00 for the road bore. The motion died for lack of a
second.

The County Judge deviated to agenda item number 27
announcement of interest items and possible future agenda
topics the County Judge made the following comments:
a) He received memo from Richard Vance,
County Engineer.
b) Ag Extension Agent 4-H, Brant Poe, has
accepted a new job and will be leaving in
August.
c) He received a letter concerning equipment
• of mass destruction. He will be
forwarding it to Emergency Management.
He commended the Director of Emergency
Management, DeMerle Giordano for
responding last year when so many
counties did not.
d) He received a letter from Richard Vance,
County Engineer concerning drainage
problems at the Detention Center on Sandy
Point Road.
Under citizen input and/or concerns, Karen Hall made the
following comment:
She asked for a list containing the dates and times
of the budget hearings. The County Judge
instructed his Administrative Assistant to give Ms.
Hall the information.
Susan Gandy made the following comment:
• She reminded the Court of a workshop on County
Retirement that will be held next week.
The County Judge made the following comment:
e) He reminded the Court of a Public Hearing and
Workshop to be held today. The Public Hearing
will be at 10:30 a.m. and the Workshop will
begin at 10:45 a.m.

At 10:28 a.m., the County Judge returned to agenda item
25 to convene into Executive Session pursuant to §551.072 of
the Texas Government Code to discuss the acquisition of real
property.
At 10:48 a.m. the County Judge announced the meeting open
to the public and that no action would be taken on the
Executive Session.
There being no further business to come before the Court,
the meeting was adjourned.

L Bill Turner, District Attorney of Brazos County, Texas, require the services of
peace officers in the performance of my legal duties.
I am hereby applying to the Commissioners' Court of Brazos County, Texas,
is pursuant to Texas Local Government Code §151.001, in conjunction with Texas
Government Code §41.102 and §41.109, to authorize me to employ no more than 10
peace officers to be titled "Investigator" pursuant to Texas Code of Criminal Procedure
Article 2.12(5).
These Investigators may hold other titles and/or positions within the District
Attorney's Office as determined by the District Attorney.
Said peace officers are to be paid those amounts set forth and authorized by the
Brazos County Commissioners' Court in each fiscal year's budget as amended.
Brazos County has a population of 152,415 according to the 2000 Federal Census,
which compels application of Texas Local Government Code § 151.001.
Pursuant to Texas Government Code §41.109 (c), in compliance with Texas Local
Government Code §151.001(d), there are no probable receipts from fees, commissions, or

COMPREHENSIVE PUBLIC LIABILITY INSURANCE REQUIREMENTS
Proof of,current coinprehensive public liability insurance is required for all commercial and vending events and
other events as determined by the Director. $1,000,000 Public Liability insurance for bodily injury or death is
required.
One week prior to the event a copy of such proof of insurance including a copy of paid receipt for
premium showing effective dates of coverage must be on file at the Brazos Center.
- SECURITY DEPOSITS
Security deposits are NEVER applied to fees.
Security deposits for any Brazos County Event Facility space are payable at the time the space is reserved.
In order to reserve a space, a deposit must be placed.

MULTIPLE REQUESTS FOR SAME DATE AND SPACE
Reservation for a one-time, one-day event can be made no more than one year in advance. Reservations
may be made on the day requested (or the nearest working day) one year prior to the actual day. Should
more than one request for the same day be made all interested parties desiring the date must appear with
their appropriate deposit, at the Brazos Center office on that date one year in advance by 8:00am.
1. At 8:15am on that day all names will be Individually written on the exact same size paper which will
then be folded and placed in a bowl or hat.
2. An impartial person will draw one name at a time until all names are drawn. The first name drawn
must pay the required deposit at that time.
3. All remaining names will be listed and retained in the order they were drawn and will be on file in
case of date cancellation by the depositor.
FREE USE OF BRAZOS COUNTY EVENTS FACILITIES
For free use by a Brazos County Department, the event must be:
1. A legally specified County duty. voting, condemnation, etc. or
2. Open to the public at no charge, or
3. Official County business
4. Any of the above or any other events held by County Departments requesting free use requires
approval of the Commissioner's Court 'and may not be scheduled more than 45 days prior to the
event with the exception of voting. -
Exceptions to this policy will be allowed only if approved by Commissioner's Court.
PUBLIC SCHOOL SPONSORED EVENTS
Special fee consideration Is given to the follom firig'BISD or CSISD'School sponsored events.
1. Junior-Senior Prom may utilize the Brazos Center 1 day (24 hours) prior to the prom day, the day of
the prom and up to %2 the day following the prom for the price of one day's fees.
2. Regular 'banquet' fees (per capita) are charged for banquets. Peace officer requirements are
standard.
PROHIBITED EVENTS

Events not conforming to accepted community standards or any event that has been scheduled using untrue
or misleading information provided by the Lessee shall be rejected or cancelled.

1. If a Lessee pays vending rates for an event, merchandise vendors at that event do not pay an
additional vending fee with the exception of concessionaires. (see page 9)

SET-UP
Lessee may reserve space, if available, for set-up. This applies only to large spaces (Concourse and
Assembly Rooms). Set-Up day's can qualify for a 50% discount of the first day's fees, with certain restrictions.
Set-up in smaller areas is at regular price.
CLEAN-UP
1. Lessee may reserve one full day following an event for clean up. The fee is one half of the fees
charged for the first day of the event.
2. For some events, Brazos Center personnel will perform dean-up for a fee of 25% of total fees
(deposits excluded): For example, if fees (including alcohol surcharge) total $350, Brazos Center
dean-up fees will be $87.50 for a total fee of $437.50. Any utensils, equipment or decorations to be
saved are the sole responsibility of the Lessee. Lessee must dean tables and spills during event

CATERING DEPOSITS
(APPLIES TO CATERER'S, BAR SERVICE, CONCESSION PROVIDERS)
1. All caterers (food & beverage) doing business at the BCEFs are required to have a $100 deposit on file at
the Brazos Center office which will be used to cover any required clean-up which the caterers fail to
perform themselves or as satisfaction for any damages occurring.
2. Brazos Center space and property used by caterers and bartenders must be left in the condition it was
found on arrival.
3. Caterers are responsible for knowing and following all rules that pertain to their service at this facility.
These are presented to the caterer upon receipt of their deposit.
COOKING
Cooking on the premises is allowed only by prior approval of director.
• ELECTRICAL
Most Brazos Center users may use up to 25 amps of 110-volt electricity. If more is required, special
arrangements must be made in the Brazos Center office before the event
EQUIPMENT
In the event that the BCEF does not have adequate equipment suitable to the proposed use or to meet the
needs of those attending, the lessee shall supply such equipment, Brazos County shall not be in any manner
responsible for such property. ; -
DECORATIONS
The Lessee is responsible for their own safety and the safety of those
• associated with their event during the installation, display, and
removal of all decorations.

CLEAN-UP
The Lessee is responsible for the clean-up of the facilities after their use.

municipal, county, or state law enforcement agency, having local jurisdiction are used. Officers must be paid -
individually by Lessee at the commencement of the event.

SPECIAL POLICIES FOR
ARENA HALL, LIVESTOCK PAVILION
1. Should an event be postponed due to the probability of inclement weather, the event may be
rescheduled or refund of fees will be made. If an event starts and is halted or unfinished due to
inclement weather, no refunds will be made and rescheduling is possible only by paying normal
fees again.
2. Sand, cornmeal or any other material used to make a "faster" floor is prohibited in the Arena Hall.
3. The Arena Complex manager must approve use of candles.
4. Amplified music in the Livestock Pavilion is permitted ONLY with strict conditions.
a. Sound must be aimed toward the northeast corner of the Pavilion.
b. Volume of amplification must be controlled sufficiently as determined by the Arena
Complex Manager.
c. If any complaint of excessive volume is made from nearby residents, the volume must be
lowered immediately.
d. After lowering, an additional complaint will be cause for the music to cease.
5. Overnight parking is not authorized. No RV hook-ups are allowed/available.
6. Users wishing to have vending booths inside the Livestock Pavilion may pay a $200 per day
vending fee that will cover as many vendors as they can reasonably accommodate. Logistics for
this type of event must be approved in advance by the Arena Complex Manager.
7. At the Arena Hall only, lessees may bring in beer/wine/champagne without going through a TABC
licensed retailer. Beer must be in cans or a keg, wine, wine coolers,_ champagne must be served
in cups. `Two peace officers will be required when alcohol is to be present. All alcohol must arrive ,
with the host of the event and no BYOB (Bring Your Own Bottle) is ever allowed. All other rules
pertaining to alcohol service, as stated previously, apply.

The Brazos County Park consists of 39 acres of woodlands with a nature trail and picnic shelter. The parkland
adjoins the Brazos Center parking lot to the south. The picnic shelter is a covered pavilion with picnic tables
that will seat 100 people. A large barbecue pit and restrooms are adjacent to the picnic shelter. Although
mostly unimproved, the park has been enhanced by small habitat improvement projects and naturescape
projects, and hosts several wildlife viewing stations. Several picnic tables and cooking pits are available in the
park that are on a first come-first served basis.
Placing a $50 deposit and signing a user agreement at the Brazos Center office will reserve the picnic shelter.
The deposit is fully refundable if the reserving party cleans-up properly after their event. This includes:
• all trash removed from the park to the dumpster at the rear of the Brazos Center
• park restroom left in good condition
ii litter caused by event is removed from park and parking lot
return of the park restroom key
Brazos County Park rules include:

I am writing this request for a utility easement variance at the request of my client
Linda Praytor. In order for Mrs. Praytor to receive a permit for sewer installation, Brazos
County required a replat of her property, being a portion of the original Lot 16 and the
original Lot 17 of Ravcnw'ood Subdivision, as recorded in Volume 385, Page 461, of the
Deed Records of Brazos County
In order for the replat to be correctly and accurately completed, it was necessary
to include all the affected adjoiners on the replat. As a result of this prerequisite, John
Paul and Linda K. Greig's original Lots 15A and l 5B were affected and had to be
replatted as well. After extensive work and preparation of the replat the Greigs have
refused to sign the replat on the grounds that it is inaccurate.
The Greig's had a survey performed when they purchased said Lots 15A and
15B, and that survey did not show the 10 foot utility easements along the side and rear lot
lines of the said C'rreig's lots, although these easements have been in effect in Brazos
County since as early as June 1977, and the plat of Ravenwood Subdivision was created
in September of 1977, therefore the easements have affected the Greig's property since
the subdivision's conception.
Mrs. Praytor is asking that the 10 foot utility easements be removed from the
• Greig's replatted lot, so that the Greig'a will sign the replat.
Any and all help with this matter will be greatly appreciated.

4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall
be conducted by an independent Geotechnical testing firm; copies of all test results shall be

Devices for Streets and Highways, published by the Texas Department of Transportation, and all

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that VERIZON COMMUNICATIONS will
construct a communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Verizon Communications will place approximately 1300 feet of buried
communications cable along Enchanted Oaks Dr. This cable will be
placed along the north side of Enchanted Oaks Drive 4 feet inside the
right-of-way at a minimum depth of 30". The cable will be placed
between L116/Pdl and L118/Pd3 as indicated on the enclosed
drawings. All driveways will be bored.
The location and description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.

ITEM: Request from Wellborn Special Utility District to construct a road bore / water
line installation in the right of way of Greens Prairie Road. Site is located in Precinct 1.
SOURCE OF FUNDS: N/A
PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) All Installations shall be constructed in designated utility easements, if applicable. If no utility easement exists,
the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the case of a road bore,
perpendicular to the dghtof-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so
and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No D-698; test shall be conducted
by an Independent geotechnical testing fim ; copies of all test results shall be furnished to the office of the Brazos
County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control Devices for
Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
4. The County Engineer must be notified 72 hours prior to the beginning of
construction in order that he, or his designated inspector, may inspect the
actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
is 3. Brazos County reserves the right to require Applicant to relocate or lower
any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. Brazos County will in no way be responsible for any damage which might
occur to any existing utility lines in the right-of-way.

5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four Inches (24") lower
than the lowest part of the drainage or bar ditch and the drainage is to be
considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
