To make arrangements, call (979) 361-4102. 1-~~ : 4 3,3 ppqyt-4 • COMMISSIONERS' COURT REGULAR MEETING JULY 2, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 2, 2002, with the following members of the Court present: • Alvin W. Jones, County Judge, Absent; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Presiding; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. Under citizen input/and or concerns Dan Bates made the following comment: He referred to the article in the Eagle about last year's budget and the tax abatements given to • companies in the area. He told the Court if they were wondering where to get money for the budget then they needed to quit giving tax abatements. The Court next considered Budget Amendment #01/02-30.1 through 30.4, which would transfer funds to Building Maintenance from Contingency, increase the budget for Juvenile Services Title IV-E Administration Funds and reallocate funds Vol G 2 Page i& y • Commissioners' Court meeting July 2, 2002 2 for the County Attorney and the Brazos Center. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20032125 through 20032303 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. The Court next considered adopting an order Prohibiting or Regulating the Ownership and Keeping of Dangerous Wild Animals in Brazos County. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to adopt the Order. Commissioner Cauley stated that the one animal in Brazos County would be grand-fathered under certain conditions. A copy of the order is attached. Vol 33 Page 1 40 • Commissioners' Court meeting July 2, 2002 3 The next matter before the Court was adopting an Order prohibiting outdoor burning. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to table consideration of this item. The Court next considered approval of the contract for the collection of delinquent property taxes. The term of the contract will be from July 1, 2002 and ending June 30, 2004 • with an option for the County to renew for two additional years. The cost to the County will be 15 percent of all delinquent taxes, penalty and interest collected from all the taxing units with the exception of Bryan Independent School District. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the contract with McCreary, Veselka, Bragg & Allen, P.C. for the collection of delinquent property taxes. A copy is attached. The next matter for consideration was the appointment of a member to the Brazos County Child Welfare Board. • Commissioner Thornton moved to appoint Dr. Cesar Malave to serve on the board. The motion was seconded by Commissioner Cauley. Commissioners Tony Jones, Thornton, and Cauley voted "Aye". Commissioner C. B. Jones abstained. Commissioner C B. Jones asked that in the future, the Court get a biography of the proposed appointees. Vol 33 Page I AIl 40 Commissioners' Court meeting July 2, 2002 4 On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Rolando Rivera - 30 Feet by 50 Feet out of the South End of Lot 10, Block 66, City of Bryan, Brazos County, Texas. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Sale Redemption Deed to the following individuals: McAurther Rice and Sandra Rice - Part of Block "C", Jones Addition, Stephen F. Austin League No. 9, Abstract 62, City of Bryan, Brazos County, Texas. The Court next considered authorizing payment of indigent health invoices incurred in the previous fiscal year. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the payment of indigent health invoices incurred in the previous fiscal year. The Court next considered entering into agreement with llaoll~ Managed Network Solutions for Dedicated Internet Access Service. The cost to Brazos County will be $480.00 per mega bites per month. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to enter into agreement with Managed Network Solutions and Vol 33 Page I -Y ,-b Commissioners' Court meeting July 2, 2002 5 authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached. The next matter before the Court was a request to purchase a replacement printer for the Road & Bridge Department utilizing funds from the General Fund Contingency - Printer Replacement account. On motion by Commissioner • Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to authorize the request. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2002-054 Office Furniture Annual Contract. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for office furniture. The Court next considered awarding the following bid: Bid No. 2002-055, Cleaning Supplies for the Jail • Pat Howard, Purchasing Agent, recommended acceptance of the bid submitted by Ecolab, Inc. on items 1 and 4 and to Team Systems on items 2,3,5 and 6. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract as noted. A copy of the bid tabulation is attached. Vol 3-3 Page ~ 4-f 0 Commissioners' Court meeting July 2, 2002 6 The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Highland Interest, Inc. on Boatcallie Road in Precinct 2 to utilize the area as a turn-around for county equipment during construction on Boatcallie Road. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to authorize the work. The Court next considered a request from Brazos Electric Cooperative for variance from the Brazos County Subdivision and Development Regulations to plat a 0.249 acre tract rather than the required 1.0 acre tract and placement of communications tower. The site is located at the intersection of State Highway 6 and Old San Antonio Road in Precinct 2. The County Engineer noted that there is neither water service nor a septic system at this location. The recommendation was to approve the variance. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the County Engineer and grant the variance. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the request Verizon and authorized the installation. A copy of the request is attached hereto. • The Court next considered approval of the Final Plat of Gandy Estates, Block One, Lot 1, 1.12 Acre Tract (called 1.13 Acre Tract) in Precinct 4. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the final plat of Gandy Estates, Block One, Lot 1, 1.12 Acre Tract (called 1.13 Acre Tract) as submitted. The Court next considered approval of the Revised Final Plat of Dilly Shaw Tap Estates. 62.11 Acres in Precinct 2. A copy of which is attached to and made a part of these minutes. Under announcement of interest items and possible future agenda topics, Susan Gandy made the following comments: a) The Courthouse will be closed on July 4, i-►~ 2002 so the deadline for agenda items is 2:00 p.m., July 3rd b) There will be a Public Hearing at 10:30 a.m. on July 9, 2002 to discuss speed limits. c) There will be a Workshop at 10:45 a.m. to discuss cell phones. d) She will try to distribute budgets this afternoon. e) July 15-26 have been scheduled for budget hearings. The schedule will be finalized and meetings will be posted. f) There will be a Workshop on July 16th to discuss the County retirement program. Commissioner Cauley made the following comment: a) The Texas Forest Service can determine if we are no longer in drought conditions and the current fireworks Order will be automatically vacated if it is determined that we are not. The Sheriff stated that his office needed clarification because some fireworks stands were in compliance and some Vol 3.3 Page /447 • Commissioners' Court meeting July 2, 2002 9 were not. DeMerle Giordano, Emergency Management Coordinator said that the drought index was currently at 514 as of this past Sunday and the she may not get the new numbers until Thursday, which is a holiday. Commissioner Cauley asked Ms. Giordano to check with the Forest Service for the current information and if the fireworks ban has been lifted, to get the exact date. • There was no citizen input and/or concerns. TEXAS ORDER NO. 2002-011 AN ORDER OF BRAZOS COUNTY, TEXAS PROHIBITING OR REGULATING THE OWNERSHIP AND KEEPING OF DANGEROUS WILD ANIMALS IN BRAZOS COUNTY • THIS ORDER is adopted in accordance with Texas Local Government Code Section 240.002 and Texas Health and Safety Code Chapter 822, Subchapter E and applies in the unincorporated areas of the county. WHEREAS, to preserve and protect public health and safety, the Commissioners Court of Brazos County, Texas desires to prohibit the keeping of a wild animal in the County. NOW, THEREFORE, BE IT ORDERED by the Commissioners Court of Brazos County, Texas as follows: 1. This Order supercedes and repeals Commissioners Court Order of December 16, 1997. 2. For purposes of this Order, the following terms shall have the following meanings: • (a) "Wild animal" shall mean a lion, tiger, ocelot, cougar, leopard, cheetah, jaguar, bobcat, lynx, serval, caracal, hyena, bear, coyote, jackal, baboon, chimpanzee, orangutan, gorilla, or any hybrid of those animals. (b) "Animal registration agency" shall mean the Brazos Animal Shelter. 3. The keeping of a wild animal within any unincorporated areas of Brazos County, Texas is hereby prohibited unless the wild animal was being kept by a person in Brazos County on the date of this Order and the person keeping the wild animal meets the following requirements: (a) The person must not acquire any additional wild animals after the effective date of this Order. (b) The person must not sell or transfer the wild animal to anyone within Brazos County. 0 (c) The person must meet the registration and all other requirements of Chapter 822, Subchapter E of the Texas Health and Safety Code and Section 4 of this Order. 4. The following procedures shall be followed in registering a wild animal: (a) The applicant shall complete the application for certificate of registration on a form provided by the Brazos Animal Shelter. The application form and accompanying submittals must, at a minimum, include the information set forth in Section 822.104 of the Texas Health and Safety Code. (b) The applicant, for an original or renewal certificate of registration under this Order, shall pay to the Brazos Animal Shelter an annual fee of $100.00 per wild animal being registered. (c) A certificate of registration issued under this Order is not transferable and shall be valid for one year after its date of issuance or renewal unless revoked. It shall be the responsibility of the owner of the animal to seek renewal prior to the expiration of the certificate of registration each year that the owner is in possession of the animal. 5. A person commits an offense if the person is found to have violated the terms of this Order. Each animal with respect to which there is a violation and each day that violation continues is a separate offense. Each such offense is punishable as a Class C misdemeanor. 6. A person who fails to register an animal in accordance with this Order or fails to comply with the provisions of Chapter 822, Subchapter E of the Texas Health and Safety Code is also liable for a civil penalty of not less than $200.00 or more than $2,000.00 for each animal with respect to which there is a violation and for each day the violation continues. The county attorney or any attorney representing the County may file an action in a district court to enjoin a violation or threatened violation of this Order. This Order shall be effective as of July 2, 2002. Attest: ounty Clerk A vin ;;;~W7Jos,o u nty Judge , • CONTRACT FOR THE COLLECTION OF DELINQUENT PROPERTY TAXES THE STATE OF TEXAS § COUNTY OF BRAZOS § THIS CONTRACT is made and entered into by and between The County of Brazos, Texas (The County), acting herein by and through its governing body, and McCreary, Veselka, Bragg and Allen, P.C. (The Firm), 5929 Balcones Drive, P.O. Box 26990, Austin, Texas, 78755. 1. The County agrees to employ and does hereby employ The Firm to enforce by suit or • otherwise the collection of all delinquent taxes, penalty and interest owing to The County. Current year taxes which become delinquent within the period of this contract shall become subject to the terns of the contract upon the following conditions: A. Taxes on real estate that become delinquent during the term of this contract, that are not delinquent for any prior years, become subject to the terms of this contract on July 1 st of the year in which they become delinquent. Taxes on personal property shall become subject to this contract thirty (30) days after delinquency as defined by the Texas Property Tax Code. B. Taxes that become delinquent during the term of this contract, on property that is delinquent for prior years and is the subject of a suit to collect the prior years delinquent taxes, shall become subject to its terms on the first day of delinquency as defined by the Texas Property Tax Code. II. The County agrees to furnish all necessary delinquent tax information to The Firm on all property within the boundaries of The County. The County shall provide The Firm a • computer tape of all delinquent taxes each quarter of the year. The County hereby authorizes The Firm to determine the name, identity and location of necessary parties and to procure necessary legal descriptions of property and hereby assigns to The Firm the right to recover the costs of obtaining such information. III. The Firm agrees to mail the tax notices required by Section 33.07 of the Texas Property Tax Code at no charge provided that The County furnishes the current year delinquent tax information on computer tape to The Firm on or before the 10th day of May of each year. t = l • N. The County shall provide Office Space in the County Tax Office to accommodate two (2) employees of The Firm and system access for The Firm's two (2) computer terminals and a printer. V. The Firm is to advise The County of errors, double assessments or other discrepancies coming under observation during the progress of the work. VI. The Firm is to intervene on behalf of The County in all suits for ad valorem taxes hereafter filed by any other taxing unit on property located within its boundaries. VII. The Firm agrees to make written delinquent tax collection progress reports to The County quarterly or upon request. VIII. A collection goal of sixty-five percent (65%) of the balance of the current taxes due on July 1 st to be collected by the following June 30th is established for the City of College Station. A collection goal of sixty-five percent (65%) of the balance of the current taxes due on July 1 st to be collected by the following June 30th is established for the College Station Independent School District. A collection goal of fifty-three percent (53%) of the balance of the current taxes due on July 1 st to be collected by the following June 30th is established for the City of Bryan and a collection goal of fifty-six percent (56%) of the balance of the current taxes due on July 1st to be collected by the following June 30th is established for Brazos County. In addition to these goals, a goal for total delinquent collection for each of the four taxing jurisdictions is established. For Brazos County a collection goal of thirty-five percent (35%), City of Bryan a collection goal of thirty-five percent (35%), City of College Station a collection goal of forty- five percent (45%) and College Station Independent School District a collection goal of forty- five percent (45%). The Firm shall escrow ten percent (10%) of the fees payable to The Firm in an interest bearing account. When it is determined whether or not the units goals have been met, the escrow account shall be distributed as follows: If a unit goal is met or exceeded, the amount of principle and interest in escrow for that unit is paid to The Firm. If the goal is not met or exceeded, said principle amount plus one half of the interest accrued on that amount is paid to that unit and the balance of the interest is paid to The Firm. fen • IX. The County agrees to pay The Firm, for services rendered, fifteen percent (15%) of all delinquent taxes, penalty and interest collected by The County for itself and all the taxing units for which it collects except for the Bryan Independent School District, for years covered by this contract. The penalty imposed pursuant to Sections 33.07 and 33.08 of the Property Tax Code is not subject to this contractual fee. The County shall pay fees due The Firm monthly by check. X. • The Firm agrees to include with its tax lien foreclosures, for the Cities of Bryan and College Station, any other city liens which are assessed against the same properties. The Firm shall and does hereby agree to indemnify and hold harmless The County, its officers and employees, from any and all damages, loss, or liability of any kind whatsoever, by reason of injury to property or third persons occasioned by any error, omission or negligent act of The Firm, its officers, agents, employees, invitees, and other persons for whom it is legally liable, with regard to the performance of this Contract, and The Firm will, at its cost and expense, defend and protect The County against any and all such claims and demands. This contract is drawn to cover a period beginning July 1, 2002, and ending June 30, 2004, • with an option for The County to renew for two additional years, and each party shall have the right to terminate this contract by giving at least thirty (30) days written notice of such intention; provided however, that The Firm shall have an additional six (6) months to reduce to judgment and sale all tax collection lawsuits filed and collect all bankruptcy claims filed prior to the date last mentioned and shall have the exclusive right to compensation of fees earned due to these suits during this six (6) month period. Veselka -a-, 911 Dedicated Internet Access Service Level Agreement This Agreement for Internet Service is entered into the 11 day of June, 2002 by and between MANGED NETWORK SOLUTIONS, INC., a Texas corporation (herein "MNS', and BRAZOS COUNTY, TEXAS, a political subdivision of the State of Texas, acting by and through its duly elected Commissioners Court (herein the "COUNTY"). Network Service Availability Guarantee MNS guarantees 99.999% availability of its Network Service, which are those services, electronics and expertise necessary to deliver, manage and maintain connectivity for Internet Service from the County firewall to the Qwest Internet backbone. The MNS Network Service extends from the points of presence (POPs) of MNS' facility provider's private Internet exchange extending to the COUNTY's Internet firewall. Availability shall be measured by the use of ICMP echo request and echo reply packets sent from MNS network core to the COUNTYs Internet firewall. Round trip times for these ICMP packets shall also be used to determine network latency and shall be sent at intervals, on average, not to exceed 5 seconds. • Calculation of Availability Credit If MINIS fails to meet the Network Service Availability guarantee in any calendar month, the COUNTY's account shall be credited. At COUNTY's request, MNS will calculate the "Network Unavailability" in a calendar month. "Network Unavailability" consists of the number of minutes that the Managed Network Solutions Network, a Managed Network Solutions-ordered telephone company circuit in the contiguous U.S., or a Managed Network Solutions-owned fiber optic or copper cable build-out was not available to COUNTY. This will not include unavailability continuing for one hour or less which COUNTY fails to report to Managed Network Solutions within five days, or any unavailability resulting from: (a) Managed Network Solutions Network maintenance; (b) any COUNTY-ordered telephone company circuits; (c) COUNTY's applications, equipment, or facilities; (d) acts or omissions of COUNTY, or any use or user of the service authorized by COUNTY; or (e) reasons of Force Majeure. The term Force Majeure as employed herein shall mean acts of a public enemy, war, blockades, riots, epidemics, earthquakes and similar Acts of God, explosions, and accidents. If Managed Network Solutions fails to meet this Availability Guarantee, the account shall be credited the pro-rated charges at the rate of $300.00 per day for each cumulative minute of Network Unavailability in any calendar month. • Such credits should be applied to the COUNTY's next succeeding invoice following the calculation of the credit. Connectivity MNS guarantees a bandwidth of six (6) megabits per second (Mbs) sustained, full-duplex connectivity to the Qwest Internet backbone. MNS shall maintain connectivity by use of single- mode fiber optics run from the Courthouse Annex to the Qwest Building located at 124 E 26th ST, in Bryan, Texas. This fiber will deliver Connectivity via 100Base-FX Ethernet. The COUNTY shall perform such measurements at times and frequency determined by COUNTY in its own discretion. As part of this agreement, COUNTY is requesting monthly, thirty (30) day utilization/usage graphs showing peak and average utilization of the bandwidth, to be delivered via electronic mail. Additionally, COUNTY understands that it may request daily and weekly utilization graphs and that those graphs will be from the same tool as is used to create the monthly utilization graphs and will be available for delivery by either mail, fax or electronic mail. There shall be no charge to the COUNTY for such graphs. Packet Latency MNS guarantees a minimum of 8 ms or less from the Courthouse Annex to the Core of the MNS Network If MNS fails to meet this Packet Latency, the COUNTY's account shall be credited the pro-rated charges at the rate of $300.00 per day for each cumulative minute of excessive packet latency in any calendar month. Packet latency shall be determined by use of ICMP packets as described in "Network Service Availability Guarantee' as described above. Domain Name MNS represents and warrants it will assign a 28 range of non-NAT, public Internet Protocol (IP) addresses and perform ARIN registration for those addresses to the domain names assigned by the COUNTY. MNS understands that COUNTY will be responsible for administering and registering with the appropriate organizations the domain name services associated with any and all domains registered by COUNTY. Fees COUNTY shall pay a monthly fee to MNS for Connectivity and IP address assignment of $480.00 per Mbs per month. Should MNS fail to maintain connectivity at a bandwidth of 6 Mbs as provided herein, a pro-rata reduction in the monthly amount due MNS shall be made premised upon the charge for a Mbs per month stated above. MNS guarantees these fees will not change for the Original Term of this contract and for the next succeeding three (3) years during which this contract is subject to renewal. MNS shall invoice the COUNTY on a monthly basis and COUNTY shall pay such invoice no later than 30 days from the date of submittal. Equipment and Installation MNS shall install one (1) versatile interface processor (VIP) and one port adapter (PA) for use with the MNS Core router. COUNTY shall pay a total of $1200.00 for the VIP and PA. MNS shall also install two (2) single-mode 100 Base-FX to 100 Base-TX media converters for $450.00 each. MNS guarantees the VIP, the PA, and the media converters are adequate for the COUNTY's needs. Installation shall be complete within 12 days after the execution of this Agreement Upon completion of the installation of the single-mode fiber optics between the Courthouse Annex and the Qwest Building located at 124 E 26`h ST, MNS agrees to assign ownership of six (6), terminated strands of fiber to COUNTY. COUNTY understands that two (2) of those strands will be used to provide the Internet connectivity described by this agreement. The COUNTY acknowledges that there are a number of non-terminated strands of fiber within the cable, which contain the 6 strands of fiber assigned to the COUNTY under this Contract. This cable is located on COUNTY property. The COUNTY agrees to work with MNS in good faith relative to the use of such non-terminated strands should MNS enter into an agreement in the future with the City of Bryan or BTU for the providing of IP Services. • MNS warrants that the prices shown in this agreement are complete, and that no additional charge of any type shall be added without the COUNTY's express written consent MINIS warrant and represents it has entered into a joint use agreement with BTU for the location of its equipment upon the poles necessary to deliver service hereunder. In the event of default by MNS hereunder, MNS agrees to assign its rights pursuant to such use agreement to the COUNTY. Problem Notification MNS agrees to notify the COUNTY on a 24-hour a day basis of Network trouble within thirty (30) minutes of detection of such trouble. Such notification shall be made to the head of the County IT Department, or a member of the IT Department staff designated in writing to MNS by the County IT Department's director. MNS agrees to have staff personnel available 24-hours a day, 7 days a week to handle calls and questions by the COUNTY. MNS upon execution of this agreement will provide to the IT Department the appropriate telephone and fax numbers for such personnel. • MNS represents and warrants that: Warranties (i) It will strictly comply with the descriptions and representations as to the services provided under this Agreement and the RFP (including, but not limited to, performance capabilities, accuracy, completeness, characteristics, specifications, configurations, standards, function and requirements) (the "Services"). The RFP terms and MNS' response to the RFP are incorporated hereby by reference. Where there are any conflicts, the terms of this Agreement shall control. The buried cable will be 4 feet in the right-of-way at a minimum depth of 30 inches. We will start at L131/Pd 4 and end at 1-13111300. This will require two road bores on Old Bundick Road and one road bore on Pine Tree Road as indicated on the work prints submitted. We will also bore driveways and dear right-of-way of brush as needed. t The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that the tender of this notice by the Verizon Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void.
