To make arrangements, call (979) 361 A 102. i .s+,11, COMMISSIONERS' COURT REGULAR MEETING JUNE 25, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, June 25, 2002, with the following members of the Court present: Alvin W. Jones, County Judge via telephone; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Presiding; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner C. B. Jones gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, the following people spoke: Karen Hall asked the Court not to apply tax exempt status to the La Salle Hotel owned by the City of Bryan. The Court next heard a presentation by Paul Reiger, a representative of the Brazos Valley Children's Museum who asked the Court for support for the museum. The Court next considered Budget Amendment 401/02-29.1 through 29.6, which would transfer funds to Non-Departmental Vol 33 Page -725 • Commissioners' Court meeting June 25, 2002 2 Justice of the Peace, Precinct 2 Place 2, Building Maintenance Division, County Auditor, and County Treasurer from Contingency and reallocate funds for The Metropolitan Planning Organization. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. • The Court next considered the following Claims as submitted by the County Treasurer for payment: 20031705 through 20032124 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. The next matter for the Court's consideration was the recommendation of agencies to receive funding by the Brazos County Community Healthcare Endowment Fund (CHEF). The following four agencies are recommended for funding for their proposed program: AGENCY: Girl Scouts - Blue Bonnet Council AMOUNT: $5,975 PROGRAM: Girls Scouts Against Smoking Vol 33 Page --)9 0 Commissioners' Court meeting June 25 , 2002 3 AGENCY: Health for All AMOUNT: $20,000 PROGRAM: Pharmaceutical Program AGENCY: Hospice Brazos Valley AMOUNT: $85,000 PROGRAM: Non-Funded Hospice Care for Brazos County Tobacco Related Illnesses AGENCY: St. Joseph Regional Health Center AMOUNT: $44,191 PROGRAM: Hospital Inpatient and Community Smoking Cessation Education Program On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to accept the recommendations of CHEF Committee and fund the previously noted agencies. The Court next considered rescinding the Order prohibiting outdoor burning. Commissioner Tony Jones moved to rescind the Order at this time but to continue to have as an item of consideration on the agenda. Commissioners Tony Jones and C. B. Jones voted "Aye". Commissioner Thornton voted "No". Commissioner Cauley abstained. The motion carried. The next matter before the Court was the appointment of a County representative to the Wolf Pen Creek Tax Increment Board. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to appoint Commissioner Tony Jones as the Court's representative to the Board. Vol 33 Page SO • Commissioners' Court meeting June 25 , 2002 4 The Court next considered the renewal of County Property and Casualty Insurance. Bill Jeanes, Risk Management officer recommended renewal of current policy. Premium for renewal is $359,174.00. This is an increase of 36 percent over last year's premium. On motion by Commissioner Thornton, seconded by Commissioner C. B. Jones, the Court voted unanimously to renew the County Property and Casualty Insurance. Then on motion by Commissioner Thornton and seconded by Commissioner C. B. Jones, the Court voted unanimously to amend the motion to include the statement that there will be no penalty for cancellation. The Court next considered a request for Tax Refund by Andrew D. Seidel. Commissioner C. B. Jones moved to approve the refund subject to it being within the limits of the law. The motion was seconded by Commissioner Tony Jones. Commissioners Tony Jones, C. B. Jones, and Cauley voted "Aye". Commissioner Thornton voted "No". The motion carried. The next matter before the Court was a request for Tax Refund by Ocie Anderson Banks, Mary Banks, Cathy Banks and Kelvin Banks. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the refund request. Vol 33 Page gl 9 Commissioners' Court meeting June 25 , 2002 5 The Court next considered a request by the Sheriff's Office to receive donated property. The Sheriff's Office Citizens Academy Alumni have donated two sets of spike strips with an estimated value of $500 each. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to accept the donated property. The Court next considered a request from Constable Precinct 3, D. W. Thompson, to appoint Brian Kyle McCannon and James Scott Fraley as unpaid Reserve Deputy Constable. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the request from Constable Thompson to appoint Brian Kyle McCannon and James Scott Fraley as unpaid Reserve Deputy Constables subject to appointment being within the allotted number of deputies. The next matter for consideration was the Tax Resale Deeds and authorization for the County Judge to execute Tax Resale Deeds. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from the agenda. Vol 33 Page 9a • Commissioners' Court meeting June 25, 2002 6 The Court next considered establishing the date and time for a public hearing to consider posting speed limits for the following subdivision roads which are located off of Creekside Drive in Precinct 4: Deer Crossing/Deer Trails Subdivision 1. Deer Trail Drive 2. Deer Crossing Drive 3. Deer Trail Court 4. Deer Crossing Court • Sandy Oaks Subdivision ` 1. Sandy Oaks Drive 2. Sandy Creek Drive 3. Sandy Cove Drive 4. Sandy Shore Drive Grapevine Addition 1. Grapevine 2. Muscatel and Creekside Drive which is not platted into any of these subdivisions but serves as the main access road for all of them. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to set the date and time for Tuesday, July 9, 2002 at 10:30 a.m. The next matter for consideration was a request by the Brazos Center to transfer departmental funds into Equipment Maintenance. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the transfer of departmental funds. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to implement the MetLife web site. The Court next considered a request by the Brazos Center for funds for repairs at the Rodeo Arena and Arena Hall. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve funding for the maintenance of the Rodeo Arena and Arena Hall. The next item was a request by the Health Department to utilize approximately $1,700.00 in county postage funds to mail a letter to the public regarding the location of trash collection sites. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to utilize county postage funds for a mass mail out. Demetrios Basdekas commended the Health Department on taking this step and suggested they contact Texas A&M University also. The Court next considered a request by the Information Technology Department to engage a consultant /trainer regarding 110"\ Electronic Disposition Reporting. Estimated cost for the services is $5,200.00. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the request. Vol 33 Page • Commissioners' Court meeting June 25, 2002 Information Technology Department to replace the Line Printer located in the Treasurer's Office. This printer is used by both the Auditor's Office and the Treasurer's Office. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The Court next considered awarding the following Request • u For Proposal: RPF No. 2002-042, For the Collection of Delinquent Taxes for Brazos County Pat Howard, Purchasing Agent, recommended acceptance of the proposal submitted by McCreary, Veselka, Bragg & Allen, P. C. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to accept the recommendation of the appointed committee award the contract to McCreary, Veselka, Bragg & Allen, P. C. C. for the collection of delinquent taxes. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to table until the Court is able to discuss contract terms . The current contract ends June 30, 2002. It will be extended until next week. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. Hedayatollah Dadfar's property Vol 33 Page 91 • Commissioners' Court meeting June 25 , 2002 11 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the work. The Court next considered a request from Gage Gandy for variance on road frontage width at Gandy Estates, Lot 1, Block 1 (2900 Sandy Point Road)in Precinct 4. The County Engineer made the following comment: In an effort to regulate the installation of "Flag lot" subdivisions, the Commissioners Court adopted, (October 1, 2000), as part of the County's Subdivision and Development Regulations, a minimum road frontage of seventy feet. However, in this case, we have a single lot that has existed in the configuration apparently for a number of years and for some reason the owner now wants it platted. I recommend approval of this variance. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the variance. The Court next considered the request from Wellborn Special Utility District to construct a road bore for water line installation in the right-of-way of Lakeland Drive in the Sweetwater Subdivision in Precinct 1. The County Engineer offered the following comments: The request for water service is for Lott 22. There is no Public Utility Easement (PUE) along the side of Lakeland where Wellborn S.U.D. proposes to route a 2 inch water line. There is an existing PUE along the other side of the road and it extends into Lot 22. Steven Cast, with Wellborn S.U.D., is aware of the existing PUE; however, he contends that there are several driveways on the side of the Vol 63 Page S9 • Commissioners' Court meeting June 25, 2002 12 road where the PUE is located and doesn't want to have to bore under them. For Wellborn S.U.D., it would be simpler and cost less to run the line in the Grad right of way along the side where no PUE exists. The recommendation to Commissioners Court is to deny the request and require the water line to be placed in the existing Public Utility Easement, as that is its intended use. Commissioner Tony Jones moved to approve the request with • recommendation noted by the County Engineer. Commissioner Cauley seconded the motion. After some discussion, Commissioners Tony Jones and Cauley withdrew their motion and second. Then on motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to condition deny the request based on the recommendation of the County Engineer. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He reminded the Court of the Public Hearing on July 9, 2002 to post speed limits on Deer Crossing in Deer Trails Subdivision , Sandy Oaks Subdivision and Grapevine Addition. Under citizen input and/or concerns, Demetrios Basdekas questioned items 28 and 29 and the difference between his property and Old Reliance Road. The County Engineer explained that there was no line of site problem on Mr. Basdekas' road as there is on the other properties. There being no further business to come before the Court, the meeting was adjourned. THIS Amendment relates to the local match fund participation requirement being based solely on the estimate of project direct cost included in this Amendment. WITNESSETH WHEREAS, the State and the Local Government executed an agreement on March 18, 1997 to effectuate the project to replace the bridge on CR 153, local road designation Democrat Road, at the Navasota River Relief (Str. D. proposes to route a 2" water line (see attached). There is an existing PUE along the other side of the road and it extends into Lot 22. Steven Cast, with Wellborn S.U.D., is aware of the existing PUE; however, he contends that there are several driveways on the side of the road where the PUE is located and doesn't want to have to bore under them. For Wellborn S.U.D., it would be simpler and cost less to run the line in the road right of way along the side where no PUE exists.
