REGULAR MEETING
JUNE 11, 2002
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, June 11, 2002, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
C. B. Jones, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton asked Merrill Green to give the
invocation. Commissioner Thornton then led the pledge of
allegiance.
On motion by the County Judge, seconded by Commissioners
Tony Jones, Bill Thornton, C. B. Jones and Cauley, the Court
voted unanimously to adopt a resolution recognizing and
congratulating Coach Janice Williamson, her staff and the
Bryan High School Women's Softball Team for winning the Class
5A University Interscholastic League Softball State
Championship. Commissioner C. B. Jones presented the

Resolution to Coach Williamson on the front lawn of the
Courthouse. The County Judge recessed the Commissioners Court
meeting until 9:45 a.m. to allow for a small victory
celebration.
At 9:45 a.m. the County Judge reconvened the meeting in
the Commissioners Courtroom.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment 401/02-28.1
which would transfer funds from Contingency to the County
Attorney's office. On motion by Commissioner Cauley, seconded
by Commissioner Tony Jones, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Tony Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as

submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the changes as submitted.

The next matter for consideration by the Court was
approval of an Order banning out door burning. As of Sunday,
the drought index was at 527. The Emergency Coordinator stated
that there were not as many grass fires due to the rain.
Commissioner C. B. Jones moved to table consideration. The
County Judge seconded the motion. Commissioner C. B. Jones
and the County Judge voted "Aye". Commissioners Tony Jones,
Thornton and Cauley voted "No". The motion failed. The
Emergency Coordinator stated that the County was considered to
be in a drought. Then Commissioner Tony Jones moved approve
an Order banning out door burning. Commissioner Cauley
seconded the motion. Commissioners Tony Jones, Thornton,
Cauley and the County Judge voted "Aye". Commissioner C. B.
Jones voted "NO". The ban becomes effective as of 5:00 p.m.
on June 12, 2002.
The Court next considered approving an Order restricting
the use of fireworks. This is being considered because the
Texas Forest Service has determined that drought conditions
exist in Brazos County. Commissioner Thornton moved to
approve the Order. Commissioner Cauley seconded the motion.
Commissioners Tony Jones, Thornton, Cauley and the County
Judge voted "Aye". Commissioner C. B. Jones abstained. The
motion carried.

The next matter for consideration was a request by the
County Clerk for consolidation of polling places. On motion
by Commissioner Cauley, seconded by Commissioner Tony Jones,
the Court voted unanimously to consolidate the polling places
on the attached list and forward the appropriate paperwork to
the Secretary of State for approval.
The Court next considered a request by the Brazos Animal
• Shelter for additional funding for radio equipment for the
county vehicle utilized in rural animal control. On motion by
the County Judge, seconded by Commissioner Cauley, the Court
voted unanimously to approve the additional funding for radio
equipment in the amount of $1,278.00.
On motion by Commissioner C. B. Jones, seconded by
Commissioner Thornton, the Court voted unanimously to
authorize the County Judge to execute a Tax Resale Deed to the
following individual:
Paul J. and Gwendolyn M. Turner - Lot 6, Block B,
Adams Addition, City of Bryan, Brazos County, Texas
The motion included a provision that allows the County Judge
to modify this to include an Order from Commissioners Court.
The next matter for consideration by the Court was a
request submitted by Justice of the Peace, Precinct 2, Place
2 seeking approval for out of state travel for himself. Judge
Truelove would be traveling to Reno, Nevada to attend a

Faculty Development seminar June 25-29, 2002. On motion by
Commissioner Tony Jones, seconded by Commissioner Thornton,
the Court voted unanimously to grant the request from the
Justice of the Peace and approved out of state travel for
Judge Ray Truelove at no cost to the County.
The next matter for consideration by the Court was a
request submitted by the County Judge seeking approval for out
of-state travel for himself. Judge Jones would be traveling
to Tucson, Arizona to attend the National Association of
Regional Councils Conference during June 22-26, 2002. On
motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to grant the request
from the County Judge and approved out of state travel for
Alvin W. Jones at no cost to the County.
The next matter for consideration was a tax refund to
Brent H. Hairston. Due to an accounting error the original
owner was billed for taxes that should have been paid by the
new owner on account 191000-0120-0010. On motion by
Commissioner Thornton, seconded by Commissioner Cauley, the
Court voted unanimously to refund $125.79 in county taxes for
2001 to Brent H. Hairston.
The Court next considered an application for Tax Refund
by Andrew D. Seidel. On motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously

to remove this item from the agenda until it is appropriate to
bring it back.
The Court next considered an application for Tax Refund
by. Ocie Anderson Banks, Mary Banks, Cathy Banks and Kelvin
Banks. On motion by Commissioner Thornton, seconded by
Commissioner Tony Jones, the Court voted unanimously to remove
this item from the agenda until it is appropriate to bring it
back.
The Court next considered authorizing the Auditor's
office to process a recurring payment request for the
following:
a) PM Properties for rental of office space
for Brazos Valley Narcotics Trafficking
Task Force, $3,450.00 per month.
On motion by Commissioner Thornton, seconded by Commissioner
Tony Jones, the Court voted unanimously to authorize the
Auditor's office to process the previously noted recurring
payment.
The Court next considered validating an Amendment to the
Special Nutrition Programs Agreement with the Department of
Human Services for Juvenile Services. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to validate an Amendment to the
Special Nutrition Programs Agreement. A copy is attached.

The next matter before the Court was the submission of a
Request for Waiver and Resolution to the Texas Department of
Transportation concerning the 10 percent local match fund
participation requirement on federal off-system bridge program
projects. On motion by the County Judge, seconded by
Commissioner Thornton, the Court voted unanimously to adopt a
Resolution and Request for Waiver concerning the 10 percent
local match fund participation requirement on federal off
system bridge program projects. A copy is attached.
The Court next considered Cancellation of Contract with
existing Internet Service Provider. On motion by Commissioner
Cauley, seconded by Commissioner Tony Jones, the Court voted
unanimously to cancel the contract with the existing Internet
Service Provider.
The Court next considered awarding the following bid:
Bid No. 2002-048RB, Internet Service Provider
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Managed Network Solutions. On motion by
Commissioner Cauley, seconded by
Commissioner Tony Jones, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Managed Network Solutions.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2002-053 Ruggedized Laptop
Computers with Hardware. On motion by Commissioner Cawley,

seconded by Commissioner Tony Jones, the Court voted
unanimously to authorize the Purchasing Agent to advertise for
bids for Ruggedized Laptop Computers with Hardware.
The Court next considered amending the current Janitorial
Contract with quality Janitorial to include services for the
office of Justice of the Peace, Precinct 2, Place 2. On
motion by Commissioner Tony Jones, seconded by Commissioner
• Thornton, the Court voted unanimously to amend current
Janitorial Contract with quality Janitorial. The cost will be
an additional $160.00 per month.
The Court next considered approval of a requisition for
a vehicle for the Juvenile Services Department. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to approve the requisition in the
amount of $19,400.75.
The Court proceeded to consider the following Blanket
Purchase Order:
Lowe's Brazos Center $1,000
• On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Nunn Jones Road in Precinct 3. On motion

by Commissioner C. B. Jones, seconded by Commissioner Cauley,
the Court voted unanimously to authorize the County Judge to
accept on behalf of Brazos County a Warranty Deed from Stephen
J. Lehr for the expansion and improvements to Nunn Jones Road.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Nunn Jones Road in Precinct 3.
Commissioner Tony Jones moved to approve. Commissioner Cauley
seconded the motion. Commissioners Tony Jones, Thornton,
Cauley and the County Judge voted "Aye". Commissioner C. B.
Jones abstained. The Court voted to authorize the County
Judge to accept on behalf of Brazos County a Warranty Deed
from C. B. Jones and wife Jeanette J. Jones for the expansion
and improvements to Nunn Jones Road. Commissioner C. B. Jones
filed his recusal form with the County Clerk's office prior to
today's meeting.
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore for water
line installation in the right-of-way of old Reliance Road
approximately 0.2 mile from it intersection with Wallis Road
in Precinct 2. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Thornton, seconded by Commissioner Tony Jones,
the Court voted unanimously to approve the request from
Wickson Creek Special Utility District and authorized the

installation. A copy of the request is attached hereto.
The next matter for consideration was the conditional
agreement with Carter and Burgess of a conceptual plan for a
realignment of the entrance road into the Brazos Center
located in Precinct 2. Mr. Lloyd Lentz, representative of
Carter and Burgess presented the plan that showed the road
staying comparatively in the same spot just being improved and
• slightly wider. The widening will affect the Lester portion
of the property rather than the Brazos Center. On motion by
Commissioner Thornton, seconded by Commissioner Tony Jones,
the Court voted unanimously to approve the conditional
agreement with Carter and Burgess of a conceptual plan for a
realignment of the entrance road into the Brazos Center. A
copy is attached.
The next matter before the Court was an Addendum to the
agenda. The Court considered awarding the following bid:
Bid No. 2002-050, Uniform Rental-Annual Bid
Pat Howard, Purchasing Agent, recommended
acceptance of the bid submitted by
Unifirst Holding LP on item I-uniforms
and the bid submitted by G&K Services on
items II and III, mop heads & mats . On
motion by Commissioner Tony Jones,
seconded by Commissioner Thornton, the
Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract as noted. A copy
of the bid tabulation is attached.

Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) He received a letter from BISD concerning
the availability of a portable building.
The County will pay $1 per year to lease
the building plus pay the cost of moving
it. Juvenile Services will use the
building and locate it at the Main Street
site. Tommy Ramirez, Juvenile Services
officer and member of the Bryan School
Board said the BISD Board would meet on
this issue at 1:30 p.m. on Friday June
14. z*'"
b) He received a letter from TxDOT in
reference to a conference at 9:00 a.m. in
the Gilchrist Building on June 17. The
topic is "Intelligent Transportation
System". The County has been invited to
attend.
c) He received a letter from the City of
College Station concerning the need to
reappoint a member to the Wolf Creek TIF.
Currently, Judge Jones is serving on the
TIF Board but he expressed a need to
appoint someone else. He said he would
put it on the next Commissioners Court
agenda.
d) He received a letter outlining guidelines
and criteria for the County.
e) He received a letter from the County
Auditor in reference to the external .•001
auditor examining confidential documents
for the health insurance third party
administrator.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

ORDER NO. 2002-009
PROHIBITING OUTDOOR BURNING IN BRAZOS COUNTY
WHEREAS, the Commissioners Court of Brazos County finds that circumstances
present in all or part of the unincorporated area of the county create a public safety hazard that
would be exacerbated by outdoor burning;
IT IS HEREBY ORDERED by the Commissioners Court of Brazos County that all
outdoor burning is prohibited in the unincorporated area of the county for ninety (90) days from
the date of adoption of this Order, unless the restrictions are terminated earlier based on a
determination made by the Texas Forest Service or this Court. This Order is adopted pursuant to
Local Government Code §352.081 and other applicable statutes. This Order does not prohibit
outdoor burning activities related to public health and safety that are authorized by the Texas
Natural Resources Commission for (1) firefighter training; (2) public utility, natural gas pipeline
or mining operations; (3) planting or harvesting of agricultural crops; or (4) bums that are
conducted by a prescribed burn manager certified under Section 153.048, Natural Resources
Code, and meet the standards of Section 153.047, Natural Resources Code.
In accordance with Local Government Code §352.081 (h), a violation of this Order is a
Class C misdemeanor, punishable by a fine not to exceed $500.00.

ORDER NO. 2002-010
RESTRICTING USE OF FIREWORKS
IN UNINCORPORATED AREAS OF BRAZOS COUNTY, TEXAS
WHEREAS, the Texas Forest Service has determined that drought conditions exist in Brazos
County; and
WHEREAS, on the 11 ah day of June, 2002, the Commissioners Court of Brazos County has '"'`11
determined that the normal danger of fire in the unincorporated areas of Brazos
County is greatly enhanced by the extremely dry conditions now existing;
NOW, THEREFORE, the Commissioners Court of Brazos County adopts this Order
prohibiting the sale or use of restricted fireworks in the unincorporated areas of
Brazos County.
A. No person may sell, detonate, ignite, or in any way use certain restricted fireworks in any
portion of the unincorporated area of Brazos County.
B. Restricted fireworks means only those items classified under 49 C.F.R. part 173. 1 00(r)(2)
(10-1-86 edition), as "skyrockets with sticks" and "missiles with fins."
C. Fireworks not prohibited under this Order are:
Common fireworks, small in size, classified as Class C explosives;
2. Large firework devices designed primarily to produce visible or audible effects by
combustion, deflagration, or detonation and classified as Class B explosives by
the U.S. Department of Transportation (TEX.000.Code, Chapter 2154).
D. A person commits an offense if the person knowingly or intentionally violates a
prohibition established by this Order. An offense under this Order is a Class C
misdemeanor.

RE: Consolidation of Polling Places
I would like to request that the attached consolidated polling places be placed on the June
11, 2002 Commissioner's Court agenda for approval. The designation of polling places
was approved in January 2002, but not the consolidation list. The polling places listed
on this consolidation list will be the actual polling places used in County elections.

Enclosed please find a copy of Amendment A to the Texas Department of Human Services Special Nutrition
Programs Agreement. The amendment incorporates recent State of Texas legislation. It adds a limited English
proficiency clause under the title: "IV. CIVIL RIGHTS POLICY COMPLIANCE" in the agreement, to ensure access
to services for applicants and recipients who cannot express themselves fluently in English. The amendment also
replaces clause B, cited under the title: "V. TDHS CLAIMS PAYMENT" in the agreement, with a clause that
allows the comptroller to apply contract payments to cover delinquent taxes and debts.

AMENDMENT (A)
TO THE SPECIAL NUTRITION PROGRAMS AGREEMENT
The Texas Department of Human Services, hereinafter designated the Department, and
Brazos County

Hereinafter designated the Contractor, entered into a Special Nutrition Programs agreement which is effective until terminated. The
Contractor and the Department hereby agree to the following amendment to such agreement
A limited English proficiency clause is added following the closing paragraph under the title: " IV. CIVIL RIGHTS POLICY
COMPLIANCE' in the agreement. The clause states.
•
"Additionally, Title VI of the Civil Rights Act of 1964, and its implementing regulations at 45 CFR, Part 80 or 7 CFR,
Part 15, prohibit a contractor from adopting and implementing policies and procedures that exclude or have the effect
of excluding or limiting the participation of clients in its programs, benefits, or activities, on the basis of national origin.
Also, 40 TAC, Part 1, §73.206 requires contractors to provide alternative methods for ensuring access to services for
applicants and recipients who cannot express themselves fluently in English. Accordingly, the contractor agrees to
ensure that its policies do not have the effect of excluding or limiting the participation of persons in its programs and
activities, on the basis of national origin. The contractor also agrees to take reasonable steps to provide services and
information, both orally and in writing, in appropriate languages other than English, in order to ensure that persons
with limited English proficiency are effectively informed and can effectively participate in and benefit from its
programs. The Contractor accepts final administrative responsibility for ensuring that its subcontractors take
reasonable steps to provide services and information, both orally and in writing, in appropriate languages other than
English, in order to ensure that persons with limited English proficiency are effectively informed and can effectively
participate in and benefit from that subcontractor's programs and services."
A clause that allows the comptroller to apply contract payments to cover delinquent taxes and debts replaces clause B cited under the
title: "V. TDIIS CLAIMS PAYMENT' in the agreement. The clause states*
"This paragraph is pursuant to §2252.903 of the Government Code. Any payments owing to the contractor under this
contract will be applied toward elimination of the contractor's indebtedness to the state, delinquency in payment of
taxes to the state, or delinquency in payment of taxes that the comptroller administers or collects until the indebtedness
or delinquency is paid in full."

This Amendment shall be in effect for the duration of the agreement unless revoked, suspended, or amended.

RESOLUTION
WHEREAS, the federal off-system bridge program is administered by the Texas Department of
Transportation (the State) to replace or rehabilitate structurally deficient and functionally
obsolete (collectively referred to as deficient) bridges located on public roads and streets off the
designated state highway system; and
WHEREAS, Brazos County, hereinafter referred to as the Local Government, owns bridges
located and identified as shown on Page 4 of this Resolution; and
WHEREAS, projects to remedy these bridges are included in the currently approved program of
projects as authorized by Texas Transportation Commission Minute Order Number 108653 dated
September 27, 2001; and
WHEREAS, the usual fund participation ratio for projects on such program is 80 percent federal,
10 percent state and 10 percent Local Government; and
WHEREAS, Texas Administrative Code, Title 43, Section 15.55(d) (43 TAC Section 15.55(d))
provides that under specified conditions the 10 percent Local Government match fund
participation requirement may be waived with agreement by the Local Government to perform,
or cause to be performed, an equivalent dollar amount of structural improvement work on other
deficient bridges or deficient mainlane cross-drainage structures within its jurisdiction, such a
project of structural improvement work being referred to as an "equivalent-match project"; and
WHEREAS, the estimated local match fund participation requirement on the approved federal
off-system bridge projects is $105.510, hereinafter referred to as the "participation-waived"
projects, such participation requirement the Local Government proposes be waived and in return
perform or cause to be performed equivalent-match project structural improvement work.
THEREFORE, BE IT RESOLVED that the Local Government perform, or cause to be
performed, the following equivalent-match project(s) in return for waiver of the local match fund
participation requirement on the approved federal off-system bridge program (participation-
waived) projects not yet awarded:

BE IT FURTHER RESOLVED that in receiving this waiver the Local Government
acknowledges its obligation to conform with all conditions of 43 TAC Section 15.55(d); such
conditions that include but are not restricted to the following:
1. The Local Government must be currently in compliance with load posting and closure
regulations as defined in National Bridge Inspection Standards under US Code of Federal
Regulations, Title 23, Section 650.303.
2. The equivalent-match project work increases the load capacity of the existing bridge or other
• mainlane cross-drainage structure, or upgrades the structure to its original load capacity with
a minimum upgrade to safely carry school bus loading if located on a school bus route.
3. In performing, or causing to be performed, the equivalent-match project(s), the Local
Government assumes all responsibilities for engineering and construction, and complying
with all applicable state and federal environmental regulations and permitting requirements
for the structures being improved.
4. The work on the proposed equivalent-match project(s) has not begun and will not begin until
the local match fund participation waiver approval process has been completed.

The Local Government will be allowed three years after the contract award of the
participation-waived project to complete the structural improvement work on the equivalent-
match project(s).
6. Should this waiver request be approved, an appropriate written agreement or amendment to a
previously executed agreement will be executed between the State and Local Government.

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) All installations shall be constructed in designated utility easements, if applicable If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm, copies of all test results shall be
furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.
