X33 • COMMISSIONERS' COURT REGULAR MEETING JUNE 4, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, June 4, 2002, with the following members of the Court present: • Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The Reverend Jones gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, the Sheriff made the following statement: He informed the Court that a bomb threat was received at midnight on June 3, 2002. The news • media reported that the Courthouse had been evacuated. This was not true. The suspect was arrested at 8:00 a.m. this morning. Precautions were taken after the threat was phoned in, but he knew from the information received that there was a very slim chance of there being a bomb. He said he would be meeting with KBTX this morning to determine how they received their information. Vol 33 Page 3 • Commissioners' Court meeting June 4, 2002 2 The Court next considered Budget Amendment #01/02-27.1 through 27.2, which would add a line item to the Juvenle title IV-B budget, and reallocate funds for the TYC Parole Division Juvenile Services. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as I-- submitted by the County Treasurer for payment: 20031256 through 20031426 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The next matter for consideration by the Court was a request submitted by the Agricultural Agent seeking approval for out of state travel for himself. C. Jack Hunter would be traveling to Savannah, Georgia to attend the National Association of County Agricultural Agents Annual meeting July Vol 3-3 Page • Commissioners' Court meeting June 4, 2002 3 27-August 2, 2002. On motion by Commissioner C. B. Jones, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from the Agricultural Agent and approved payment of out of state travel expense for C. Jack Hunter. The Court next considered adopting an Order prohibiting outdoor burning. Demerle Giordano, Emergency Management Coordinator informed the Court that as of Sunday, June 2, • 2002, the drought index was at 532 and that there had been seven grass fires in the county. Commissioner C. B. Jones moved to table consideration. Commissioner Thornton seconded the motion. Commissioners Tony Jones, Thornton, C. B. Jones and the County Judge voted "Aye". Commissioner Cauley abstained. The motion carried. The next matter before the Court was authorizing the payment of delinquent indigent health care invoices. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the payment of $125.86 in delinquent indigent health care invoices. E The Court next considered awarding the following bid: Bid No. 2002-050, Uniform Rental, Annual Bid. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from the agenda. Vol 2.3 Page .5 • Commissioners' Court meeting June 4, 2002 4 The next matter before the Court was the renewal of Contract between Brazos County and the Bryan College Station Eagle for municipal advertising. The cost to Brazos County will be $15.72/inch daily and $16.18/inch Sunday. Starting date is July 1, 2002 through June 30, 2003. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to renew the municipal advertising agreement with the Bryan College Station Eagle. A copy of the contractual agreement is attached hereto. The Court next considered awarding the following bid: Bid No. 2002-051, Temporary Employment Services Marcia Mann, Buyer, recommended acceptance of the bid submitted by Manpower as Primary on items 1-7; the bid submitted by AES Staffing Solutions as Secondary on items 1-7 and the bid submitted by Express Personnel Services on items 8-10. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Buyer and award the contracts as noted. A copy of the bid tabulations is attached. The next matter for consideration was the approval of a requisition for a vehicle for the Narcotics Task Force On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the requisition in the amount of $15,996.12. Vol 3-3 Page • Commissioners' Court meeting June 4, 2002 5 The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(4). This is for the purchase of professional services in the form of Behavior Modification workshops for juvenile probationers from vendors Traci Thomas and/or Portia Smith. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for said services during fiscal year 2001-2002. The Court next considered the request from Verizon to construct a buried cable installation in the right-of-way of Marino Road approximately 410 feet off Dilly Shaw Tap Road in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the request Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from wellborn Special Utility District to construct a 12 inch water line installation in the right-of-way of Arrington Road in Precinct The County Engineer stated that all appeared to be in order and recommended approval. on motion by Commissioner Vol 33 Page 7 0 Commissioners' Court meeting June 4, 2002 6 Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from the agenda. The Court next considered approval of the Re-Plat of Lots 15 & 16, Block One, North Country Estates Phase Two 7.98 Acres in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the Re-Plat of Lots 15 & 16, Block One, North Country Estates Phase Two 7.98 Acres as submitted The Court next considered approval of the minutes of the Commissioners' Court meetings held in March 2002 on the following dates: Regular Meetings 5, 19, and 26 and Workshops 19.and 21. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the minutes as submitted. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) The Court will have to take action on limiting fireworks at next week's meeting. b) He received a letter on bullet proof vests that he will forward to the Sheriff. Vol 33 Page Commissioners' Court meeting June 4, 2002 c) He received an E-mail from Scott Thompson of Vertex that he will send to the District Attorney so that he can decide if he wants to participate. d) He received a letter from Andrew Siedel in reference to his being delinquent on his tax payment. He will place this on the agenda for the next meeting. e) He had asked the MPO to do a traffic study around the property for the new Exposition Ce nter. They found that the • median speed Leonard Road on it's SH 47 is 72 62 mph and 4 mph, on 5 mph on Jones Road. f) He reminded the Court that there is a Housing Finance Corporation meeting here at 10:00 a.m. g) The County may owe the City of Bryan a tax refund for the La Salle Hotel. He will ask the Tax Assessor/Collector to speak to the Court on it next week. h) He received an E-Mail from the Texas Land Board on setting up a Veterans State Home at the State's expense. i) He received a letter from Judge Mike Schnider, who wrote that he was in awe of the cleanliness of the Courthouse. The County Judge thanked Carlos Guitron, Director of Building Maintenance, for his hard work. • j) He met with personnel from the cities of Bryan and College Station in reference to the airport. A&M is no longer interested in operating the airport. He will keep the Court informed as it is worked through. There was no citizen input and/or concerns. WiuuZ The Eagle CONTRACT FOR MUNICIPAL ADVERTISING Date: May 24, 2002 To earn a reduced rate on municipal display advertising published in The Eagle, the undersigned Advertiser hereby agrees to purchase space in The Eagle and to abide by all terms and conditions of this Contract Starting Date: July 1, 2002 Length of Contract: Twelve Months Expiration Date: June 30, 2003 Rate: Daily: $15 72 inch. Sunday: $16.18 inch In the proposed system, the City will be guaranteed a set price per inch for the contract period without regard to • the number of inches run each month, nor will there be a minimum number of inches required. This contract is based on nine column format. Ads running in retail on six column format would be converted to nine column equivalents and the rate applied (as noted above). A carrying charge of IY2% per month will be charged on all accounts not paid in full by the 15th day of the month following advertising insertion. The Advertiser also covenants to pay all costs incurred by The Eagle enforcing this Contract, including collection and attorney's fees (up to 50% of the amount in default) should the Advertiser default in payment. A cable on the south right-of-way of Marino Road will be dug up and a pedestal placed to access cable to provide telephone service to a Voice Stream tower site addressed at 1179 Marino Road. The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-0f-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by the Verizon Southwest does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void. B) All installations shall be constructed in designated utility easements, if applicable. If no utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line. C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so and to remove all Geared brush, trees etc. from county right-of-way.
