IN THE COMMISSIONERS COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS. 1. Invocation and Pledge of Allegiance - Commissioner C. B. Jones. 2. Site is located in Precinct 2. 12. Request from Verizon to construct road bores and parallel buried cable installations in the rights-of-way of Hicks Lane, Daisy Lane and Barrow Court. Site is located in Precinct t. Z. 13. Discussion of request from Lester property to construct boulevard utilizing part of the existing entry into the Brazos Center. 14. Announcement of interest items and possible future agenda topics. 15. Call for citizen input and/or concerns. 16. Convene into Executive Session pursuant to §551.071 of the Texas Government Code to discuss privileged matters with legal counsel regarding acquisition of real estate. 17. To make arrangements, call (979)361-4102. • COMMISSIONERS' COURT REGULAR MEETING MAY 14, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, May 14, 2002, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1, Absent; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, Dan Bates spoke about the Court taking responsibility away from Constables. He chastised the Court for giving the Constables new cars but • no lights or other necessary equipment. He feels that Constables need lights to enforce speed limits in the area where he lives. He continued by saying that he was against the "cookie cutter" approach for Justices of the Peace and Constables. He ended by saying that Constables are part of law enforcement. Vol 3-- Page 8 0 Commissioners' Court meeting May 14, 2002 2 The Court next considered Budget Amendment #01/02-24.1 through 24.2, which would increase the budget for the District Attorney Child Protective Services Division, and set up accounting for the Right-of-Way purchase by TxDOT. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as -VQhI\ submitted by the County Treasurer for payment: 20030528 through 20030747 On motion by Commissioner Cauley seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to adopt a resolution authorizing the exemption from property taxation of organizations engaged primarily in performing charitable function strictly in accordance to Section 11.184 of the Texas Property Tax Code. Vol 3~- Page 99 • Commissioners' Court meeting May 14, 2002 3 The next matter before the Court was the establishment of speed limits for Capstone Drive located in Precinct 1. After considerable discussion and on motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to table consideration until the next Commissioners Court meeting. Commissioner Tony Jones was not at the meeting and it was decided to delay action until he • could resolve some issues. The Court next considered authorization for the Sheriff's Department to apply to the U.S. Department of Justice for a "Sex Offender Management Discretionary Grant." On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Sheriff's Department to apply to the U.S. Department of Justice for a "Sex Offender Management Discretionary Grant." The Court next considered a request by the Road & Bridge Department to transfer funds from the Information Technology "Printer Replacement" account to the Road & Bridge Department • for the replacement of an HP650c wide-format plotter. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request by the Road & Bridge Department to transfer funds from the Information Technology "Printer Replacement" account to the Vol 3a- Page %Cl 0 Commissioners' Court meeting May 14, 2002 4 Road & Bridge Department for the replacement of an HP650c wide-format plotter. The Court next considered the request from Verizon to construct a road bore for buried cable installation in the right-of-way of Green's Prairie Trail approximately 2,329 feet southwest of Royder Road in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Verizon and authorized the installation. All requirements must be met. A copy of the request is attached hereto. The Court next considered the request from Verizon to relocate an existing buried cable in the right-of-way of Alexander Road with the placement of an aerial crossing to accommodate new bridge construction in Precinct 2. Vol 3a Page o Commissioners' Court meeting May 14, 2002 5 The Court next considered the request from Verizon to construct road bores and parallel buried cable installations in the rights-of-way of Hicks Lane, Daisy Lane (private road) and Barrow Court in the Big Cedar Estates Subdivision in Precinct 2. The County Engineer offered the following exceptions: is 1. The first 1,100 feet of cable installation (including the first road bore) on Hicks Lane is in the City of Bryan which is outside county jurisdiction. 2. Road bore under Barrow Court is not addressed in Verizon's written request. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request frgm Verizon and authorized the installation subject to their compliance with the exceptions noted above. A copy of the request is attached hereto. The next matter for consideration was a discussion of • request from the Lester property owner to construct a boulevard utilizing part of the existing entry into the Brazos Center. The developer will need to meet with the City of Bryan and get their approval before contacting the County. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He got a letter from the Governor thanking the Court for taking steps toward the establishment of the transportation corridor. One property is currently being used for Juvenile Services Boot Camp and one for Community Supervision. c) He asked the Court if they wanted to limit fireworks for the 4th of July. This needs to be done by June 14th . Demerle Giordano, Emergency Management Coordinator, said the drought index was currently at 461. 6 d) He reminded everyone that tomorrow, May 15, 2002 at 9:00 a.m. was the Greens Prairie Road grand opening. He invited one and all to come out and see the new road. There was no citizen input and/or concerns. There was no requirement to meet in Executive Session. There being no further business to come before the Court, the meeting was adjourned. SOURCE OF FUNDS: N/A REQUIREMENTS: 1) No work will be permitted between front slope and/or back slope 2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line. 3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way. 4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. 5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction.
