ID COMMISSIONERS' COURT REGULAR MEETING APRIL 30, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, April 30, 2002, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Tony Jones gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. On motion by the County Judge, seconded by Commissioners Tony Jones, Thornton, C. B. Jones and Cauley, the Court voted unanimously to adopt a resolution supporting the Texas Brazos -t Trailblazers' submission of a grant application to the Texas Historical Commission to promote awareness and encourage preservation of agricultural heritage and traditions. The Court next considered Budget Amendment #01/02-22. through 22.3, that would reallocate funds for the County Attorney, County Court at Law #1 and District Attorney. On motion by Commissioner Cauley, seconded by Commissioner • Commissioners' Court meeting April 30, 2002 2 Thornton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20030082 through 20030308 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as • submitted. The next matter before the Court was a Tax Exemption Request from the SPJST Lodge #39 of Bryan, Texas. The Texas Comptroller of Public Accounts has determined that SPJST Lodge #39 is a charitable organization eligible for property tax exemption. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Tax Exemption Request from the SPJST Lodge #39 of Bryan, Texas. The next matter before the Court was a Tax Exemption Request from the ADAM ROYDER LODGE #778, Ancient Free and • Accepted Masons. The Texas Comptroller of Public Accounts has determined that the Ancient Free and Accepted Masons is a charitable organization eligible for property tax exemption. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the Tax Vol 3 '2- Page ~5 Commissioners' Court meeting April 30, 2002 3 Exemption Request from the ADAM ROYDER LODGE #778, Ancient Free and Accepted Masons. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to adopt a resolution accepting responsibility for ten (10) percent of the cost of right-of-way acquisition currently estimated at $7,245,000 for the improvement of SH 6 from FM 159 to the Navasota River. The Court also authorizes the Texas Department of Transportation to transfer the credit balance of $280,220.90 from the SH 6 right-of-way project, account # 8017-1-25 to the SH 6 right- of-way project, account # 8107-1-57. The next matter for consideration by the Court was a request submitted by the County Extension Agent-FCS seeking approval for out of state travel for herself. Dr. Alma Fonseca would be traveling to New Orleans, Louisiana to attend the CYFAR 2002 Conference May 28-31, 2002. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to grant the request from the County Extension Agent-FCS and approved payment of out of state travel expense for Dr. Alma Fonseca. The Court next considered acceptance of Special Warranty Deeds for right-of-way on South Dowling Road in Precinct 1. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to cancel the June 18, 2992 Commissioners Court meeting. The next matter for consideration was an application made by Irvin Richard Price for military service credit with the Texas County & District Retirement System. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the application of Irvin Richard Price for military service credit and forward the application to the Texas County and District Retirement System. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for water line installation in the right-of-way of Shady Creek Drive in the Rustic Oaks Subdivision. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. The Court next considered approval of the Final Plat of Vol 3,9- Page 9 • Commissioners' Court meeting April 30, 2002 6 Duck Haven Subdivision Phase One in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1} Developer and Union Pacific Rail Road Company will work out rail road crossing details that affect development of this subdivision. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the final plat • of the Duck Haven Subdivision Phase One subject to the developer complying with the exceptions noted by the County Engineer. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for March 2002 and the Quarter Ending March 31, 2002. He suggested getting invitations out for the ground breaking ceremony. He asked the Sheriff for an escort on the first drive up and down the road. There was no citizen input and/or concerns. There was no requirement to convene into Executive Session. APPROVED: o~rq Judge Attest: 40 Resolution RESOLUTION NO. 2002-009 WHEREAS, the Texas Department of Transportation has requested Brazos County (County) to enter into a contractual agreement and acquire Right of Way for the highway project on SH 6 from FM 159 to the Navasota River; and WHEREAS, the County desires to voluntarily contribute to the State, funds equal to ten (10) percent of the cost of the said Right of Way for the proper development and construction of the project; and WHEREAS, the completion of the improvement to SH 6 is crucial to the enhancement of circulation and safety; and WHEREAS, the County maintains a credit balance of $280,220.90 with the Texas Department of Transportation on the SH 6 right-of way project South of College Station, Account No. 8017-1-25; and NOW, THEREFORE, BE IT RESOLVED by the Commissioner's Court of Brazos County, Texas, that Brazos County, Texas, accepts responsibility for ten (10) percent of the cost of said Right of way which is currently estimated at $7,245,000 for the improvement of SH 6 from FM 159 to the Navasota River. The Commissioner's Court hereby authorizes the Texas Department of Transportation to transfer the credit balance of $280,220.90 from the SH 6 right-of- way project, Account No. 8017-1-25 to the SH 6 right-of-way project, Account No. 8107-1-57. SH 6 This Agreement by and between the State of Texas, acting by and through the Texas Department of Transportation, hereinafter called the State, and Brazos County, Texas, acting by and through its duly authorized officials pursuant to a Resolution dated the 304- day of APRs t , 2002, hereinafter called the Local Government, shall be effective on the date of approval and execution by and on behalf of the State. In addition, the Local Government shall transmit to the State with the return of this agreement, a warrant or check payable to the Texas Department of Transportation in the amount of Four Hundred Forty- Four Thousand Two Hundred Seventy-Nine and 10/100--------Dollars ($444,279.10 ) for the remaining (10%) of the estimated total cost of the right of way. The estimated total cost of the right of way is Seven Million Two Hundred Forty-Five Thousand and 00/100--------- Dollars ($7,245,000). If however, it is found that this amount is insufficient to pay the Local Government's obligation, then the Local Government will within thirty (30) days after receipt of a written request from the State for additional funds, transmit to the State such supplemental amount as is requested. Upon completion of the highway project and in the event the total amount as paid by the Local Government is more than ten percent (10%) of the actual cost of the right of way, any excess amount will be returned to the Local Government by the State. In the event any existing, future, or proposed Local Government ordinance, commissioners court order, rule, policy, or other directive, including but not limited to those concerning outdoor advertising, are more restrictive than State law, policy, or directive, and thereby result in any increased costs, then the Local Government will pay one hundred percent (100%) of all such increased costs, even if the applicable county qualifies as an economically disadvantaged county. The amount of the increased costs associated with the existing, future, or proposed Local Government ordinance, order, rule, policy, or other directive will be determined by the State at its sole discretion. Donations of real property may be credited to the Local Government's funding obligation for cost of right of way to be acquired for this project. Credit for all real property, other than property which is already dedicated and/or in use as a public road, donated by the Local Government to the State shall be based on the property's fair market value established as of the effective date of this agreement The fair market value shall not include increases or decreases in value caused by the project and should include the value of the land and improvements being conveyed, excluding any damages to the remainder. Such documentation shall include an appraisal of the property by a licensed appraiser approved by the Texas Department of Transportation, Right of Way Division, unless the Local Government determines that an appraisal is unnecessary because the valuation problem is uncomplicated and the fair market value is estimated at no more than $10,000 00. The cost of appraisal will be the responsibility of the State. The State will review the submitted documentation and make a final deternunation of value; provided however, the State may perform any additional investigation deemed necessary, including supplemental appraisal work by State employees or employment of fee appraisers. Credit shall be given only for property transferred at no cost to the State after the effective date of this agreement and the State's issuance of a letter of funding authority, and only for property which is necessary to complete this project. Credit shall be in lieu of monetary contributions required to be paid to the State for the Local Government's funding share of the right of way to be acquired for this protect. The total credit cannot exceed the Local Government's matching share of the right of way obligation under this agreement, and credits cannot be reimbursed in cash to the Local Government, applied to project phases other than right of way, nor used for other projects. In the event the Local Government's monetary contributions to the State for acquisition of right of way, when added to its donation credits, exceed the Local Government's thatching share of the right of way obligation, there will be no refund to the Local Government of any portion of its contributed money. The cost of providing such right of way acquired by the State shall mean the total value of compensation paid, either through negotiations or eminent domain proceedings, to the owners for their property interests, including but not limited to utility owners involving expenses related to the relocation, removal or adjustment of eligible utilities.
