REGULAR MEETING
APRIL 9, 2002
A regular meeting of the Commissioners' Court of Brazos
County, Texas was called to order in the Commissioners'
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, April 9, 2002. The County
• Judge announced the meeting would be moved to the 85th District
Courtroom. The following members of the Court were present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm.S. Thornton, Commissioner of Precinct 2;
C.B. Jones, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner C.B. Jones gave the invocation and led the
pledge of allegiance.
Under citizen input and/or concerns, Sharon Anderson
• spoke in opposition to the rearrangement plan for the Union
Pacific Railroad Tracks by the Metropolitan Planning
Organization (MPO). Ms. Anderson submitted a petition from
the neighborhood west of Carson Street to the Court.

The court next considered Budget Amendment #01/02-16.3
which would reallocate funds for the Constable, Precinct 1.
Commissioner Tony Jones requested that this item be considered
along with item #13.
The Court then moved on to item #4 and considered Budget
Amendment #01/02-19.1 through 19.10 which would increase the
budget for Contingency from the old Justice of the Peace
Precinct 2, old Justice of the Peace Precinct 3, old Justice
of the Peace Precinct 4, old Justice of the Peace Precinct 5,
and old Justice of the Peace Precinct 6 budgets and then
increase the budget for the new Justice of the Peace Precinct
1, new Justice of the Peace Precinct 2-Place 1, new Justice of
the Peace Precinct 2-Place 2, new Justice of the Peace
Precinct 3 and new Justice of the Peace Precinct 4, all from
Contingency.
On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the budget
amendment as submitted. A copy is attached.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Tony Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Tony Jones, the Court voted unanimously to
approve the changes as submitted.
The Court next considered participating in the City of

College Station Tax Increment Reinvestment Zone #15 (TIF
#15)for a city conference center and associated privately
developed hotel. The following people spoke in support of TIF
#15:
James Massey, College Station Council Member
Lynn McIlhaney, College Station Mayor
Charles Cryan, City of College Station Representative
Ron Blatchley, Economic Development Corp. Representative
Joe Horlen, Economic Development Corp. Exec. Director
The following people spoke in opposition of TIF #15:
Dick Birdwell, citizen
Mike wheeler, citizen
Commissioner Tony Jones stated he considered the following in
regard to TIF #15:
•
1) Would our involvement in the TIF be beneficial to
Brazos County?
2) Would it be beneficial for the Community?
3) Is the repayment plan realistic?
4) Should this be sent to the voters for a referendum?

5) why the difference in $6.5 million from TIF #7 and $18
million for TIF #15
After a great deal of research and consideration in regard to
TIF 415 Commissioner Tony Jones concluded:
1) The TIF would be beneficial for Brazos County.
2) The TIF would be beneficial for the Community.
3) The repayment plan is one that will work.
4) The $18 million is a realistic number.
Therefore, Commissioner Tony Jones stated he is in favor of
Brazos County participating with College Station in TIF #15.
Commissioner Thornton said he does not believe that
Commissioners Court should have been put in the position of
resolving differences between the citizens and the Council of
College Station. Commissioner Thornton further believes that
this matter should have been approved by a referendum and that
a more objective and timely feasibility study should have been
made as to the conference center. However, Commissioner
Thornton stated he believes the reward, the financial
solidarity and reliability of the developer, and the
credentials of the management team to be involved, justify the
risks.

Commissioner Cauley stated he feels TIF #15 is too long and
too large. Commissioner Cauley also said he has a problem
with equipment sharing and stated these are questions he will
raise even if the Court votes to participate in the TIF today.
Commissioner C.B. Jones stated that he was against TIF #15 in
the beginning, but after studying the figures he cannot find
any reason to vote against it. Judge Jones stated he believes

planning. Commissioners Court was then told that the project
would die unless the Court voted to participate in the TIF.
He stated none of the Court Members appreciate being put in
that position. Judge Jones agreed that the vote in 1997 was
not site specific, but does not agree with the tremendous
increase in costs of the project without the vote of the
citizens. Judge Jones said he would vote in support of the
project, but will ask the Court to consider the TIF for 13
years, rather than an open ending TIF. Judge Jones stated he
appreciated all the comments concerning the TIF, both for and
against. The County Auditor questioned if the TIF is in
accordance with legal tax codes and addressed Attorney General
opinions.

The Auditor also asked if the Conference Center is being built
to support the public or to support the hotel and suggested to
the Court that these issues need to be evaluated.
Commissioner Tony Jones stated he believes the hotel is
subsidizing the conference center. Commissioner Thornton
stated that the Attorney General's Office does not approve
TIFs. Commissioner Tony Jones then made the motion to approve
Brazos County's participation in the College Station TIF #15
with the following conditions:
1) Brazos County would have a 15 year term, starting on
the first day of construction beginning January 1, 2003.
2) The new dollars would be added to TIF #15.
3) On or before 15 years, if the revenues collected
adequately pay the debt of TIF #15, the County is out of
the TIF.
4) The County only pledges dollars from the tax revenues
collected that are in access of our debt service payments
each year.
5) Approval is based on the current plans only. There is
to be no new infrastructure added.
6) City of College Station must comply with all
requirements as instructed by legal counsel for Brazos i°~,PN
County.
Commissioner Thornton seconded the motion. The Court voted
unanimously to approve participating in the City of College
Station Tax Increment Reinvestment Zone #15 subject to the
noted conditions.

The Court next considered approval of a tax exemption
request from the Brazos Valley Elks Lodge #859. David
Ledbetter, Secretary of the Elks Lodge, requested a property
tax exemption for the non-profit organization. Mr. Ledbetter
explained this would fund additional projects and allow more
charitable acts with the money saved. Joe Trowbridge also
spoke in support of a tax exemption for the Elks Lodge. Judge
• Jones noted that the Brazos County Tax Assessor/Collector said
this would have a very minor effect on Brazos County. On
motion by Commissioner C.B. Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax
exemption request by the Brazos Valley Elks Lodge #859
The Court then considered amending a prior order dated
December 16, 1997 prohibiting the ownership, control and
custody of dangerous wild animals in Brazos County, Texas.
Judge Jones announced that Ms. McCauly is still trying to
obtain certification for exemption. On motion by Judge Jones,
seconded by commissioner Tony Jones, the Court voted
unanimously to remove the item from the agenda. Judge Jones
told Ms. McCauly that she would be notified when the item is
placed on the agenda again.

The Court next considered the appointment of a
magistrate. Judge Langley presented Dana Zachary to the Court
as the person chosen as magistrate to begin part-time
beginning October 1, 2002. On motion by Judge Jones, seconded
by all of the Commissioners, the Court voted unanimously to
appoint Dana Zachary as magistrate to serve the district and
county courts at law of Brazos County. A copy of the
resolution is attached.
The next matter for consideration was a resolution
endorsing the Bryan-College Station Metropolitan Planning
Organization's Selected option (#12-2) for the rearrangement
of the Union Pacific Railroad Tracks. On motion by
Commissioner Thornton, seconded by Commissioner Tony Jones,
the Court voted unanimously to approve the resolution. A copy
is attached.
The Court next considered approval of the use of the
Boonville Cemetery. A previous order was passed by
Commissioners Court to close Boonville Cemetery for burials.
This is a request to bury cremated remains in a family plot
that is well marked. Judge Jones made the motion to allow the
burial of cremated remains in Boonville Cemetery. The motion
was seconded by Commissioner Cauley.

After further discussion, Judge Jones withdrew his motion and
Commissioner Cauley withdrew his second. On motion by
Commissioner C.B. Jones, seconded by Commissioner Tony Jones,
the Court voted unanimously to allow the burial of cremated
remains for two family members of Connie Carll_
The Court next considered approval of vehicle equipment
requests. Commissioner Tony Jones made the motion to approve
$17,082.00 for equipping the Constable vehicles. Commissioner
Tony Jones noted $5,662.06 would come from Contingency.
Commissioner C.B. Jones seconded the motion. The motion
passed with Commissioners Tony Jones, C.B. Jones, Cauley and
Thornton voting "Aye". Judge Jones voted "Ney".
The County Judge then deviated from the agenda and
considered agenda item #3, Budget Amendment 01/02-16.3. On
motion by Commissioner Tony Jones, seconded by C.B. Jones, the
Court voted unanimously to remove this item from the agenda.
The Court next considered a request by the County Clerk's
office to rescind appointments to the County Election
• Commission made on March 26, 2002 and to create a Voting
Systems Selection Committee. On motion by Commissioner
Thornton, seconded by Commissioner Cauley, the Court voted
unanimously to appoint the following positions and people to
the Voting Systems Selection Committee:

The Court proceeded to consider the following blanket

On motion by Commissioner Cauley, seconded by Commissioner
Tony Jones, the Court voted unanimously to approve the Blanket
Purchase orders as submitted.
The Court next considered transferring a piece of
furniture from "salvage" to "inventory" for use in the
District Clerk's Office. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously 110=1'1
to transfer one desk from "salvage" to "inventory" for use in
the District Clerk's Office.

The Court next considered approval of an order declaring
the public necessity and convenience for acquiring 2.658 acres
road right-of-way for the Democrat Road project and ordering
the condemnation of said property if the land cannot be
acquired by purchase for the authorized official offer and by
the necessary date. On motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the order. A copy is attached.

The Court next considered acceptance of a warranty deed

2. Judge Jones thanked the Peters family for their
contribution.

on motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to accept the warranty deed. A copy is attached.
The Court next considered an addendum to the agenda
giving the Purchasing Department permission to solicit
RFP #2002-048RB for an Internet Service Provider. Ernie
Laney, Interim Director of Information Technology announced
that the current internet provider has not been able to
provide service at a level in which the County needs. On
motion by Commissioner Cauley, seconded by Commissioner Tony
Jones, the Court voted unanimously to allow the Purchasing
Department to solicit RFP #202-048RB.
Under announcement of interest items and possible future
agenda topics the County Judge made the following comments:
a) The questions on exempting travel trailers have
been answered and approval granted if Brazos County
elects to do so.
b) He received a letter from The Software Group
concerning the Senate Bill on racial profiling
along with a questionnaire. Sheriff Kirk announced
he received the same letter and is preparing a
response. .per
c) He received a letter and survey from Mr. Julian on
county facilities and their standards.
d) The Auditor has provided a cost plan for SCAT.

There was no citizen input and/or concerns.
At 10:57 a.m., the County Judge announced the
Commissioners Court meeting closed to the public so that the
Court could meet in Executive Session pursuant to Section
•
551.071 of the Texas Government Code to discuss privileged
matters with legal counsel regarding potential litigation with
an information technology firm and acquisition of real estate.
At 11:05 a.m., the County Judge opened the meeting to the
public and announced that no action would be taken on the
Executive Session.
There being no further business to come before the Court,
the meeting was adjourned.

WHEREAS, Brazos Valley Elks Lodge #859 is an integral part of this county and community;
and
WHEREAS, Brazos Valley Elks Lodge 4859 has incorporated into its Bylaws a requirement to
perform charitable work and public service; and
WHEREAS, this Lodge and its Members have and will continue to perform charitable work and
public service by supporting such great Elk charities as the Texas Elks Children
Services, Texas Elks Summer Camp, Elks National Foundation, Elks Hoopshoot
• and Soccershoot programs, Elks Veteran Services at Marlin, Temple and Waco
VA Hospitals and contract nursing homes, BCS Little League, Blue Bonnet Girl
Scout Council, Girl Scout Troop #1736, Brownie Troop #1736, Bryan Aquatics,
College Station Adult Softball, SHARE (Special Horses and Riders Excelling)
Equestrians, Robertson County Rockets and Brazos County Aggie Bombers
Special Olympics, Salvation Army Christmas Gift Program, Grand Lodge and
Texas Elk State Association Scholarships and Essay contests, Texas Elks
Prosthesis grants, and various other work programs and charitable projects that
may occur; and
WHEREAS, the Texas Comptroller of Public Accounts has deemed the Brazos Valley Elks
Lodge #859 a charitable organization which is eligible for a property tax
exemption;
NOW, THEREFORE, BE IT RESOLVED that the Commissioners Court of Brazos County
does hereby support the Brazos Valley Elks Lodge #859 in its application for
exemption from Ad Valorem taxation and recommend the Brazos County
Appraisal District grant such exemption.
PASSED this 9th day of April, 2002, at a regular meeting of the Commissioners Court of Brazos

Whereas, Texas Government Code §54.1041 authorizes the judges of the district
courts and county courts at law in Brazos County, with the consent and approval of the
Commissioners Court, to jointly appoint one or more magistrates to serve the courts in this
county; and
Whereas, the judges of the district courts and county courts at law in Brazos County
have appointed Dana L. Zachary to serve as Magistrate for the district and county courts at
law and have requested the consent and approval of this Commissioners Court of her
appointment; and
Whereas, the Commissioners Court is of the opinion that the confirmation of Dana L.
Zachary to serve as magistrate is in the best interest of the citizens of Brazos County;
Be It 11fierefore !Rfsotved, that the Commissioners Court of Brazos County, Texas,
consents and approves the appointment of Dana L. Zachary as Magistrate to serve the district
and county courts at law of Brazos County, effective October 1, 2002.
Be It Further 4psotve4 that the Commissioners Court of Brazos County, Texas,
determines that Dana L. Zachary as Magistrate shall be paid a salary of $2,775 per month
beginning October 1, 2002, for her part-time services of not more than 20 hours per week.
Be It Further 4Zosofved, that after passage and upon effective date of legislation
expanding the powers of the magistrate to include authority to determine probable cause,
issue warrants, perform magistrate's warnings, and set bail in criminal cases, it is the intent
of the Commissioners Court of Brazos County, Texas, that Dana L. Zachary, as Magistrate,
shall be paid a salary of $5,550 per month for her full-time service.

ORDER APPOINTING MAGISTRATE
On the 3rd day of April, 2002, the Judges of the District Courts and County Courts at Law in
Brazos County, Texas, met and reviewed the applications for appointment to the position of
Magistrate as authorized under Tex. Govt. Code § 54.1041 et. seq. After considering the applications
submitted and the recommendations of the Magistrate Selection Committee of the Brazos County
Bar Association, the judges determined that the application of Dana L. Zachary should be accepted.
IT IS THEREFORE ORDERED that Dana L. Zachary be and is hereby appointed
Magistrate of Brazos County, Texas, subject to the consent and approval of the Commissioners

A RESOLUTION ENDORSING THE
BRYAN-COLLEGE STATION METROPOLITAN PLANNING ORGANIZATION'S
SELECTED OPTION FOR THE REARRANGEMENT OF THE
UNION PACIFIC RAILROAD TRACKS
WHEREAS, the Bryan-College Station Metropolitan Planning Organization's Policy
Committee ("the Policy Committee") is the transportation planning decision-making body for
federal funding in the Bryan-College Station/Brazos County planning area, as designated by the
Governor of Texas in accordance with federal law; and
WHEREAS, the Policy Committee is currently engaged in a study to determine the
locally preferred rearrangement of the Union Pacific Railroad tracks in the'MPO area; and
WHEREAS, Brazos County Commissioners Court has been informed that the Policy
Committee conducted an extensive public involvement process wherein a citizen's rail advisory
committee was created and well over thirty (30) public meetings were held where the public was
invited to speak on this issue in the twenty-one (21) months since the study commenced; and
WHEREAS, Brazos County Commissioners Court has been informed of the progress of
this study through staff briefings, workshop presentations and local media sources; and
WHEREAS, the WO requests concurrence and support for the selected option from
each entity participating in the study for it to continue.
NOW, THEREFORE, BE IT RESOLVED by the Brazos County Commissioners
Court that it concurs and is in full support with the Policy Committee's selection of the #12-2
"Bryan Bypass" concept which incorporates both grade separations and track reconfigurations as
being in accordance with the legislative intent and letter of the High Priority Corridor projects
#1812 and #1820 by which the study and any potential outcome is funded through the federal
Transportation Equity Act for the 21 n Century (TEA-21).
BE IT FURTHER RESOLVED that the Brazos County Commissioners Court endorses
the MPO's efforts to produce an environmental document acceptable to, and as directed by,
Texas Department of Transportation and Federal Highway Administration for the selected option
that would eventually lead to the design and implementation of the #12-2 "Bryan Bypass"
concept; and
FURTHER, that the MPO staff will take administrative and procedural actions to
implement this Resolution.

the public purpose and use of and for the location, construction, improvement,
maintenance, expansion, widening, repair, extension and reconstruction of Democrat
Road thereon and located in Brazos County, Texas.
BE IT ORDERED BY THE COUNTY COMMISSIONERS COURT OF
THE COUNTY OF BRAZOS, TEXAS:
Section 1. That the findings and recitals in the preamble of this Order are hereby
found and determined to be true and correct and are hereby approved and adopted.
Section 2. That the official offer by Brazos County, Texas, for the 2.658 acres
necessary for road right-of-way to the land described in Exhibit "A" attached hereto, in
the amount of $5,880.00 represents the right-of-way's fair market value based upon an
appraisal by an independent fee appraiser, and is hereby confirmed and the County staff
and its authorized agents and representatives are hereby authorized and directed to offer
the owner the amount of $5,880.00 for the necessary property. Further, the authorized
agent and representative are hereby authorized to offer, to the landowner, in addition to
•
the amount stated herein, to build approximately 7723 feet of barbed wire using 12 '/z ga.
American made barbed wire on cedar post or, at landowner's request, wolmanized or
metal t-post and to stack and bum all brush and trees, install cattle guards to be furnished
by the landowner and the County to furnish and install up to three, 4 inch pipe sleeves at
locations on the road designated by the landowner.
Section 3. That in the event the authorized official offer described in Section 2 is
refused by the owner of the said property designated for the right-of-way, the County of
Brazos, Texas is hereby authorized and directed to institute and prosecute to conclusion
proceedings in eminent domain against the owner of said property and against all
interested owners, leinholders and other holders or claimants of an interest in the said
property.
Section 4. That Brazos County, Texas authorizes the law firm of Bruchez, Goss,
Thornton, Meronoff and Hawthorne, P.C. to act together with and on behalf of Brazos
County, Texas to acquire the subject property and if necessary institute and prosecute to
conclusion proceedings in eminent domain as authorized in Section 3.

parts, all situated in the ISAIAH CURD LEAGUE, Abstract No. 11, and being out of and a part of
the remainder of that certain Called 147.94 acre tract described in deed from Feather Crest
Farms, Inc. to Feather Crest Egg Company recorded in Volume 806, Page 456, Official Records
of Brazos County, Texas (O.R.B.C.T.): said 0.302 of one acre (13,146 square feet) tract of land in
three (3) parts being more particularly described by metes and bounds as follows:

BEGINNING at a point for the northeast comer in the proposed northerly right-of-way line of a
county road commonly known as Democrat Road, same being a point in the northeast line of said
Feather Crest Egg Company remainder of the called 147.94 acre tract of land and the southwest
line of the Feather Crest Farms, Inc, called 133.62 acre tract of land as described in deed
recorded in Volume 3414, Page 212 (O.R.B.C.T.), and from which point a 5/8" Iron Rod w/TxDot
Brass Disk found on the existing south right-of-way line of S. H. No. 21 at the occupied north
comer of said Feather Crest Egg Company called 147.94 acre tract of land and the occupied west
corner of said Feather Crest Farms, Inc. called 133.62 acre tract of land bears N 46°10'26" W a
distance of 1967.97 feet;
THENCE, S 46°10'26" E. along the line common to said Feather Crest Egg Company remainder
of the called 147.94 acre tract of land and said Feather Crest Farms, Inc. called 133.62 acre tract
of land, a distance of 16.62 feet to a point for southeast comer in an existing fence line and in the
existing northerly right-of-way line of said county road commonly known as Democrat Road, as

ITEM: Request from Texas A&M University System to install an underground low
voltage cable and set a power drop pole in the right of way of Silver Hill Road.
Note- Proposed power pole must remain in line with existing overhead electrical
service and not further encroach the road right of way. Site is located in Precinct 4.
Source of funds: N/A
Reauirements:
A) No work will be permitted between front slope and/or back slope.
B) All installations shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall be
furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published bythe Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

Domestic Water System Improvements
Dear Mr. Vance:
Attached is Texas A&M University's request to permit the laying of an underground low voltage
cable and setting a power drop pole in Silver Hill Road's right of way. I am respectfully
requesting that this item be placed on the next agenda for consideration.
Just as background information, the purpose for this request is for maintenance of two main water
transmission lines owned by the University. The 18 and 24 inch lines were installed in 1956 and
1976 respectively. These water lines are concrete-coated steel cylinder pipes that transport all of
the University's water from remote wells. Over time the concrete coating has deteriorated thus
exposing the steel directly to the soils. As I am sure you are aware, the soils in Brazos County are
very corrosive and tend to eat away at the steel pipes over time. This has resulted in a number of
ruptures in both lines which of course has affected our ability to deliver water to the campus. It is
our intent to install a cathodic protection system predominately on private property. This system
will protect the steel pipes by using a low-voltage electrical current induced into the pipe along
the entire length. While the cathodic protection will not stop the line breaks, it will certainly
cease further deterioration until sections of the lines can be replaced when budgeted.

Formal notice is hereby given that Texas A&M University proposes to place an
underground cable and a power pole with a power drop within the right-of-way of
Silver Hill Road In Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3 copies of
the drawing attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning of construction
in order that he, or his designated inspector, may inspect the actual installation.
• 2. All damage to the roadways and rights-of-way will be repaired to the original
condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. Brazos County will in no way be responsible for any damage which might occur to
any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the Texas
Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24") lower that
the lowest part of the drainage or bar ditch and the drainage is to be considered at
least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
• Construction of this line will begin on or after the 15th day of April , 2002.
