A regular meeting of the Commissioners' Court of Brazos Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. The attached sheet contains the names of the citizens and Commissioner Thornton gave the invocation and led the Under citizen input/and or concerns, the following people REGULAR MEETING APRIL 2, 2002 spoke: Vol Betsy McCauley spoke in reference to item number 7 of the Commissioners Court agenda. She informed the Court that she was attempting to get a Class C Permit (USDA permit) and was merely waiting "IN06-1 to hear a response from the government. She stated that she wanted to work with the Court to keep her pet, "beta". Sharon Anderson spoke in opposition to the Metropolitan Planning Office proposed plan for railroad configuration. 3/ Page 66 • Commissioners' Court meeting April 2, 2002 2 The Court next considered Budget Amendment #01/02-16.3, that would reallocate funds for Constable, Precinct 1. Commissioner Cauley moved to approve the amendment. There was no second to the motion. Then on motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to table consideration of the budget amendment. The Court next considered Budget Amendment #01/02-18.1 • through 18.2, which would transfer funds to Constable Precinct 4 from Contingency, and reallocate funds for The Metropolitan Planning Organization. Commissioner Cauley moved to approve as submitted. Commissioner Thornton seconded the motion. Commissioners Tony Jones, Thornton, C. B. Jones and Cauley voted "Aye". The County Judge abstained. A copy is attached. The Cogrt next considered the following Claims as submitted by the County Treasurer for payment: 20029166 through 20029358 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as • submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. Vol =31 Page 67 0 Commissioners' Court meeting April 2, 2002 3 The next matter before the Court was approval of an Order Amending a prior Order dated December 16, 1997 of Brazos County, Texas Prohibiting the Ownership, Control and Custody of Dangerous wild Animals in Brazos County, Texas. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to table consideration pending government approval of Ms. McCauley's exemption permit. The Court next considered approval of a Letter of I-- Agreement with Ingram, Wallis & Company for auditing services for the years 2002,2003 and 2004. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Letter of Agreement with Ingram, Wallis & Company. A copy is attached. The next matter before the Court was sponsoring the 2003 Texas Community Development Program Application for West 28th Street Sewer Improvements. On motion by Commissioner Cauley, seconded by Commissioner C. B. Jones, the Court voted unanimously to sponsor the 2003 Texas Community Development Program Application for West 28th Street Sewer Improvements. The Court next considered appointing three members to the Brazos County Child Welfare Board. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to reappoint Ms. Suzanne Phelps and Ms_ Kathy Vol / Page 68 • Commissioners' Court meeting April 2, 2002 4 Joyce and to appoint Ms. Sharon Jackson to serve on the Brazos County Child Welfare Board. The Court next considered appointing a member to Twin Cities Endowment, Inc. This was formerly the Brazos County Industrial Foundation.. On motion by the County Judge, seconded by Commissioners Thornton and Cauley, the Court voted r~ unanimously to appoint Mervin Peters to the position. The Court next considered the approval of a Quitcalim Deed and authorization for the County Judge to execute the Quitclaim Deed for Lots 5 and 6, R. B. Darling Addition, City of Bryan, to Minnie Marie Pierce. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from consideration until there is clarification on the item. • The next matter for consideration was approval for the Purchasing Agent to advertise for the following bids: Bid 2002-045, Counseling Services for adult probationers Bid 2002-047, Poly Jute for the Road and Bridge Department On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Purchasing Agent to advertise for the previously noted bids. The Court next considered vehicle Equipment requests. The Court next considered the request from Verizon to construct 1,913 feet of buried cable installation in the right-of-way of Castenson Road located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for water line installation in the right-of-way of Grassbur Road approximately 0.2 miles from the intersection with Riley Road. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the minutes as submitted. The Court next heard a presentation by the Director of • the Bryan/College Station Metropolitan Planning Organization (MPO) concerning the conceptual plan for railroad track configurations. Mike Parks presented the conceptual plan with Option 12-2-Bypass. He asked the Court to endorse the plan so that the MPO can continue with the study. Joe Merka Mike Parks said that this was merely a conceptual plan and that he would be glad to visit with everyone, give them additional information and hear their concerns. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) The Court, in the not too distant future, will consider allowing the burial of cremated remains at the Boonville Cemetery. b) He received a letter from Representative Bullins requesting and interim study on how we appoint or elect judges. c) He received a letter in reference to SCAT Program fund allocation. He will forward it to the Auditor. Commissioner C. B. Jones stated that he heard on the radio that the City of College Station will request that the Commissioners Court vote on TIF #15. He then asked if it would be placed on the agenda. Commissioner Tony Jones asked that it be placed on the agenda. The County Judge replied that it would be on the next Commissioners Court agenda. Vol Page • Commissioners' Court meeting April 2, 2002 8 The County Judge's Administrative Assistant reminded the Court that a workshop was scheduled for next week to discuss long range facilities. Constable, Precinct 1, James Marrow, thanked Commissioner Tony Jones and the Purchasing Department for their efforts with the purchase of new vehicles for his department. At 9:58 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss privileged matters with counsel concerning litigation with American Casualty Insurance Company, potential litigation with an information technology firm and acquisition of real estate as allowed under Section 551.071 of the Texas Government Code. At 11:04 a.m. the County Judge announced the meeting open to the public. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to institute a law suit against American Casualty Insurance Agency, Inc. and Donna Greak d/b/a Donna Greak Insurance Agency for fraud, • negligent misrepresentation and violation of the Texas Insurance Code. The County Judge then recessed the Commissioners Court meeting of April 2, 2002 until 11:00 a.m. on Wednesday, April 3, 2002. At the conclusion of the engagement, we will provide information to management as to where the reporting packages should be submitted and the number to submit. The workpapers for this engagement are the property of Ingram, Wallis & Co., P.C. and constitute confidential information. However, we may be requested to make certain workpapers available to grantor agencies pursuant to authority given by law or regulation. If requested, access to such is workpapers will be provided under the supervision of Ingram, Wallis & Co., P.C. personnel. Furthermore, upon request, we may provide photocopies of selected workpapers to grantor agencies. The agency may intend, or decide, to distribute the photocopies or information contained therein to others, including other governmental agencies. AND DONNA GREAK DB/A DONNA GREAK INSURANCE AGENCY, AND THE EMPLOYMENT OF THE LAW FIRM OF NEXT AND MUNNELLY, L.L.P. TO PROSECUTE SUCH SUIT. WHEREAS, Brazos County, Texas hereby determines and declares that it is in the County's best interest to pursue claims it has against American Casualty Insurance Agency, Inc. and Donna Greak d/b/a Donna Greak Insurance Agency in a court of law NOW, THEREFORE, BE IT ORDERED BY THE BRAZOS COUNTY COMMISSIONERS THAT: Section 1. The County institute a law suit against American Casualty Insurance Agency, Inc. and Donna Greak d/b/a Donna Greak Insurance Agency for fraud, negligent misrepresentation and violation of the Texas Insurance Code, all of which had an economic impact on the County. Section 2. The institution of such action is in the best interest of the County. Section 3. The County employ the law firm of Hext and Munnelly, L.L.P. to prosecute such claims on behalf of the County and to seek such remedies as it believes appropriate in this matter.
