20. Appointment of a Commissioner to serve on the proposed Tax Increment Reinvestment
Zone #15 Board.

REGULAR MEETING
FEBRUARY 19, 2002
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, February 19, 2002, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1, Absent;
Wm.S. Thornton, Commissioner of Precinct 2;
C. B. Jones, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
The members of the Commissioners Court presented former
Commissioner, Randy Sims, with a plaque for his dedicated
service as a Commissioner in Brazos County.
There was no citizen input/and or concerns
The Court next considered Budget Amendment #01/02-13.1 ,
which would transfer funds to the Tax Office from Contingency.
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.

The Court next considered authorizing the Auditor's
office to process a recurring payment request for the
following:
a) Ikon Office Solutions for lease of copier
for Justice of the Peace, Precinct 1
office, $305 per month.
On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the Auditor's
office to process all the previously noted recurring payment.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
20027699 through 20027957
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve

C. B. Jones, the Court voted unanimously to cancel the March
12, 2002 Commissioners Court meeting.
The next matter for consideration was a request by the

District Attorney for funding for temporary personnel. This
will allow for a transition/training period for both the
positions of Victim Assistance Coordinator as well as the
Administrative Assistant. On motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request for funding for temporary personnel.
The Court next considered authorization for payment of
delinquent invoices for Indigent Health Care prescriptions.
On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the payment
of $14,817.87 in delinquent invoices. The County Judge asked
the Sheriff to accompany him when he visits the pharmacy staff
to stress the importance of receiving invoices in a timely
manner.
The next matter for consideration was the approval of
Amendment Number Four to the Brazos County Employee Benefit
Plan. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
Amendment Number Four to the Brazos County Employee Benefit
Plan that would name College Station Medical Center as a
preferred provider organization, for the deductible and co-pay
plans and increase dependent coverage until the age of 25 if
the dependent is a full time student. A copy is attached.

The next matter for consideration by the Court was a
request submitted by the RC&D Coordinator seeking approval
for out of state travel for Walter Wilcox, Brazos County's
Representative and Chairman of the Big 8 Board of Directors.
Mr: Wilcox would be traveling to Hutchinson, Kansas to attend
the Annual meeting during the week of March 3 through the 7,
2002. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to grant
the request from the RC&D Coordinator and approved payment of
out of state travel expense for Walter Wilcox.
The next matter before the Court was approval of a
Contract Update for receipt of USDA Donated Commodities for
the Juvenile Detention Center. On motion by Commissioner
Cauley, seconded by Commissioner Thornton, the Court voted
unanimously to approve the Contract Update for receipt of USDA
Donated Commodities. A copy of the contractual agreement is
attached hereto.
The Court next considered approval of a Letter of
is Agreement with the Texas Transportation institute for the

County in collaboration with the Brazos County Local Emergency
Planning Committee. On motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously

to - approve the Letter of Agreement with the Texas
Transportation Institute. A copy is attached.
The Court next considered awarding the following Request
for Proposal (RFP):
RFP No. 2002-035, Remodeling of Constable Annex
Pat Howard, Purchasing Agent, recommended
acceptance of the RFP submitted by Orion
Construction. On motion by Commissioner
Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to
accept the recommendation of the
Purchasing Agent and award the contract
to Orion Construction. A copy of the bid
tabulation is attached.
The next matter for consideration was the Extension of
Contract with Ben Sanford and Associates, Inc. for
consultation concerning the County's long distance service
provider. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to extend the
contract at $100 per hour and not to exceed five hours. The
attached requisition in the amount of $500 is approved also.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 2002-043, Seal Coat Project
for all precincts. On motion by Commissioner Cauley, seconded
by Commissioner Thornton, the Court voted unanimously to
authorize the Purchasing Agent to advertise for bids for seal
coating.

county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Paul C.
Patranella, Sr. on Collette Lane to lower a pond spillway to
allow water to drain from culverts located under the Collette
Lane roadway. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the work.
The Court next considered acceptance of the wickson Creek
Special Utility District's cost estimate of $9,200.00 for
water line relocation for improvements on Mize Road in
Precinct 2. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to accept the
Wickson Creek Special Utility District's cost estimate of
$9,200.00 for water line relocation for improvements on Mize
Road. The attached requisition for $9,200.00 is also approved.
The next matter before the Court was a request by the
City of College Station for the waiver of the requirement for
a 60 day notice of the public hearing regarding the
establishment of Tax Increment Reinvestment Zone #15.
Commissioner Thornton moved to approve the request for the
waiver. Commissioner Cauley seconded the motion. Dick
Birdwell asked the Court to deny the request for the time
being to allow the citizens time to understand it. Kim Foutz,

representative of the City of College Station, said that the
waiver was requested only to accommodate the schedules of the
City and the Commissioners Court meetings. The County Judge
then asked to delay the vote until after the presentation to
be'made by the City of College Station. The County Judge then
moved on to agenda item 21.
The Court next heard a presentation by the City of
College Station on the proposed Tax Increment Reinvestment
Zone #15 and other TIFs. Kim Foutz gave the presentation for
funding of a new conference center adding that, tentatively,
there is a public hearing scheduled for March 19,2002.
Charles Cryan, City of College Station representative, gave an
update on active TIFs and reported that the County has
contributed $310,000 toward the active TIFs. The County Judge
then asked if the tax abatement period could be shortened from
the requested 11 years. Ms. Foutz stated that if the
projected revenue indicated the debt would be paid off earlier
than the anticipated 11 years, then it could be an option.
College Station Council Member Massey spoke in favor of the
TIF siting community development. Dick Birdwell voiced
concern on the project and the financing. He emphasized that
this project was in no way similar to the project voted on in
1994. He asked the Court to demand a feasibility study before

joining the TIF. The County Judge then suggested going back
to consider agenda item #19.
The motion on the table was made by Commissioner Thornton
and seconded by Commissioner Cauley to approve the request by
the City for a waiver of the requirement for a 60 day notice
of the public hearing regarding the establishment of Tax
Increment Reinvestment Zone #15. Commissioners, Thornton,
C. B. Jones, and Cauley voted "Aye". The motion carried.
On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to appoint
Commissioner Tony Jones to serve on the proposed Tax Increment
Reinvestment Zone #15 Board.
There were no announcements of interest items nor
possible future agenda topics.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

EMPLOYEE BENEFIT PLAN
STATE OF TEXAS
COUNTY OF BRAZOS
BEFORE ME, the undersigned, a Notary Public in and for said state and county,
personally came and appeared Brazos County, represented by Alvin W. Jones, County Judge,
who declared that the Brazos County Employee Benefit Plan, previously established, is hereby
amended as follows:
ARTICLE I(a) CO-PAY PLAN, MEDICAL COVERAGE, SCHEDULE OF BENEFITS,
the section entitled PREFERRED PROVIDER ORGANIZATION, is hereby restated to
include the direct contract with College Station Medical Center.
PREFERRED PROVIDER ORGANIZATION:
Notwithstanding anything to the contrary contained in this Plan Document, the
Schedule of Benefits contains a Preferred Provider Organization arrangement with
Alliance Brazos Valley and a direct contract with College Station Medical Center,
hereinafter referred to as the PPO Network. The Plan will provide the Covered Person
with a list of all the participating providers in this arrangement.
Preferred Providers are providers who have contracted with the PPO Network and who
have agreed to accept reduced payments for covered services rendered to individuals
covered under the Plan.
Non-Preferred Providers are providers who have not contracted with the PPO
Network.

ARTICLE 11, DEF 141MONS, CO-PAY AND DEDUCTIBLE PLAN, DEPENDENT, is
hereby amended in a: good faith effort to comply with Texas House Bill 1440. Such definition
is hereby restated in its entirety:
DEPENDENT
One or more of the following person(s):
A. An Employee's legal spouse;
B. An unmarried child to age 25 to include:
a natural child, adopted children and stepchildren. It is not required that these
children reside with or receive principal support from the Employee or the
Employee's spouse. (Note: An adopted child is a child placed with a covered
Employee. Placement is defined as the assumption and retention of a legal
obligation for total or partial support of a child in anticipation of adoption of such
child.)

claimed as an exemption for federal income tax purposes.

chiefly dependent upon the Employee for support and maintenance. Proof of the
incapacity and dependency shall be furnished to the Plan within 31 days of the
child's attainment of 25 and subsequently as may be required by the Plan but not
more frequently than annually after the two-year period following the child's
attainment of the limiting age.
The Employer reserves the right to require whatever documentation it deems necessary to satisfy
that the individual meets the definition of a Dependect.
This Amendment shall be effective January 1, 2002.

NONGOVERNMENTAL CONTRACTOR CERTIFICATION
The Texas Department of Human Services (DHS) has adopted rules pertaining to contracting with organizations in which a former
board member or employee (whose last day of duty was within the past two years) has any ownership or control, or who Is an
employee or consultant of such organization. Also, Human Resources Code 422.0033 prohibits for one year after employment
former DHS employees in pay grades equivalent to or above pay grade 17, Step 1, from helping (for pay) another entity obtain a
contract with DHS In an area for which the former employee was directly concerned or had administrative responsilATity.
Additionally, DHS has adopted standards for contracting with contractors associated with current or former employees and board
members, and their relatives. This form is necessary to help the Department determine compliance with those rules.

Dear Judge Jones:
This letter shall serve as a formal contract between the Texas Transportation Institute
and Brazos County for the service outlined below.

As proposed, the estimated cost (fixed-price) for conducting these services is $19,200.
In keeping with TTI operating requirements, one payment of $3,200 is to be retumed
with a fully executed copy of this agreement. Five (5) Monthly payments of $3,200 each
will be due the on the first of the month starting April 1 and ending August 1, 2002. The
period of performance will be 3-1-02 to 8-31-02.
This contract may be terminated before the stated termination date by: mutual
agreement and consent, in writing of both parties; any party for reasons of its own and
not subject to the mutual consent of the other party(ies) upon not less than thirty (30)
days written notice; and by satisfactory completion of all services and obligations
described herein.
The Texas A&M University System serves people of all ages, regardless of

The Texas Transportation Institute (Texas A&M University System), in collaboration with
the Brazos County Local Emergency Planning Committee (LEPC), proposes to conduct a hazardous
materials flow survey in Brazos County. The primary purpose of the commodity flow study is to
identify the types and commodities transported through a specified geographic area, such as a single
community, state, or urban area and the routes used for transporting those commodities. Upon
completion of the hazardous materials commodity flow study, planners will have a better
understanding of hazardous materials transportation patterns and can use these data to conduct
• planning and to estimate the risks facing the jurisdiction.
TTI's research team and technical activities will include assisting the LEPC in identifying the
objectives of the study, the design and conduct of the study, training of involved personnel, analysis
of the data and guidance for application of results.
SCOPE ONRESEARCH
The overall scope of the study will include these major components: 1) identification of
hazardous materials transportation flow patterns in the study area, 2) identification of fixed facilities
that handle or store hazardous materials, 3) performance of a general assessment of issues regarding
hazardous materials transport, and 4) performance of an analysis of the data and identification and
assessment of vulnerabilities.
This study will encompass all hazardous materials. For the purpose of this study, U.S. DOT"s
hazardous materials definitions will be used to classify materials, and any commodity that does not
fall under the U.S. DOT hazardous classification will be classified as non-hazardous.

STATEMENT OF WORK
Task 1 Identify the Purpose of the Study
A commodity flow study is the collection of data on transportation patterns within a
jurisdiction. A jurisdiction often has specific objectives for conducting a hazardous material
commodity flow study based on the particular needs of the area. TTI researchers will collaborate
with members of the Brazos County LEPC to identify the objectives of the proposed study.

Primary Objective
The primary objective of the study will be a routing risk analysis. The commodity flow study
undertaken in the study will be a routing risk analysis which relates to the following basic objectives:
• Identify hazardous materials transportation flow patterns which will identify current
routes that are being used for hazmat, and determine the relative amounts of through
truck traffic.
• Identify fixed facilities in the area that are locations for shipping out, receiving,
and/or storing hazardous materials.
• Assess possible issues regarding hazardous material transport in the study area by
collecting applicable hazardous materials accident reports, truck data, and vehicle
accident data.
• Perform a vulnerability analysis that defines the hazardous materials threat, identifies
the facilities and populations at risk, identify locations, and provide a general
consequences assessment.
Task 2 Establish a Study Approach and Data Requirements
The following broad operational objectives and guidelines are suggested in establishing a
study approach:
1. The transportation flow study will be designed to analyze amounts and types of
hazardous materials within Brazos County. Although the study will focus on truck
traffic, other transport modes, such as rail, will be examined for hazardous materials
transport. Traffic over any existing hazardous materials routes as well as selected
alternate routes will be examined. The study proposes to identify the number of
trucks which carry hazardous materials into, through, and throughout the county. The
times of day when these shipments transit the area as well as the quantity of
hazardous materials by name will be examined.
2. Information collected during the transportation flow study will be used to identify
fixed sites where hazardous materials are stored while in transit as well as where
operations involve end use oftransported hazardous materials, and where hazardous
waste storage and/or disposal occurs.
The study will perform an initial background assessment regarding the transportation
of hazardous materials within the area. This assessment will include a historical
review of the number and types of threats, such as spills, releases, and vehicle
accidents which have occurred in the area.

4. The identification of the most common types of hazardous materials traversing the
county will be linked with the determination of location and size of populations most
at risk to a transportation accident using worst case scenarios. Additionally, the
location of special population facilities most at risk to an accident will be identified.
TTI researchers will review hazardous materials flow studies undertaken in other parts of the
State and Nation in the course of completing the study design. Researchers will, in consultation with
the Brazos County LEPC, outline the information and data requirements needed to implement the
objectives and approach previously identified.
Task 3 Assemble Existing Information
Prior to undertaking the actual survey, available data must be examined for possible insights
into the flow pattern as it exists. To select routes to focus on during the study, it is important to
determine which roads within a geographic area are capable of supporting hazardous materials and to
• identify the amounts and types of materials that are being transported over those roads. The
information sources reviewed in this task will support this determination.
Task 3.1 Industry Survey of Firms Shipping and Receiving Hazardous Materials.
In order to establish the types and quantities of hazardous materials being transported and to
arrive at a better understanding of the magnitude of the risks and impacts of routing alternatives, a
survey of firms and fixed facilities will be conducted. A literature survey will also be undertaken to
locate information regarding materials shipped in the area.
Task 3.2 Review of Hazardous Materials Truck Accident Data
Several sources of information will be reviewed to obtain a better understanding of the causes
of hazardous materials truck accidents, the potential consequences of these accidents, and the role in
which emergency response capability may play in alleviating the risk. Possible sources used in this
task are the U.S. Department of Transportation Hazardous Materials Information System (HMS)
and the Texas Natural Resource Conservation Commission (TNRCC) databases.
• Task 3.3 Collect Information on Existing/Alternative Transportation Routes
In this task TTI researchers will collect information related to population density, terrain,
weather, response capabilities, local exposure and risk factors, continuity of routes, alternative
routes, effects of commerce, delays in transportation, climatic conditions, and congestion on existing
routes.
Task 4 Design a Field Commodity Flow Survey
Tasks 1-3 will define the scope of the field investigation, which will be designed in this task

and conducted in Task 5. The design of the field survey will focus on collecting more specific data
that complements information obtained in Task 3. Essentially, the field survey will provide
information on the frequency and type of hazardous material shipments being shipped in the
proximity of the LEPC.
• Elements of Industry Survey of Firms Shipping and Receiving Hazardous Materials
- Past, present, or anticipated hazmat shipments originating or terminating
- types of hazmat shipped
- hazmat transportation routes used
Results of the industry survey will highlight the need for additional information and the
difficulties in obtaining data. It is anticipated that the industry survey will provide some information
regarding the specific hazardous material shipments, a more complete picture of the potential amount
of hazardous materials shipped through respective LEPC neighborhoods will be obtained through a
field investigation.
Vehicle Counts will establish frequency and type of hazardous materials shipments
- on designated hazardous material routes
- on select alternate routes
Study Design Elements
- Researchers will conduct placard survey vehicle counts
- Survey will include all designated hazmat routes
- Count will sample as much of the 24-hour day as possible
- Count will be conducted during the weekdays and weekends
Survey Record Components
- Vehicle Type (tractor/trailer, tandem trailer, or tank trailer) displaying a
hazardous materials placard
- U.S. DOT placard on vehicle
- Commodity identification number
- direction of travel
- time the vehicle passes the survey location
- total number of trucks passing the survey location
Task 5 Conduct a Field Commodity Flow Survey and Other Data Collection
TTI researchers will conduct a field commodity flow survey designed in Task 4. Depending
upon the final goals of the study, TTI researchers will devise appropriate data collection and
recording procedures, which may include: placard survey, shipping paper review, and/or driver
interviews.

Task 6. Compile Results and Conduct Analysis
TTI researchers will conduct an analysis of data gathered in the previous tasks based on
guidelines provided in the literature and by the FHWA to identify vulnerabilities in the study area.
This analysis will provide information on:
Hazardous materials transportation flow patterns in the study area including,
► Types of materials by identification number,
► Routes used to transport materials as identified by placard survey
► Types of hazardous materials by route, and
► Types of hazardous materials by hazard.
2. Information pertaining to fixed facilities that handle or store hazardous materials
including:
► Summary of the types of hazardous materials that are shipped, received,
• and/or stored in the study area,
► Summary of the amounts of hazardous materials that are shipped, received,
and/or stored in the study area,
► Modes of transportation used for hazardous materials that are shipped,
received, and/or stored in the study area.
► Origins and destinations for hazardous materials that are shipped, received,
and/or stored in the study area.
► Routes reported by facilities to transport hazardous materials through the
study area.
3. Performance of a general assessment of the accident probability in the study area
regarding accidents involving hazardous materials, including accident and incident
history of the study area as well as identification of areas for concern.
4. Performance of a modified risk/vulnerability analysis to evaluate potential
consequences of accidents.
Task 7. Prepare Final Report
• A final report will be prepared fully documenting the research effort and findings. The final
report will include results of the commodity flow study that can be used to improve preparedness,
prevention, and response capabilities by designating specific routes to be used for the transportation
of hazardous materials, and other focused planning efforts.
The final report will consist of the following items: a detailed report outlining all findings
and documentation of data gathered in the study; an executive summary, and a power point slide
presentation outlining findings. The report will be furnished in both hard copy and electronic form.
