To make arrangements, call (979) 361-4102. • COMMISSIONERS' COURT REGULAR MEETING JANUARY 29, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 29, 2002, with the following members of the Court present: • Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns The Court next heard a presentation and then considered approval of a candidate for the County Extension Agent - • Family and Consumer Sciences position with the Texas Cooperative Extension Office. Zelda Williams, District Extension Director introduced Dr. Alma Fonseca to the Court. On motion by Commissioner Thornton, seconded by Commissioners Tony Jones, C. B. Jones, Cauley and the County Judge, the Court voted unanimously to approve Dr. Alma Fonseca as the Vol ~L~ Page a ~e a, E Commissioners' Court meeting January 29, 2002 2 County Extension Agent - Family and Consumer Sciences. The Court welcomed her to the County. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20026909 through 20027164 On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. The next matter before the Court was the reconsideration of previous action taken concerning the elimination of the Place 1 and Place 2 Justice of the Peace positions in Precinct 2. The County Judge moved to reconsider the previous action. Commissioner Cauley seconded the motion. Commissioners Tony Jones, Thornton, Cauley and the County Judge voted "Aye". Commissioner C. B. Jones abstained. The County Judge stated that his reason for doing this was that the candidates winning the primary were not guaranteed a spot on the November ballot. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to change Class 1729, Position 1 from Group 8, Step 2 to Group 11, Step 2 and Class 1727, Position 1 from Group 16, Step 2 • down to Group 14, Step 2. The Court next considered approving the submission of a letter to Governor Rick Perry referencing HB 178 that concerns the reimbursement to counties for the mandated assistant prosecutors' longevity supplement. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to forward the letter to Governor Perry. The next matter before the Court was the approval of an Addendum to the Brazos County Events Facilities Contract. On • motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the attached Addendum. The next matter for consideration by the Court was a request submitted by the Sheriff's Office- Jail Administration seeking approval for out of state travel for Lt. Clarence Henry, Sgt. David Drosche, Detention Officer Jayson Lyday and Deputy John Carlson. They would be traveling to Moundsville, Vol a~ Page 40 Commissioners' Court meeting January 29, 2002 4 West Virginia to attend the Mock Prison Riot Training and Conference May 4th through the 9th, 2002. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from the Jail Administrator and approved payment of out of state travel expense for previously named individuals. The Court proceeded with the appointment of Commissioners to serve on the Brazos County Rural Fire Prevention District No. 1. On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to appoint the following individuals to the board of the Brazos County Rural Fire Prevention District No. 1: Charles H. Ellis, Jr. one year term Lynn Elliott one year term Charles Robertson two year term A. P. Boyd two year term Michael Herron, M.D. two year term The next matter before the Court was the renewal of the Basic Life/AD&D and Optional Life Insurance policy with Canada Life and increase in the rate for the Basic Life and AD&D Insurance. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to amend the Plan Document of the Sun Life of Canada Stop Loss Policy to reflect the wording of the reinsurance contract in certain areas. A copy is attached. The next matter for consideration was the correction of the "Appointment of Designated Representative,, clause of the College Station Medical Center Hospital Services Agreement. on motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to correct the appointment of designated representative and designate Employee Benefit • Services, Inc. only, as Designated Representative. A copy of the College Station Medical Center Hospital Services Agreement is attached. The Court next considered a request by the Purchasing Department for additional funding for Account 653100, Vol .I Page 40 Commissioners' Court meeting January 29, 2002 6 Equipment Repairs /Maintenance for the Fuel Management System. This request is due to lightening striking the system causing $1,419.25 in needed repairs. On motion by Commissioner Cauley, seconded by Commissioner C.B. Jones, the Court voted unanimously to approve the request. The Court proceeded to consider the following blanket Purchase Order: Lowe's Brazos Center $1,000 On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered approval of a Hardware Maintenance Agreement and Software maintenance/upgrade agreement with BioIdentix, Inc. for the ID badge equipment for Courthouse Security. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve a Hardware Maintenance Agreement and Software Maintenance/Upgrade agreement with BioIdentix, Inc. A copy of the Agreement is attached. The next matter before the Court was approval of an Amendment to the Copier Lease Agreement with IKON. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve an Amendment to the Copier Lease Agreement with IKON. A copy is attached. The Court next considered a request from Delos L. Wimberly for variance from the Brazos County Flood Damage • Prevention Ordinance to add a second residential structure to a 1.16 acre lot located in Sandy Oaks Subdivision in Precinct 4. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to allow the variance so long as the Health Department has been notified that both home sites meet standards set forth by the Texas Natural Resource Conservation Commission (TNRCC) and that the flood plain issues have been addressed. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for waterline installation in the right-of-way of Step Hollow Road approximately 3,200 feet from its intersection with Elmo • Weedon Road in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner C. B. Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the Vol OL Page ;L to g is Commissioners' Court meeting January 29, 2002 8 installation. The Court next considered the request from Verizon to construct buried cable installation in the right-of-way of Broach Road beginning at its intersection with FM 2223 and extending east for a distance of 645 feet. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the request from Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Verizon to construct a road bore and approximately 1,485 feet of buried cable installation in the right-of-way of Old Bundick Road in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. on motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the request from Verizon and authorized the installation. A copy of the request is attached hereto. The court next heard a presentation by the District Attorney in reference to restitution payments to victims. Under announcement of interest items and possible future agenda topics Commissioner Tony Jones made the following comment : • a) He thinks we need to have a workshop on new locations for the offices working in the Annex. The Annex is part of a parcel of land that will become a parking garage. Commissioner Cauley responded that the District Judges needed to take more misdemeanor cases rather than employing a magistrate. 361"t District Judge, Steve Smith, addressed the point for employing a magistrate. The County Attorney answered the Court's question concerning misdemeanor cases. 10 b) 85`h District Court Judge, J. D. Langely's ^ mother died. The funeral is Thursday, January 31, 2001 in Greenville, Texas. There was no citizen input and/or concerns. At 10:11 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss the acquisition of property for the Exposition Center as allowed under Section 551.072 of the Texas Government Code. At 10:35 a.m. the County Judge announced the meeting open to the public and announced that no action would be taken on the Closed Executive Session. There being no further business to come before the Court, the meeting was adjourned. Any additional Customer requested changes unique to Customer will be billed at the rate of S 125.00 per hour (minimum $50) and billed in hour increments, or on a flat rate fee basis agreed upon by both patties. Service Response: BioIdentix will accept notices (at designated phone numbers - 281-412-6670 or 281-338-2783) of software malfunction between 8:00 am and 6:00 pm Monday through Friday, (excepting national holidays) for normal hour service. Customer will be notified (and approve) of any service required outside of normal hours. Bioldentix shall respond within 4 hours from time of notification and shall commence corrective action immediately and shall diligently pursue such action until the malfimctionts are resolved. Customer shall cooperate with Bioldentix in making tests of other peripheral devices not provided by BioIdentix available. C. Contract Term: Effective date and BioIdentix's obligation to provide Software support and customer's obligation to begin paying under this agreement shall commence at the time of signing of this agreement and/or the issuing of a purchase order for this agreement, whichever occurs fast and continue in force for a period of one year. D. Contract Extenstion: BioIdentix will provide a renewal notification to Customer 60 days prior to the contract expiration date. Customer agrees to provide BioIdentix in writing a cancellation notice 30 days prior to contract expiration. Failure to do so will result in automatic contract renewal for an additional one year period. • E. Contract Amount: Two Thousand Three Hundred Ninety Seven Dollars and No Cents. Limitation of Remedies: Bioldentix's entire liability to Customer for any losses or damages, other than personal injury, whether based on contract, warranty, tort, otherwise, and whether direct, indirect, incidental, consequential, special, or exemplary, arising from the use or inability to use the goods or services that BioIdentix famished or failed to famish under this is agreement, shall not exceed the contract price paid by Customer under this agreement. SINCERELY, • JOHN ARNOLD SUPERVISOR - ACCESS DESIGN JA: EC ATTACHMENT z' ~YL D vo p4c r o K A5 49 VERIZON COMMUNICATION Notice of Line Installation January 17, 2002 To The Commissioner's Court of Brazos County ATTENTION COUNTY JUDGE: Formal notice is hereby given that VERIZON COMMUNICATIONS will construct a communication line within the right-of-way of a County Road in Brazos County, Texas as follows: Beginning at the southwest comer of the FM 974 Macey Road and Old Bundick Road intersection a cable will be direct buried 5 ft within and along the south R.O.W. proceeding east for a distance of 17 feet where a 50 foot bore will be made to the north R.O.W. to point of end. A second section of cable will be placed direct buried starling approximately 1.3 miles from above mentioned intersection 5 feet within and along the north R.O.W. of Old Bundick Road that will proceed east for 1436 feet to a point of end. A third section of cable will be placed direct buried for 32 feet at the Acacia pipeline crossing at the north R.O.W. of Old Bundick Road where cable has been damaged. The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that the tender of this notice by the Verizon Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void. Construction of this line will begin on or after January 21, 2002.
