V~ ~ • COMMISSIONERS' COURT REGULAR MEETING JANUARY 8, 2002 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 8, 2002, with the following members of'the Court present: • Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2; C. B. Jones, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Tony Jones gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns The Court first considered authorizing the Auditor's office to process a recurring payment request for the • following: a) BI, Inc. for rental of monitoring equipment $1,394.55 monthly payment. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Auditor's office to process the previously noted recurring payment. Vol ac1 Page • Commissioners' Court meeting January 8, 2002 2 The Court next considered the following Claims as submitted by the County Treasurer for payment: 20026221 through 20026442 On motion by Commissioner Tony Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted The Court next considered an Extension of Agreement between Brazos County and the Bryan-College Station Economic Development Corporation (EDC). The County and the EDC are in the process of re-negotiating their contract but have been unable to complete the process prior to the expiration of the contract term. On motion by Commissioner Thornton, seconded by Commissioner Tony Jones, the Court voted unanimously to extend the contract for a two-month period ending January 31, 2002 and the County will pay the EDC the sum of $41, 158.55 for services rendered for the month of December 2001 and services to be rendered in January 2002. The Court next considered recommendations concerning Tax Abatement Agreements. Bob Malaise, representative of the Economic Development Corporation (EDC), explained the current contract status for the following companies and gave recommendations: Vol 4 9Page 8? • Commissioners' Court meeting January 8, 2002 3 a. Betco, Inc. is not in full compliance with the contract requirements and should be notified of the default with the remedy being a pro-rated loss of year 2001 tax abatement. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the EDC representative and amend the contract to include a prorated tax abatement clause, unless Betco, Inc. meets all requirements for 2002. b. DecisionOne, Inc. is not in full compliance with the contract requirements and should be notified of the default with the remedy being a pro-rated loss of year 2001 tax abatement. On motion by the County • Judge, seconded by Commissioner Thornton, the Court voted unanimously to accept the recommendation of the EDC representative and amend the contract to include a prorated tax abatement clause. C. Koch Microelectronic Service Company, Inc. is not in compliance with the contract requirements and should be notified of default with the remedy being the loss of year 2001 tax abatement. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the EDC representative. The Court next considered authorization for the County Judge to execute contracts for Residential Services for the Juvenile Services Department. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the County Judge to execute contracts is for Residential Services for the Juvenile Services Department. The next matter before the Court was a request from Justice of the Peace, Precinct 1, for authorization to increase the cash drawer fund from $50.00 to $200.00. The Court next considered authorization for payment of $2,365.85 for indigent health care from funds carried over from the 2001 fiscal year. On motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the payment of $2,365.85 for indigent health care. The next matter before the Court was the exemption from taxation of travel trailers that are not held for the production of income. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to exempt from taxation, travel trailers that are not held for the production of income. The Court proceeded to appoint members of the Brazos County Fire Prevention District #4 Commissioners Board. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to appoint Anderson Jones, James Green and Sue Moody for a two year term beginning January 1, 2002 and ending December 31, 2004. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for November 2001. A copy of which is attached to and made a part of these minutes. On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Official Bond of Dee Wayne Thompson, Constable, Precinct 3. The Court proceeded to consider the following blanket Purchase Order: AES Staffing District Clerk $3,000 On * motion by Commissioner Cauley, seconded by Commissioner Tony Jones, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The next matter for consideration was approval for the Purchasing Agent to advertise for the following bids: a. Bid 2002-030, Decking Timbers b. Bid 2002-031, Bridge Piling C. Bid 2002-032, Bridge Repairs d. Bid 2002-033, Gasoline/Diesel Fuel on motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for the previously noted bids. Precinct 1 - It is proposed that the remainder of the budget for the elected Justice of the Peace, Precinct 2 be transferred to the newly appointed Justice of the Peace, Precinct 1. The County Judge asked if funding for overtime was available. The County Auditor replied that funding was available in the existing budget for all Constable precincts except for $2,000 which could come out of the contingency fund. The Court next considered approval of appointment and salaries for deputy constables for the following precincts: a. Precinct 1, On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the appointment and salaries for deputy constables. b. Precinct 2, Commissioner Tony Jones moved to approve the appointment and salaries for deputy constables. Commissioner Cauley seconded the motion. Commissioner Tony Jones asked that the original motion include funding for two (2) additional deputies. The funding to come from the • County Judge's budget and Contingency. After considerable discussion Commissioner Tony Jones amended his motion to fund the positions from the old Precinct 6 budget and the Commissioners Court budget. The County Judge called for a vote on the amendment. Commissioners Tony Jones, Thornton, C. B. Jones and Cauley voted "Aye". The County Judge abstained. Then the County Judge called for a vote on the original motion which was to approve the appointment and salaries for deputy constables. Commissioners Tony Jones, Thornton, C. B. Precinct 4, On motion by Commissioner Tony Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the appointment and salaries for deputy constables. The next matter before the Court was the approval of a part-time bailiff position and funding for the Juvenile Referee. On motion by the County Judge, seconded by Commissioner Tony Jones, the Court voted unanimously to remove this item from the agenda. It was the opinion of the Court that the Constables would have enough time to perform the service. . The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the changes as submitted. There were no announcements of interest items and possible future agenda topics. There was no citizen input and/or concerns. At 10:22 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in Closed Executive Session to discuss the acquisition of real property as allowed under Section 551.072 of the Texas Government Code. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS that for and in mutual consideration herein expressed, the parties agree as follows: 1. The Contract is hereby extended for a two month period ending January 31, 2002. Pursuant to such extension, the COUNTY will pay to the EDC the sum of $41,158.55 for services rendered for the month of December, 2001 and to be rendered in January, 2002. 3.
