O.s r~ U COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 4, 2001 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, September 4, 2001, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm.S. Thornton, Commissioner of Precinct 2, via telephone; • Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Jones gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #00/01-42.1, which would reallocate funds for the Capital Improvements Fund. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. • The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20022415 through 20022651 On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. Vol Page 3I Commissioners' Court meeting September 4, 2001 2 The next matter for consideration by the Court was rescinding the Order Banning Out Door Burning. According to the Emergency Management Coordinator, the drought index is dropping. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to rescind the Order Banning Out Door Burning. The Court next considered approval of the 2002 Plan Options for the County Retirement Plan. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to continue with the current plan. The next matter before the Court was approval of enrollment in the Internet Vehicle Registration Program for the County Tax Assessor-Collector. On motion by commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve enrollment and participation in the Internet Vehicle Registration Program. A copy of the enrollment form is attached. The Court next considered adopting an Order Establishing Rules for the Burial of Paupers. Commissioner Thornton asked who would assume responsibility for determining if someone is a pauper and the disposition of the ashes. Judge Jones noted the Court would approve the order and address Commissioner Thornton's questions at a later date. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to adopt the Order Establishing Rules for the Burial of Paupers. A copy is attached. The Court proceeded to consider a Tax Resale Deed and authorization for the County Judge to execute the Tax Resale Deed to Carol Ann Crawford Green. This a part of the S. F. Austin Survey No. 9, Abstract 62, City of Bryan, Brazos County, Texas, more particularly described by metes and bounds in Volume 117, Page 342 of the Brazos County Deed Records. On Vol 95- Page 3a- • Commissioners' Court meeting September 4, 2001 3 motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to execute the Tax Resale Deed to Carol Ann Crawford Green. The Court next considered approval of a Maintenance Agreement with MAGEC Technology Solutions Corporation on a line printer for the Information Technology Department. Due to a clerical error the paperwork was delayed. The maintenance agreement should have been included with the purchase of the replacement printer that was approved February • 20, 2001. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Maintenance Agreement with MAGEC Technology Solutions Corporation. A copy is attached. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Frank Cotton on Fickey Road to re-route a creek channel and reinforce the right-of-way with excess fill material to prevent further erosion. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. • The court next considered a requisition from the county Court at Law #1 Minor Furniture Funds for three chairs. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve payment of the requisition in the amount of $762.75. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2002-009, Pavement/Road Service Painting. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for Pavement/Road Service Painting. Brenham Wholesale Grocery Co. withdraw their bid based`°on the result of the bid award. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to re-award a portion of the commissary bid as follows: Item I-10 to Keefe Supply I-12 to Midstate Services I-19 to Brazos Wholesale I-21 to Keefe Supply II-8 to ICS II-12 to ICS III-1 to ICS III-7 to Brazos Wholesale A copy of the bid tabulation is attached. The Court next considered awarding the bid for Car Rental. Pat Howard, Purchasing Agent, recommended acceptance of the bid submitted by Enterprise Company. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Enterprise Company. A copy of the bid tabulation is attached. The Court next considered renewing the bid for Landscaping Services. Pat Howard, Purchasing Agent, recommended renewing the contract with The Greenery for another year at the same cost to the county. on motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to accept the recommendation of the Purchasing Agent to renew the contract with The Greenery. A copy if the contract is attached. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for July 2001. A copy of which is attached to and made a part of these minutes. The following people spoke in support of an increase for the County Sheriff: 1. Joe Bergstad 2. Demetrios Basdekas 3. G. H. Jones Commissioner Sims then moved to kept the Sheriff's salary at the budgeted amount. Commissioner Jones seconded the motion. Commissioner Sims and the County Judge voted "Aye". • Commissioners Cauley and Jones abstained. The motion failed. Under announcement of interest items and possible future agenda topics the County Judge made the following comments: a) He reminded the Court of the tax rate vote scheduled at 10:00 a.m. today. There was no citizen input and/or concerns. At 9:28 a.m. the County Judge announced the meeting closed to the public so that the Court could meet in closed executive session to discuss acquisition of real property for the Exposition Center as allowed under Section 551.072 Texas Government Code. At 9:30 a.m. the County Judge announced the meeting open to the public and that no action would be taken on the Closed Executive Session. • There being no further business to come before the Court, the meeting was adjourned. THEREFORE, BE IT ORDERED by the County Commissioners Court of the County of Brazos, Texas: 1. That the findings and recitals in the Preamble of this Order are hereby found and determined to be true and correct and are hereby approved and adopted. 2. Brazos County shall be responsible for the cost of the disposition of the body of a f. person dying in Brazos County, Texas who fits within the definition of "Pauper" set forth below. 3. Such disposition shall be by cremation. 4. A person shall be determined to be a pauper, for purposes of this Order, premised on income levels per family unit size set forth in the Poverty Guidelines promulgated by the Department of Health and Human Services, as those Guidelines are amended annually and published in the Federal Register. 5. Family members of a person determined to be a pauper, as stated above, may object to the form of disposition of the deceased's body, but only if such family member(s) presents to the County a certified check for the difference in the cost between cremation and the family requested form of burial. 6. Any contributions made by pauper's family to the County for the cost of burial shall be deposited in the County's general fund. Effective this day of 2001. Alvin . The statute requiring the County to undertake this obligation, as you know, is fairly vague, leaving many questions to be decided by the County. One issue that I raised was the ultimate disposition of the ashes of the cremated pauper. I chose to simply not discuss that in the Order. The other question is what branch or department of the County is to be assigned the task of establishing whether or not a person is a pauper by applying the HHS Guidelines? (MTS). Purpose Customer desires that MTS provide ongoing maintenance for the printer(s) described in Schedule A attached to this agreement; MTS agrees to provide such maintenance service according to the terms and conditions herein. The word printer as used in this agreement includes any printing device and any attachments or accessories associated with it Maintenance Fee Customer agrees to pay to MTS a Maintenance Fee in advance for the maintenance service to be provided for uie printeis li3tcd ui Sr hoduio A. The addition of attachments or features to a printer may incur additional maintenance fees. MTS reserves the right to adjust maintenance fees based upon increased cost of parts or other reasonable considerations upon sixty-day advance notice to Customer after the first year of this agreement. Upon receipt of such notice from MTS, Customer has the right to delete the printer(s) affected and to receive a fill refund of any unused prepaid maintenance fees for such printer(s). Term of agreement This agreement is effective for a period of 60 months (the "Initial Term") commencing on Apr 1, 2001 and ending on Mar 30, 2006. This agreement automatically renews for like period or on a month to month basis upon completion of the Initial Term unless either party issues written notice to the other requesting that it not renew. Such written notice must be given prior to the ending date. Level of service Maintenance service will be provided on one of the two options listed below, indicated by a checkmark. __2L_(4-Hour Response) MTS will respond to a service call from Customer within four hours of receipt of the call- This coverage is active five days per week; 9 hours per day excluding only published MTS holidays. During published holidays MTS will use its best efforts to respond in a timely manner. Remedial maintenance will be provided during normal working hours. MTS will issue a prorated refund of any maintenance fee paid in advance for the deleted printer(s). Customer may, after the completion of the Initial Term, terminate this agreement by issuing written notice to MTS with thirty days notice given. Customer will be entitled to a refund of eighty percent (80%) of any advance payment of maintenance fee for the unused period. Eligibility Any new printer purchased by Customer from MfS and installed by MTS is eligible for maintenance coverage. Any printer not installed by MTS, whether new or not, must be inspected (and repaired, if needed) by MTS and certified in order to be eligible for maintenance coverage. MTS charges a fee for either installation or inspection and certification. Repairs are charged for on a time and materials basis using the then-current MTS service rates. A printer which is covered may become ineligible and subject to be removed from coverage by MTS for reasons that it has been misused, modified, improperly serviced by other then MTS personnel, used excessively, subjected to unusual mechanical or electrical stress, or subjected to consumables not approved by MTS and the equipment manufacturer. (MT'S can provide approved consumables and parts for all printers sold by MTS and for most other printers). Damage due to a power surge is not covered under this maintenance contract For protection against a power surge, MTS recommends the use of a high quality surge suppression device. The device should have an insurance coverage/warranty adequate to cover the cost of any damage to your printer, in the event of a power surge. Repair work or service which must be performed as a result of any of the reasons listed above will be charged for at the MTS time and materials rate in effect at the time the service is provided After completion of such repair or service MTS may determine that the printer in question is or is not eligible for continued maintenance coverage. Vol Access to equipment Customer agrees to furnish sufficient access to all printers covered in order for MTS to accomplish its responsibilities of this agreement Movement or shipping of printer Customer is responsible, in the event that a printer is moved, for proper packaging and shipping. MTS may require that any printer which has been moved be re-inspected and re-certiSed as eligible for maintenance coverage. MTS will charge at its then-current time and materials rates for such activity. Customer is responsible to ensure that power sources are adequate and appropriate at the new location and that use of the printer at the new location does not violate any government regulations or laws, including those addressing safety or environmental protection. Liability MTS will not be liable for any special, indirect, or consequential damages. The terms and conditions of this agreement prevail notwithstanding any variation from the terms and conditions of any other, past, present, • or future agreement between the parties.
